From: roc@xpresso.seaslug.org (Bill Vance) Subject: FCC Public File Auto-FAQ Date: 01 Jan 1999 03:57:10 PST This "FAQ" is auto-posted once a month via cron triggered script, and may be triggered off by hand from time to time in between if the info is requested by someone, such as when the House recently voted down the AW Ban and the Media threw a hissy fit. The purpose of this FAQ is to inform people what they can do about Media generated lies and misinformation. While the FCC only handles Broadcast Media, (TV and Radio), some of these techniques will work for magazines and newspapers too. If I've missed something, or you find errors, let me know and I'll add/fix it. 1.a. Send letters of complaint to the Station Manager every time it happens with all the time, details, other info, and your complaint(s). 1.b. Send an additional copy for their FCC (Federal Communications Commission) Public file. 1.c. Send an additional copy to the FCC itself, in case they don't put it in their Public file. 2.a. Send a letter of complaint to their Station Owner as per above, with copies as per above (1.b and 1.c). 3. Send copies of their replies to you along with yours to them to their FCC Public file, so that it gets nice and fat, again, with copies to the FCC itself. 4. If you can afford it, send all corespondence by Certified Mail with Return Receipt Requested. Send a copy of the Return Receipt with everything that goes to the FCC itself, so that they will have additional evidence if the Station is cheating on their Public File. 5.a. Go to the Public Library and look up "Standard Rate and Data Services" (SRDS) "Directory of National Advertisers." It is found in many major Libraries (in the business/reference stacks), and lists EVERY current advertiser, who the players are at both the company and advertising agency(s), and the appropriate telephone and fax (and probably E-Mail by now) addresses. If your Library doesn't have it, it can be requested. Otherwise you can watch their commercials for a few days to a week, listing all their advertisers. There are other references that have the addresses for the nation's business headquarters too. look them all up and pass the addresses and phone/FAX numbers etc., around so that everyone can bitch to the sponsors. IF enough people do that, it'll get back to the Station. Tell them if the Station continues their nastiness you'll _consider_ changing to brand(X), (otherwise they'll just write you off as a loss). 5.b. The above, (5.a.), can be a lot easier and less time consuming if you're dealing with a newspaper's or a magazine's ads, as they are right in front of you for the listing. 6. If they put on something good or even just more reasonable, call and compliment them on it, but do _not_ send any kudos to their FCC file, or write to them about it. That way they have to keep it up and hope, as there is nothing good in the file or in writing that they can show the FCC to justify their Station's License. 7. Shortly after winning the 1996 presidential election, Bill Clinton told a gathering of fellow Democrats that his opponents constitute a cancer on American politics, and swore to excise them from the political scene during the next four years. Before that, he claimed that our Constitution is "radical," and that its authors may have set aside too many freedoms and rights for ordinary American citizens. On the evening of Dec. 31, 1998, a reporter for CNN Headline News named Candy Crowley was talking about the dimming prospects for a Senate censure of the recently impeached Clinton, in the face of insistence from "conservatives" that the Constitution requires that the President stand trial. Crowley bemoaned the fact that censure, "a popular, mainstream idea," was going down in flames on Capitol Hill. Political discussion (and "reporting") throughout 1998, and indeed since 1992 by some odd coincidence, has been brim-full of such indictments of conservatives and the things we hold dear. We're "extremists," they say. We revere a "radical" Constitution and use it to shoot down "popular, mainstream" ideas. One might be excused for getting the impression that those speaking don't like us much. Indeed, they despise conservatives and conservatism. They hold the Constitution in contempt as an obstacle to their imposing on us uneducated, unenlightened, unwashed masses the kind of shining bureaucracy on a hill that they believe will bring about Heaven on Earth. So much for the separation of church and state. But what's most disturbing to someone like me, someone who though young at the time nevertheless remembers quite well the message of the New Left in 1968, is that the price of one Summer of Love seems to be a decade-long Winter of Hate from the same bunch. Of course, the Summer of Love was only one face of the Boomer Left -- that same splinter of American society also gave us the terrorist Weather Underground, the thuggish Students for a Democratic Society, and the murderous Black Panther Party (ask David Horowitz if you don't want to believe me). The gentle, dope-smoking hippie popularized in those songs by the Mamas & Papas, or in "Hair," was simply the benign face that the movement's darker elements found useful to win acceptance of their agenda by once-mainstream liberals and their successors, the moderates. The Summer of Love icon remains strong with many in politics and media who have rationalized the devastation caused by their "ideas," and by their constant suppression of opposition, on moral grounds rooted in the presumption of their own moral unimpeachability. After having gained ascendancy preaching that "the end does not justify the means," they have come around 180 degrees to the certainty that any means, however foul, are justified if they help to keep themselves on top and their opponents in the gutter. After all, their opponents are, by definition, evil; they want to stop The Anointed from carrying out their mission, which would be divine if there were a god, which of course there isn't, but it's still a moral imperative that brooks no dissent. Thus their slavish devotion to The Impeached One. In their view, he stands like a colossus, between us e-e-e-e-e-evil conservatives and the people at large, blocking our message with an unprecedented talent for distraction, and co-opting any ideas that threaten to be popular with the hoi polloi on whose goodwill his power depends. His interests may have nothing real in common with those of the true Boomer Leftists, but he frustrates us conservatives, and that's enough. Since we have no claim on the Summer of Love heritage that he and his supporters have wrapped themselves in, we are by definition hateful, and therefore fair game for their own hate. At the same time they tut-tut over the vengefulness of capital punishment, and argue that "an eye for an eye" is an outdated ethic, in politics they return real hate for perceived hate, real evil for alleged evil. And when the bombs are being dropped by their guy, and promise to derail efforts to punish him for his crimes, suddenly it's a "good" war. They don't want Albert Gore, Jr. to be president before 2001 -- and many of them don't want him at all. They know that he does more damage than good to the Green agenda with his lack of knowledge, his rhetorical clumsiness, and his lackluster persona. They know that as president Gore would be unable to carry off the kind of hate campaign on which Clinton has thrived. Where Clinton comes off (God help us!) as a good-ole-boy trying to do right, Gore would be perceived more accurately: as a hack politician trying to manipulate public opinion for his own benefit. Where Clinton has succeeded beyond anyone's wildest nightmares, Gore would be the conservative commentator's dream. And with Clinton no longer in the spotlight to distract the people, Gore would be recognized instantly as the reality that is the flip side of Dan Quayle's reputation. And so they are afraid. And fear is a primal emotion, far more basic than love. The modern face of the Boomer Left is that of a prince past his prime, soured on life and bereft of his ideals, blaming his misfortunes on those whom he once claimed to love -- and plotting their destruction in revenge. The FBI letter to Reno states "During the June 30, 1993 meeting with the National Security Council staff to discuss the status of the Presidential Decision and Review Directives concerning key-escrow encryption technology and telecommunications trends, which was attended by Associate Attorney General Webster Hubbell, the issue of a recommended solution to the law enforcement access problem, or the digital telephony issue, was discussed." The Department of Justice withheld many of the documents seen by Hubbell, including a SECRET report from the FBI on "Requirements For the Surveillance of Electronic Communications." The June 30, 1993 letter from Sessions to Reno states that the Whitewater figure attended a secret White House briefing on U.S. computer chip policy. In 1993, President Clinton considered mandatory legislation for a special computer chip called CLIPPER to be manufactured into all U.S. computers. According to a SECRET FBI report from 1992, the CLIPPER chip contained a "exploitable feature" which allowed the Federal Government to intercept and decode computer communications. The letter proves Ms. Reno appointed her trusted Assistant Attorney General Webster Hubbell to over-see the secret National Security Agency (NSA) encryption chip project in 1993. According to documents obtained using the Freedom of Information Act (FOIA) Hubbell attended at least one other meeting at the National Security Agency (NSA) Headquarters in May 1993, along with White House lawyers Vince Foster and Bernard Nussbaum. Ms. Reno has been heavily involved in the making of computer security policy of interest to China since 1993. She has also supported a view to monopolize the computer security industry under the Federal government. One 1996 CIA report noted that Ms. Reno wanted to monitor all American domestic computer communications such as e-mail, using a technique to secretly intercept and decode any messages. According to CIA Director John Deutch, the government would mandate all computers be equipped with a special "back-door" system called "key recovery". Federal agents would use a secret "key" to secretly enter a back door and read any computer communication. According to the 1996 report to V.P. Gore by CIA Director Deutch, Ms. Reno proposed an all out Federal take-over of the computer industry. The Justice Department, proposed "legislation that would ... ban the import and domestic manufacture, sale or distribution of encryption that does not have key recovery." Prime targets for monitoring would be foreign governments, banks, corporations, and individuals opposing the Clinton administration. The keys were to be held by "key recovery agents" licensed by the Commerce Department. According to Congressional investigators, documents from Hubbell's personal schedule for 1993 show that the Whitewater figure met multiple times at the White House on a top secret computer chip project called CLIPPER. Hubbell met with the then National Security Council (NSC) advisor George Tenet. Tenet is currently the Director of the CIA. According to George Tenet's SECRET White House email, Ron Brown insisted that the Commerce Department be one of the key holders or be in charge of licensing key holders. Hubbell resigned from the Justice Department in April of 1994. In late June 1994, Lippo boss James Riady met with John Huang and Bill Clinton during five days of White House visits. Early the next week, a Lippo unit paid Hubbell about $100,000. In December 1994, Hubbell pled guilty to several felony charges relating to illegal billing in the Whitewater affair. Webster Hubbell also cited his Fifth Amendment rights to not testify before the Senate Congressional hearings. Two weeks after the Lippo money was given to Mr. Hubbell, John Huang got his job at the Commerce Department as Assistant Secretary. Huang's position determined technology transfers that went to places such as Indonesia and Communist China. Mr. Huang has taken the Fifth Amendment. His wife, Jane Huang, has taken the Fifth Amendment. Commerce/Lippo/DNC fundraiser and secret cleared John Huang was briefed 37 times on encryption communications by the CIA while working at the Brown controlled Commerce Department. Immediately after each briefing, Huang would walk across the street to the Lippo/Stephens Group offices and make long distance phone calls and send faxes to points unknown. Key recovery or key escrow is a government back door system designed to secretly monitor computers. Key recovery has a big downside, according to a former top Clinton official. Key Recovery can be abused by foreign powers to perform economic espionage against the U.S. or worse, to monitor political opponents around the world. "Can Key Recovery be used against dissidents and political opponents?" questioned Admiral William McConnell, the former National Security Administration Director under President's Bush and Clinton. "In a word, YES." Admiral McConnell is considered the father of the CLIPPER chip. McConnell ran the NSA under Clinton. The role of Webster Hubbell in CLIPPER raises the specter of economic and military espionage at the highest level. Orwellian computer chip technology abused by oppressive foreign governments, targeting their citizens and Americans around the globe. In fact, it was the "exploitable" feature of CLIPPER that worried U.S. government officials. The FBI Director wrote two major papers to Clinton NSC advisor George Tenet early in February of 1993. The FBI documents reveal that CLIPPER had flaws which could compromise all the computers so equipped. The FBI Director wrote "This design means that the list of chip keys associated with the chip ID number provides access to all CLIPPER secured devices, and thus the list must be carefully generated and protected. Loss of the list would preclude legitimate access to the encrypted information and compromise of the list could allow unauthorized access." The CLIPPER flaw worried other U.S. government officials. NASA decided to decline to use any CLIPPER device. In 1993 NASA Associate Administrator for Management Systems and Facilities, Benita A. Cooper, wrote "There is no way to prevent the NSA from routinely monitoring all encrypted traffic. Moreover, compromise of the NSA keys, such as in the Walker case, could compromise the entire system." Please note, Ms. Cooper referred to Soviet spy John "Walker" who is serving life in prison for disclosing U.S. Navy secret codes. In 1993 Ms. Cooper did not know of Lippo, Huang, nor Hubbell but her prophetic prediction was not so remarkable in retrospect. The role of Webster Hubbell and the First Lady at the Rose office law firm goes much deeper than Whitewater land fraud. During the 1980s, Mrs. Clinton and Webster Hubbell worked on a secret NSA project for a Rose office law firm client. This too is also clearly documented by FOIA request. Mrs. Clinton, Hubbell and Vince Foster worked on a NSA contract for Systematics of Arkansas, a firm then owned by Riady partner Jackson Stephens. Nor is the involvement of the Riadys, Huang, Hubbell, Foster, and Mrs. Clinton in a White House scandal a conspiracy theory. In 1993, the Arkansas travel firm Wide World Travel was selected by Hillary Clinton to replace the illegally fired Presidential Travel Office staff. Wide World Travel was then owned by the Lippo Group. The new FBI letter is clear evidence that Ms. Reno is in conflict of interest. She is NOT investigating the penetration of Chinese military agents inside the Clinton White House. A real investigation of the Chinese intelligence operations involving advanced U.S. secure communications should involve Webster Hubbell, General Reno, Bill Clinton and the First Lady. However, no FBI agent wishing to keep his job will show up at Janet Reno's door to ask questions - much less try to interview Mrs. Clinton. NOW a news cameraman has spilled-the-beans on one of these disappeared TV reports, indicating that what people have been saying they saw on TV really was on TV. People have claimed they saw an interview right after the crash of an Air National Guard pilot as he stood on a tarmac in front of an aircraft where the pilot said the jet was hit with a missile and that Navy-missile exercises were being conducted at the time. Consistent with such an interview, the Long Island paper Suffolk Life reports [1]: "Long Island's Channel 55 cameraman James Hughes, said during an interview that he and another camera crew from one of the networks were at the airport when the C130 landed. The crew, he said, stated they saw a missile heading toward FL800 just before they witnessed the explosion. The C130 crew members were pulled away from the two camera crews by what Hughes said appeared to be their superiors and came back claiming they had seen nothing." This not only confirms TV-witness accounts of a truth-leaking interview of a pilot at an airport, but it also clearly indicates that the truth was known that night and, with the immediate censure of the pilots, it also reveals that a massive cover-up was activated immediately, which must explain why the media forgot about that explosive interview. (The C-130 was piloted by Col. William Stratemeier. Major Frederick Meyer, who said he saw a meteor-like streak, piloted an HH-60 helicopter. After retiring from the ANG, Meyer said that the first blast looked like "the detonation of an anti-aircraft shell."[2]) It would seem that if military command says forget that news, it is forgotten and any who remember it and/or who believe what those pilots said they saw are smeared by the GovtMedia as lairs, criminals, or nuts... as one who might have to be locked away. The evidence suggests military control of society. Maybe that's why the same week Pierre Salinger's report came out CNN reported [3]: "The FBI this week launched a criminal investigation, hoping to stop missile theorists." The government of a civil nation does not activate "criminal investigations" to "STOP THEORISTS" (!!), but the U.S. Govt does! MORE CONFIRMATION OF PILOTS INTERVIEW The sudden change of the pilots story is consistent with a report from Aviation Week & Space Technology [4] that the ANG C-130 pilot "said he had seen what appeared to be the trail of a shoulder-fired SAM ending in a flash on the 747," and then in the next issue, Aviation Week reports that the pilot had a sudden change of mind, now saying: "We did not see smoke trails [from a missile], any ignition source from the tail end of a rocket nor anything..." [5] And the media filmed the witness intimidation [1]: "The C130 crew members were pulled away from the two camera crews by what Hughes said appeared to be their superiors and came back claiming they had seen nothing." Anyone capable of rational thought can see (a) that the military pilots were pressured to say they did NOT see what they'd ALREADY said they saw, and (b) that this is prima facie evidence of a cover-up, and (c) specifically, a cover-up of a missile hit. If X says he saw a missile hit P, and then X gets a talking-to by superiors, and then X says he did NOT see a missile hit P, one of his two statements must be false and it stands to reason that it's the second. If the media taped those pilots changing their story under pressure and yet forget that event and portray those who believe there's a cover-up as nuts & liars, then the media are choosing to promote the cover-up. THE MAJOR MEDIA: VOICE OF THE MILITARY STATE If the media could forget about a widely-televised interview of military pilots saying FL800 was hit by a missile, pilots who are then quickly whisked away by superiors only to return saying they saw nothing, could we trust the major media to report it if someone with inside information contacted them with a major scoop? If they'd cover-up the former, they should also cover-up the latter. In fact, when James Sanders gave CBS a patch of the rocket-fuel-covered seat cushion [6] so that they too could test it, CBS gave it to the FBI instead and then assisted with the FBI's efforts to jail Sanders by spreading FBI disinformation about him. So when people say there could not be such a large cover-up since someone would come forward, it stands to reason that if someone with critical evidence did come forward and in so doing contacted a major media network to get his/her story out, the network would contact the FBI and then forget about the incident. STILL MORE DISAPPEARED AND CENSORED NEWS Speaking of news the media ignores, last September the agent who headed the FBI's "investigation" said that the "boats" below FL800 seen on the NTSB radar plot that the FBI cited the Privacy Act to conceal the identities of, were "Navy vessels that were on classified maneuvers." An outright admission by the top FBI agent of a cover-up, and recorded on tape! Would that make headlines? Not one. 100% black out! Consistent with that hypothesis is the fact that the day after FBI agent James Kallstrom called Hollywood director Oliver Stone a "bottom-feeder" for his plan to interview eyewitnesses of the FL800 crash in an upcoming TV program looking into the missile theory, ABC canceled the program. Other TV networks chimed in to denounce Stone's shameful effort to allow eye- witness accounts to evade the military black out, which the on-the-spot censure of the C-130 pilots proves went into effect on the night of the crash. Philip Luty, an Englishman, was appalled at the British government=92s=20 response to a lone criminal=92s killing spree in Dunblane. Because the c= riminal=20 used a firearm to kill several people, the government took that opportuni= ty to=20 outlaw all handguns and privately owned long guns. That=92s right -- the= =20 British government outlawed all handguns and most long guns (except for=20 those held by police and military personnel). Philip Luty was opposed to gun prohibition. Philip also was fairly=20 handy with the tools in his workshop. To prove that outlawing firearms=20 cannot stop people (especially dedicated criminals) from getting firearms= ,=20 Philip set out to build a home-made machine gun. He built the gun using=20 common tools and readily available materials. He tested it safely and ne= ver=20 intended to harm anyone. Philip then wrote a book about how to build a home-made machine=20 gun. Of course, manufacturing and possessing a machine gun is highly=20 illegal in England, but Philip felt he was proving the futility of "gun c= ontrol."=20 He hired a man to take photos of the component parts and the machine gun= =20 itself, to be included in his book. Unfortunately, the photographer did = not=20 sympathize with Philip=92s cause, and informed the police of the whole=20 operation. The police swooped down with a SWAT team, but found Philip=20 missing. Nevertheless, they searched his home and found the evidence of = the=20 machinegun and its components and ammunition. Philip disappeared into=20 hiding. The police eventually captured Philip, and he was tried and=20 convicted for making and having a machinegun and ammunition. Philip had no prior criminal record. The judge acknowledged that=20 Philip had no evil or criminal intent, that he had made the gun as an act= of=20 protest. Even the arresting detective was willing to speak on Philip=92s= behalf.=20 To set an example to all would-be protesters, the judge sentenced Philip= =20 Luty to 4 years in prison this past Spring. Philip=92s attorneys appeale= d, but=20 lost. At the local prison, the authorities assessed Philip to be fit in securi= ty=20 category "D" which means "low risk." Category "D" prisoners are=20 appropriately kept in an "open" prison, with opportunities to work outsid= e=20 prison and even to visits to home on leave. =20 During the first four weeks of his imprisonment, Philip was moved=20 through five prisons. These moves put Philip at risk and highly stressfu= l and=20 disruptive to his mental state. Philip is not a hardened criminal. He h= as=20 considered suicide; he has lapsed into severe depression. =20 The prison authorities also did not treat Philip as though he fit in=20 Category "D". Instead, they erroneously (or deliberately) have treated h= im as=20 a "locksmith." Locksmiths are put in Category "B", a much higher securit= y=20 rating. Philip has never been a locksmith, and he could prove it. One o= f the=20 prison wardens apparently got the false notion that Philip was a gun-maki= ng=20 locksmith, and thus moved Philip to other, higher security prisons as soo= n as=20 possible. The false reputation has followed Philip throughout the system= . =20 Being in Category "B" means that he is confined with hardened dangerous=20 career criminals. The jailers insist on treating Philip as a high securi= ty risk,=20 when he is actually a political prisoner -- he never committed a violent = crime=20 or even attempted one. =20 Philip=92s family members have sought every legal and bureaucratic=20 means to downgrade his security rating to "D" so that Philip would not be= =20 treated like an axe murderer. The family has contacted members of=20 Parliament, for example, to no avail. =20 Philip=92s mother worked hard to try to either free Philip or to act lea= st=20 ameliorate the harsh conditions of his confinement, but the authorities t= urned=20 a deaf ear. She developed a brain tumor, and even when her condition was= =20 diagnosed to be terminal, the authorities would not even allow the harmle= ss=20 Philip to visit her before she died this Fall. Family members are asking for our help to pressure the British Home=20 Secretary (who is in charge of domestic affairs) to downgrade Philip=92s=20 security rating. Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled, SECTION 1. REGULATION OF GUN SHOWS. (a) IN GENERAL- Section 923 of title 18, United States Code, is amended by adding at the end the following: `(m)(1) A person shall not hold a gun show unless-- `(A) the person is licensed to do so under this subsection; and `(B) at least 30 days have elapsed since the person, using a form which shall be prescribed by the Secretary, has notified the Secretary and the chief law enforcement officer of the postal address and the dates and times at which the gun show is to be held. `(2) A person desiring to be licensed to hold a gun show shall submit to the Secretary an application which-- `(A) contains a certification by the applicant that-- `(i) the applicant meets the requirements of subparagraphs (A) through (D) of subsection (d)(1); and `(ii) any gun show to be conducted under the license is not prohibited by State or local law, and will be conducted in accordance with the requirements of State and local law; `(B) contains a photograph and fingerprints of the applicant; and `(C) is in such form as the Secretary shall by regulation prescribe. `(3)(A) The Secretary shall approve an application submitted pursant to paragraph (2) which meets the requirements of paragraph (2). On approval of the application and payment by the applicant of such fee as the Secretary shall establish to ensure that the fees collected under this subsection are sufficient to cover the costs of issuing licenses under this subsection, the Secretary shall issue to the applicant a license which, subject to the provisions of this chapter and other applicable provisions of law, entitles the licensee to hold gun shows in interstate or foreign commerce during the 3-year period that begins with the date the license is issued. `(B) The Secretary shall approve or deny an application submitted under paragraph (2) within 60 days after the Secretary receives the application. If the Secretary fails to so act within such period, the applicant may bring an action under section 1361 of title 28 to compel the Secretary to so act. `(4)(A) Before a person not licensed under this section transfers a firearm at a gun show-- `(i) the person shall provide to the holder of the gun show written notice of-- `(I) the name, age, and address of the person and of the prospective transferee (or, in the case of a party who is a corporation or other business entity, the identity and principal and local places of business of such party); `(II) the serial number, make, and model of the firearm; and `(III) the date and location of the transfer; and `(ii) the holder of a gun show shall comply with the requirements imposed on licensed dealers by section 922(t) and subsections (g)(1)(A) and (g)(3)(A) of this section with respect to the transfer. `(B) Within 30 days after the end of a gun show for which a license is issued under this subsection, the licensee shall deliver to the Secretary all records or documents which the licensee collected pursuant to subparagraph (A) during the gun show. `(5) For purposes of this subsection, the term `gun show' means an event or function that is-- `(A) sponsored by-- `(i) a national, State, or local organization devoted to the collection, competitive use, or other sporting use of firearms; or `(ii) an organization or association that sponsors functions devoted to the collection, competitive use, or other sporting use of firearms in the community; and `(B) held at a location-- `(i) which is not specified in any license issued under subsection (b) or (c); `(ii) at which a firearm is offered for sale or transfer; and `(iii) at which 50 or more firearms are present, 1 or more of which has been shipped or tranported in interstate or foreign commerce.'. (b) PENALTIES- Section 924(a) of such title is amended by adding at the end the following: `(7)(A) Whoever knowingly violates section 923(m)(1) shall be fined under this title, imprisoned not more than 5 years, or both. `(B) Whoever knowingly violates subparagraph (A)(i) or (B) of section 923(m)(4) shall be fined under this title, imprisoned not more than 1 year, or both. `(C) Whoever violates section 923(m)(4)(A)(ii) by knowingly failing to comply with a provision of law specified in such section shall be punished as otherwise provided under this section for knowingly violating the provision of law.'. One camp "feels" that education should socialize the young within an existing culture and offer them the basic means to succeed in that culture. This is basically the classical conservative position. The other camp "feels" that education should give the young the means to challenge and overthrow the existing culture, presumably in order to achieve a better life. This is basically the classical liberal position. Considered rationally, these points of view are not necessarily incompatible or opposed to one another, and Roger Shattuck succinctly explains why: "We can reasonably expect a liberal education in our colleges and universities to serve two principal functions. The first is to present the historic basis of our complex culture and the political and moral standards it has evolved. It's no accident that the same word describes both a particular form of liberty, and the opposite of wrong. In the old days before people could reasonably expect to exercise their God-given rights, it was possible for people, who had weapons, to force others, who didn't have weapons, to do things that were wrong. Actually, the old days persist in most of the world, and judging from recent events it appears the old days are back in the good old U. S. of A., but I'm getting ahead of myself. The concept of rights is based on the idea that people should be free to use their own judgment in matters of right and wrong. We can't defend ourselves from our Creator's judgment by blaming our deeds on the advice of others, not even the holiest of priests -- who is, after all, a fallible mortal. When all advice is given and weighed, we make the final choice ourselves, and our rights do not only *free* us to choose right, they *oblige* us to do so. The presumption here is that everyone has two things going for them: the capacity to make moral distinctions, and the desire to do the right thing. If each of us, in conducting our own lives, is free to apply these traits to the subtle moral dilemmas that come up in everyday life, we should be able to act in a moral fashion, and the result should be a society that is right and good and just. It hasn't always worked that way, but we don't always make the right choices anyway. As I've said before, this is what comes of being born of ashes and dust. We're supposed to do our best, and forgiveness is there for those who fail after having tried in all good faith, as well as for those who willfully do wrong -- if their repentance is genuine. That is His judgment to make, and His alone. Do animals have rights? Wolves don't choose their prey so as to give them a fighting chance, they go after the easiest pickings: the old, the sick, the lame. They cannot distinguish right from wrong in a moral context, unless we humans first redefine the word "morality" so as to make animal instinct the highest calling. But redefining a word doesn't change the fact that right and wrong are beyond the reach of non-sentient creatures. The only thing it does change is our understanding of morality -- and the change it wreaks is total destruction. Animals cannot have rights unless we first redefine the word "right" as it pertains to particular forms of liberty, and we cannot so redefine that word unless we totally divorce it from its sibling, "right" as in the opposite of wrong. When the former meaning of "right" becomes "the freedom to do as you please," the moral component of liberty is abolished because you may "please" to steal, or murder, or commit adultery, or bear false witness, all things that are known to be wrong, regardless of culture. (Pop quiz: How many Commandments has Bill Clinton NOT broken since becoming President, assuming innocence in the presence of reasonable doubt? If he's not batting at least .700, I'll be very surprised.) An example of the havoc that can be wrought by this sort of disconnect exists in our nation's own history: the Civil War. The Confederacy claimed that its member states' prerogatives under the U.S. Constitution had been unilaterally abrogated by Northern interests, and that therefore they were entitled to consider the contract implicit in the Constitution to have been breached. Looked at in a vacuum, they were absolutely right -- there is nothing in the Constitution, then or now, that empowers the federal government to force a state to remain a part of the Union. But their grasp of the constitutional principle of federalism was undermined by the moral contamination represented by the practice of slavery. Even though the U.S. Constitution did not ban the practice, and even though federal law could not in those days touch a state that allowed slavery, the mere fact that the Southern states held to the practice, impeached them morally when they argued about such things as justice and liberty. They argued for their states' right to permit and encourage something that was morally wrong. And, oh by the way, they also lost the war. A nation that claims the stature to be the world's political leader, must not make such a claim from a position of moral impeachment. If our leaders see fit to endorse the moral contamination that has befallen our nation during the latter half of this century, they will in effect set the stage for an inevitable collapse of American prestige and power. Being right politically is no substitute for being right morally. In a horrendous ruling devastating for justice, fair play and the rule of law, the 10th Circuit has ruled (9-to-3) that the laws of the United States do not apply to officers and agents of the government unless Congress specifically designates that the law applies to the government. "Statutes of general purport do not apply to the United States unless Congress makes the application clear and indisputable," says the court, citing a 1873 case that "it is a familiar principle that the King is not bound by any act of Parliament unless he be named therein by special and particular words." At dispute in the case, Singleton v. U.S., is the federal statute that specifies punishment for "whoever" promises anything of value to a witness in exchange for testimony for or against another person. Under the normal reading of the statute, prosecutors who promise defendants reduced sentences in exchange for testimony against others are violating the prohibition. According to the majority opinion, federal prosecutors are not bound by the law against bribing witnesses, because they serve as alter ego for the government and "the word 'whoever' connotes a being," whereas " the U.S. is an inanimate entity, not a being. The word 'whatever' is used commonly to refer to an inanimate object. Therefore, construing 'whoever' to include the government is semantically anomalous." In other words, "whoever" doesn't mean "whoever" if the "whoever" is an officer of the government. This Clintonesque word-play is necessary because, as the court acknowledges, "no practice is more ingrained in our criminal justice system" than convicting people with purchased testimony. Faced with an emptying of the prisons, the court ruled that the U.S. government is not a government accountable to law, but a "sovereign" above the law. Prosecutors have found that it is far easier to purchase with leniency the testimony of accomplices against their confederates than to build a case against the confederates. When this practice began it was aimed at known criminals against whom evidence was lacking. But once the practice began, it has taken on a life of its own. Today many innocents are ensnared by untrue accusations from criminal defendants seeking reduced charges by producing more fodder for prosecutors. Less and less does the criminal justice system work by police investigating a known crime and building a case. All too often, the first knowledge of the "crime" occurs when a defendant seeking reduced charges accuses others. In these cases, the accusation is the sole "evidence" of the crime, and prosecutors, who serve career instead of justice, are increasingly destroying innocents with purchased testimony. A recent example is Khem Batra of Burke, Va. Mr. Batra, married with two children, came to the U.S. in 1974 from New Delhi, India. He has been a U.S. citizen since 1981 and was successfully operating his own travel agency. His troubles began when the husband of one of his employees approached him for loans to enable him to purchase distressed properties at auction. Soon Mr. Batra found himself in partnership, pooling money to bid on properties. Unbeknownst to Mr. Batra, his sometime partner was illegally obtaining multiple mortgages on the same property. When the partner was apprehended, instead of being indicted, he was wired and promised leniency in exchange for implicating others. The partner managed to implicate some mortgage companies in technical infractions and apparently made an unsuccessful attempt to implicate the Burke and Herbert Bank in Alexandria, Va. Mr. Batra was never implicated in the illegal financing schemes, but his partner, desperate to earn his leniency, testified that his money-pooling partnership with Mr. Batra was a conspiracy to under-bid the properties. On the basis of his partner's plea-bargained testimony, Mr. Batra was convicted in federal court of one count of violating the Sherman Anti-trust Act. It is a definite sign of prosecutorial abuse when the Sherman Anti-trust Act, designed to bust up large monopolies, is applied to a small-time local partnership speculating in distressed properties sold at auctions where Mr. Batra and his partner comprised one of many bidders. Such a dubious interpretation of the anti-trust statute shows an extraordinary determination to convict. But justice is forfeited when, in addition, the conviction is obtained solely through the purchased testimony of a defendant who committed a real crime and is seeking to reduce his charges. Until the Glorious Revolution when Parliament established the supremacy of law over the sovereign, kings dealt with enemies by bribing or compelling witnesses to testify against them. Once law and not the king's government was supreme, Matthew Hale established the maxim that testimony purchased with reward has no standing in court. It is an abomination that the 10th Circuit has enabled unscrupulous prosecutors to resurrect the ancient practice of convicting defendants with paid testimony. Defenders of the President raise the specter of a constitutional crisis by referring to a "coup." They say that Republicans are obstructing the "business of the country" and are trying to "overturn an election." But--as we have mentioned before--if Mr. Clinton is removed from office it will be he, the president, who has overturned the election, because he has subverted the rule of law and betrayed the purposes for which he was elected. And of course a vice-president of his own party--not some Republican opponent--will succeed him. What is happening now is spelled out in the Constitution. It is, to be sure, a rare event; the present example being only the second in our history and the first in 130 years. Perhaps this can be explained by the good economy, or a reaction against the sexual harassment laws that Mr. Clinton first supported and then was sued for violating; or perhaps something else. In any case, the Senators are not bound to the polls but to the special oath they took, and to their larger constitutional duties. Yet constitutional duty is not without risk. Consider the case of Congressman James Rogan, one of the House managers, who won re-election in November with only 50.8% of the vote. He is a young man with a long future before him, in a district that voted heavily for Clinton's re-election. If Mr. Rogan and others in the House who voted for impeachment, and those in the Senate who may vote to convict, are punished at the polls, it will not mean the end of the country, or even of the Republican Party. It will, however, make it harder next time to cultivate, to call up, and to depend upon a sense of constitutional duty in the Congress. And it will become harder to resist the momentary passions of a majority, on matters small as well as great. Even graver, if resentment against the Congress, and against the impeachment proceeding, becomes resentment against the Constitution then we will have lost something too precious to be counted in votes. The alternative is that in the end the public will regard Congress' action as justified and appropriate. They will recall that the Constitution has a purpose and integrity of its own, and that its authority is greater than whatever the latest poll numbers--or even the latest election-- decree. In the wake of 12 months of data, here is what anyone can see: Australia wide, homicides are up 3.2%. Assaults are up 8.6%. Armed robberies are up 44% (yeah, a 44% increase in armed robbery). Gee, when guns are outlawed, only outlaws have (and use) guns. 3. The state of Victoria saw "homicide with firearms" increase 300%. Previous to this Australian legislative brain flatulence, there had been a steady decline in homicides with firearms, and a steady decrease in armed robbery with firearms. The entire case against the President is based on the fact that he is true to his nature, a nature that was wrongly criminalized by Congress itself when it passed the illegitimate laws against sexual harassment. We are mystified that anyone can believe this case has merit. The Republicans bent on destroying their party claim that the President should be held to the same legal standards as anyone else, conveniently overlooking the fact that he is the President. With great power comes great responsibility, and with great responsibility must come great privilege to offset the burden. In particular several ISPs had banned access to privacy because a rating service they used had decided that telling people how to protect their privacy was an anti-government activity and therefore such a site should be on a restricted list. Obviously, the same rules apply to a a site with pictures of Andrews NC. Moreover, the effect was like you described the ISP simply disconnects transfers to such a site and certainly makes no effort to tell their customer that they are censoring what they download...nor did they tell the sites like PRIVACY that they had been blacklisted. It could be something like an HTML script error (innocent, not necessarily malicious) that the Netscape interpreter doesn't handle gracefully, and does a catatrophic shutdown of Netscape without any notice or warning. (Catastrophic errors tend to do that sort of thing.) In this event, the site regresses to making mountains out of molehills instead of being a hoax. Netscape is as bad as Microsoft when it comes to tossing code over the wall and letting the unsuspecting customer debug it. Careless Web Site programmers are worse.
