Res. 41) that would have made it more difficult to raise federal taxes by increasing the majority requirement from a simple majority to a 2/3 majority, failed to pass on Wednesday, 4/25/01. Martin is serving a lif= e sentence for wounding Fearon and killing his teenage accomplice, Fred Barras, with a shotgun in an attempt to defend his property. The Home Office has ruled that as a "victim" Fearon, who has 34 convicti= ons for burglary, theft and handling stolen goods, and is currently serving = three years for the break-in, must be consulted about Martin's parole. Last night, the consultation decision was criticised by MPs. Ann Widdeco= mbe, the shadow home secretary, said that it was "madness". "Whatever the rig= hts and wrongs about the degree of force Tony Martin used, it's turning comm= on sense upside down to consult a burglar about the liberty of his victim." Gerald Howarth, a member of the Commons home affairs select committee, called it "utter lunacy". "There's no doubt in the mind of the British p= ublic that the criminals in this case are the ones who broke into Mr Martin's premi= ses and the idea that one of them should have any input into his parole what= soever is a farce. "I will be writing to the Home Secretary to ask him to make sure that on= no account should this man's views be taken into consideration." In a leake= d memo last year Tony Blair, the Prime Minister, referred to the Martin ca= se as an example of how the Government was being seen as "out of touch" on law and order. Mr Blair wrote: "The Martin case - and any lack of res= ponse from us that appeared to empathise with public concern and then channel = it into the correct course - has only heightened the problem [of being seen= as out of touch]." Fearon revealed that he had been asked about Martin's pa= role in a letter he sent to the Norfolk farmer. It said: "I have since been visited by the Victim Support Group in relat= ion to my feeling about you gaining parole in the future. I was, therefore, for= ced to think about how remorseful you may be. Judging from the cold words of yo= ur distorted truth in the paper reviews, my thoughts are not overly optimis= tic." Fearon suggests that Martin will only be at peace with himself once he h= as admitted his crimes, adding that he himself has done just that. He says:= "I feel you will gain your sense of truth in time, as you and I know what h= appened that fateful night. Reconciliation will not occur until you face up to y= our doings as I myself have done so." However, Fearon, 30, who was jailed in January last year after admitting conspiring to burgle Martin's home on the night of August 20, 1999, unde= rmines his claim to have come clean by adding: "We was [sic] not there to take = your belongings merely to escape your dogs and didn't mean to be intruders." Fearon, whose brother Neil was jailed last year for fiv= e years for cheating elderly women out of =A340,000, was the leader of the exped= ition to raid Martin's farm in the village of Emneth Hungate. Together with anoth= er man, who did not enter the property, Fearon and Barras drove 60 miles from th= eir home in Newark, Nottinghamshire, to the isolated farmhouse hoping to fin= d antiques. Martin, who claimed he was lying in bed upstairs, heard them b= reak in through a window and fired his pump action shotgun repeatedly into th= e downstairs darkness, hitting both intruders. Barras managed to crawl out= side before dying while Fearon staggered to a nearby property where the owner= s raised the alarm. The letter begins with directions to McVeigh regarding a storage locker in= =20 Council Grove, Kansas. It contained valuables from a robbery, and Nichols= =20 referred to it as "CG 37." The first nine lines of the note explain what to= =20 do with that locker and include oblique reference to the circumstances=20 under which McVeigh is receiving the note. The tenth line is the phrase,=20 "You=B4re on your own, go for it," after which Nichols signed his name. Below Nichols=B4 signature are four paragraphs, essentially afterthoughts.= =20 The second paragraph contains instructions for forwarding Nichols=B4 mail.= =20 The third provides more detail about handling the locker with the loot from= =20 the robbery. The fourth states explicitly that if McVeigh has received the= =20 letter, Nichols has died. The first paragraph says merely, "Also liquidate 40." That is terribly=20 important. "40" refers to another storage locker. It contained a ton of=20 ammonium nitrate, one of the bomb=B4s basic ingredients. "Liquidate 40" in= =20 its most obvious sense means get rid of the material. It does not mean mix= =20 it with fuel oil, put it in barrels in the back of a Ryder truck and blow= =20 up a federal building. Indeed, "Liquidate 40" is followed by instructions about picking up the=20 mail. The ammonium nitrate has essentially the same status as the mail.=20 Both are entirely secondary. Thus, Nichols=B4 note strongly suggests that i= f=20 he did not return from the Philippines, there would have been no bomb,=20 because McVeigh was told to get rid of the ammonium nitrate. Now even sports fans are being subjected to treatment once reserved for criminal suspects. Fans who lined up to attend Super Bowl XXXV were, without their knowledge, standing in a virtual lineup. According to the Los Angeles Times on Feb. 1, 2001: Hidden cameras scanned each of their faces and compared the portraits with photos of terrorists and known criminals of every stripe. In a command post at Raymond James Stadium in Tampa, Fla., the digitized images of fans and workers were cross-checked against files of local police, the FBI and state agencies at the rate of a million images a minute. The cameras identified 19 people with criminal histories, none of them of a "significant" nature ... .... [Tampa police spokesman Joe] Durkin said the department wanted to screen for pickpockets and other potential scam artists drawn to the huge event and for potential terrorists who wanted to use its worldwide TV and radio audience to make a political statement ... No arrests were made that day. But, Durkin said, "it alerted us that they were there. It confirmed our suspicions that a crowd of this magnitude would attract people trying to take advantage of the situation." Typically for corporate news, this story is only partly true. Obviously, it wasn't cameras that compared the portraits. It was face-recognition software (FRS). The Times also neglects to question how the police confirmed their suspicions without making arrests. Can they read minds? Questioning the police, or authority in general, is not something the corporate media does well or often. If that's what you want, you'd better go to the anticorporate media instead. At Indymedia, the news about what was done to the fans at Super Bowl has sparked vigorous debate about how FRS can be deceived, or "spoofed" as it's called in the trade. Sports themselves have become the subject of long-overdue discussion. Long overdue as well, is recognition by the public of the threat that FRS, and artificial intelligence in general, presents to political activism. Though you'd never know it from the Times' account of Super Sunday, FRS is nothing new. Back in 1997, Science Daily reported: Computer "eyes" are now up to such tasks as watching for fugitives in airline terminals and other busy locations. A sophisticated face-recognition system that placed first in recent Army competitive trials has been given the added ability to pick out faces in noisy or chaotic "street" environments. The new Mugspot software module developed at the University of Southern California automatically analyzes video images, looking for passers-by. When it finds them, it picks out the heads in the images and then tracks the heads for as long as they remain in the camera's field ... "This face-recognition software, developed at USC and the University of Bochum, Germany, and now in commercial use for clients such as Germany's Deutsche Bank, is robust enough to make identifications from less-than-perfect face views. It can also often see through such impediments to identification as mustaches, beards, changed hair styles and glasses - even sunglasses." Take note of that date. As well as being a technology with many commercial applications, artificial-intelligence software such as FRS is of great use to the military and intelligence communities. It is not at all atypical for technology with military and intelligence applications to exist for 10, 20, even 30 or more years before reaching the commercial market (if at all). The entire dynamic of identity disguise at public demonstrations must be reevaluated in the light of FRS, and that reevaluation must be backdated considerably. The calculus has changed. Those of you who still wonder why political activists might want to conceal their identity need only to read history. Start with COINTELPRO. Even a cursory perusal will set you straight. As recently as last at year's political conventions, the arbitrary, preemptive arrests of those who the state sees as leaders of dissent illustrated the enormous threat to liberty that FRS represents when it is in the wrong hands. And make no mistake about it, it is in the wrong hands. FRS programs mimic the way that the human brain recognizes a face. They electronically analyze the distances between various parts, or landmarks, of the face. Every face has its own distinct pattern, so the information enables the programs to distinguish one individual from another. Facial landmarks are on distinctive structures, such as the eye sockets, the bridge of the nose or the cheekbones. Facelt, one of Mugspot's competitors, defines the face as having 60 landmarks. According to its developers, Facelt takes only 14 of these landmarks to reconstruct an individual's distinctive facial pattern. Since FRS software makes such effective use of bone structure, a ski mask or bandanna probably won't defeat it. If it can see through a beard and sunglasses, how much good do you think a rag over your face is going to do? A loose, rubber mask may spoof FRS, but don't bet your freedom, or even your life, on it. No one who takes an active role in organizing public dissent is safe from the withering gaze of techno-repression. Toss Echelon, Carnivore, Prosecutor's Management Information System (or PROMIS), and High-Definition TV into the mix, and it's a whole new world. Now days, anyone who does more with his political convictions than grumble into his beer is, of necessity, forced to consider his or her personal life to be an open book. People's opinions, appearance, and even location, is a matter of record. These records can be cross matched, sometimes with life-altering results. Modern information technology, especially artificial intelligence, has redefined forever the economics of surveillance. No longer is the tedious, expensive, and intrinsically subjective work of the human mind required. The days of three shifts a day, 24-7, trench coat-and-sunglasses-wearing teams working for scale are over. Today, even as innocuous an expression of one's objection to the tyranny of our rulers as kvetching over the Internet, is not too expensive to investigate. Artificial intelligence has made the cost of conducting surveillance virtually negligible. It has made truly effective mass covert surveillance a possibility for the first time in history. The powers that be not only admit to using covert surveillance on innocent citizens, they brag about it. They are justifiably proud of themselves. But that's not why they are bragging. They are bragging to send us a message. Covert mass surveillance has been a long-standing, front burner project since before we were born. SS chief Heinrich Himmler, for example, was a notoriously obsessive collector of records about minutia. He was supposedly asked once what possible value there could be in knowing that a "Private so-and-so did KP duty on such-and-such a night." He is said to have answered, "One never knows." Not only do our rulers now employ artificial intelligence to keep track of what we are doing, they have apparently begun using it to predict what we will do in the future. This is called behavioral-recognition software. If it's not already in use, it's in the pipeline. They seem to be trying to break this to us gently. Last April, we were permitted to learn that TASC, a subsidiary of defense giant Litton Industries, was joining with Loronix Information Systems to codevelop a state-of-the-art digital video technology that employs software to find behavioral patterns in video images. The proposed technology will allow retailers to catch shoplifters before they ever take an object, capture the image of people performing a fake "slip and fall" for an illegal lawsuit, and clean up a spill before an accident occurs. Law enforcement could use such intelligent video technology to spot erratic traffic patterns, such as cars moving at high speeds, irregular turning, or other atypical traffic behavior. By using intelligence extracted from the video, law enforcement officials could proactively manage problem spots by isolating trends before problems got out of hand. Highway officials, Loronix points out, could also monitor critical safety areas like railroad crossings more effectively. Imagine getting a ticket for an infraction you haven't even committed yet. It gets worse. They are now teaching computers to hunt in packs. According to EurekAlet, an NEC Institute-Penn State study shows that computer programs, known as autonomous agents, not only can evolve their own language and talk with one another, but also can use communication to improve their performance in solving the classic predator-prey problem. Like kids playing hide and seek, the autonomous agents used in the study hunted for and found their prey faster and more efficiently if they communicated with one another. Who, we must wonder, are these packs being taught to hunt? Because the technology does not simply "look" for an object or an individual, security teams at airports and casinos can use it to spot a person's irregular behavior. If it can detect suspicious behavior in an airport, it can detect suspicious behavior at a demonstration. What, exactly is "suspicious behavior" in the government's eyes, anyway? As a journalist for a mainstream publication, I was able to find a person working on the inside who still believes in freedom of information. During the Vail, Colo. World Alpine Ski Championships, the Dept. of Defense in conjunction with local law enforcement agencies, wired the town and mountain with hidden video (We believe it is all still in place but no one is talking). The second call was made from Wagoner, OK at 4:55 A.M. CST and lasted for 7 minutes. It was routed through Telecom, USA. Within a few minutes ( approximatly at 5:05 a.m. CST of my finishing that phone call, I entered one of those all night combination gas station, conveinence stores. At that time I witnessed several individuals who were later identified by Glen Wilburn from my complete verbal description of the people I saw. I gace Mr. Wilburn a complete discription down to hair color, eye color, height and weight of each individual.Those included Andreas Strasmeyer, Michael Brescia at that time unidentified, and unidentified third male and a female, later identified as Esther Millar. The third male was middle eastern in appearance, with dark brown or black hair, brown eyes, about my weight and height. ( roughly 5'9'' tall and 160 pounds ) I say roughly since he was wearing a light windbreaker style jacket. I had met Andy once before at a gun show in North Texas or possibly OK ( to the best of my recollection it was in Fort Worth ) since at that time I was frequenting as many shows as possible, so I have no doubts as to Andy's identity since we had a long conversation about the necessity of civilian actions needed in restructering our government. Upon exiting the establishment I also saw what I believed to be a rental truck similar to the Ryder truck that was used in OKC on the 19th. except it did not have anything written on the side of it that was visible to me. After leaving that area I proceeded north on Rt. 69 to theBig Cabin toll booth and arrived there at 06:05:45, paid my toll, ( kept the receipt ) and headed east on lane 268 to MO 44. I arrived at my destination early on the morning of the 18th and received a call from home ( in Texas ) at 9:59 A.M. CST. To be honest, when I first heard about the explosion on the 19th. and that a rental truck had been used I thought it was these individuals who had done it. I first heard about the explosion through an employee who came up to the smoking area at the lab and told several of us that she had just heard about it on the radio. This was later confirmed by news reports that I saw on relevision that evening. There is much more to this story, including conversations with Kirk Lyons whom I feel covered up the truth about his client. I find it amusing that the FBI agent I was working with at that time asked me to see if I could locate him and it turned out that Andy had already been secreted out of the U.S. through Mexico. Not to mention the fact that he admitted in a fax to Mike Vanderbough that he had used funds that were to be used to defend the Branch Davidians to get Andy out of the country. I first told this story to Mike Kemp and he allowed me to use the alias Patrick Henry to contact Lyons about his client mainly to protect my identity. Mike was very helpful although there seemed to have been several players in what I was sending to Kirk including Mike Vanderbough and Jeff Randall. BTW, for those that have condemned Jeff Randall, all I can say is from my privete conversations with certain fedgov individuals that unless the agencies were playing the old game of cat and mouse to cover their inside man he is innocent of anything oter than what a true God fearing American would have done. As for the so called VSA evidence, by a certain individual, he knew nothing until we took an evening stroll up the street from his home where Imrevealed the entire truth of what I had been doing. Including this complete story as well. We did that so in case their were bugs our conversation could be private. I hold no grudges against any of these individuals despite some accusations made by at least one of them. NOW I have an accusation of my own. Since ONLY three individuals knew of Patrick Henry, one of the three, Jeff Randall, Mike Kemp, or Mike Vanderboegh gave my identity up to Kirk Lyons. So in your parlance, who is the SNITCH??? Seems to me it's my turn to ask that seemingly popular question of paranoid patriots! Kind of like a case of the pot calling the kettle black. I'm curious if that hate monger Martin Linsdedt will be so eager to find the real snitch. I sincerely doubt it since this entire letter on my part proves on which side of the fence my loyalties belong. Seems that someone gave Kirk Lyons my real name and phone number ( that's called a snitch ) and he quickly called me about his client. His story was that Andy and Mike were fixing fence on that morning and left early because of the rain. I find that interesting since it also rained the day before. After wasting considerable energy discussing this issue with Lyons, I feel he knows his client is guilty at least within the confines of a conspiracy to blow up a federal building either in Tulsa or OKC. "Under California's 1998 `snitch' rule," Associated Press writer David Kravets reports, "judges routinely order jurors to inform the court if a juror is not applying the law during deliberations. That is what happened in the case decided Monday." An alternate juror stepped in to replace the uncooperative member of the panel, and the jury --thus reorganized and stacked in favor of conviction -- duly rendered a conviction. "Jury nullification is contrary to our ideal of equal justice for all and permits both the prosecution's case and the defendant's fate to depend upon the whims of a particular jury, rather than upon the equal application of settled rules of law," Chief Justice Ronald M. George wrote for the seven San Francisco lawyer-politicians. Which is nonsense on several counts. First, the Sixth Amendment means precisely that a defendant can be acquitted based on "the whims of a particular jury." What else does the dishonored Mr. George think it means? That the government gets to keep trying the case before jury after jury, no matter how many choose to acquit? Second, no jury can convict a defendant of any charge beyond what prosecutors have presented and the judge has allowed -- any such conviction would be instantly set aside by the court. So this stated concern for "the defendant's fate" is pure doggerel. Fully-informed juries can displease the courts only by acquitting when both prosecutors (the one in front of the bench, and the black-robed one behind it) would rather cut another notch in their barrels -- they can err only on the side of mercy. But more significantly, the D.C. Court of Appeals confirmed in 1972, in one of the biggest Vietnam draft-dodger cases, that our modern juries today still retain "an unreviewable and irreversible power ... to acquit in disregard of the instructions on the law given by the trial judge. The pages of history shine upon instances of the jury's exercise of its prerogative to disregard instructions of the judge; for instance, acquittals under the fugitive slave law." Not to mention the case that gave America its freedom of the press, the 1735 prosecution of John Peter Zenger for publishing "seditious libels" against the king. Defense attorney Andrew Hamilton admitted Zenger had published the stuff (truth was considered no defense.) But the jury acquitted him anyway -- they simply decided the law sucked. I called Houston appellate attorney Clay Conrad, author of the 1998 book "Jury Nullification: The Evolution of a Doctrine" (Carolina Academic Press) to ask about this latest pathetic attempt by the professional judges to dilute the traditional rights and powers of the increasingly inconvenient citizen jury. "This is one area where the courts blunder and stumble and can't figure out what to do," Conrad told me. "All they can do is stomp their feet and say, `We don't like it.' ... "But now that you know the other jurors can snitch on you, what's that going to do? Jurors will be less willing to raise a discussion of whether the law is appropriate, but they're still free to just say, 'I refuse to convict; I still think there's a reasonable doubt.' So since there can't be a forthright discussion of the possible reasons to acquit, the chances grow that you'll have hung juries." Isn't that almost as good for defendants? Few prosecutors will continue to re-try cases where juries are hung time after time. "What we'll see now are more hung juries, and then their next target will be the unanimous jury rule," Conrad responded. "The Constitution lets them go down to 9-to-3, so that's what you can expect them to start pushing next." Is there any chance these judges are right -- that jurors aren't supposed to judge the law? "The way we interpret what trial-by-jury means is by the common law, what the practice was at the time of the Founders," Conrad replied. "And the history is unassailable, that this is a power the jury had, the history is just rock solid on this. ... Indiana and Maryland still have it in their state constitutions, that juries have the right `to judge the law as well as the facts.' ... "And then a lot of states are in the situation we have here in Texas. The Texas Constitution says, `In libel cases the jury shall have the right to decide the law as well as the facts, as in other cases.' But the state courts have simply ruled that's no longer relevant, because it's an anachronism. Can you imagine? They've ruled their own constitution is `an anachronism.' " Nearly as anachronistic, I suppose, as the words of John Jay, first Chief Justice of the United States, who said in charging the jury in Georgia vs. Brailsford, 1794, "You [the jurors] have, nevertheless, a right to take upon yourselves to judge of both, and to determine the law as well as the fact in controversy." Thank goodness our judges, like those in California, no longer have to take an oath of office binding them to "protect and defend" a Constitution written by such men as John Jay. Human Rights Commission is trying to ban several private human=20 rights advocacy groups from participation in the United Nations. Those=20 targeted include Freedom House, the Baptist World Alliance, the Simon=20 Weisenthal Center and the Family Research Council. "First, they silenced the United States=B4 voice on the human rights=20 commission. Now, they are going after U.S.-based human rights advocacy=20 groups," said Freedom House President Adrian Karatnycky. The effort is being orchestrated in a 19-nation subcommittee of the=20 54-nation U.N. Economic and Social Council (Ecosoc), which has become=20 increasingly polarized between democratic nations and others such as Suda= n,=20 Sierra Leone, China and Cuba. The subcommittee is responsible for accrediting nongovernmental=20 organizations (NGOs) and renewing accreditation every four years.=20 Accreditation is needed for NGOs to participate in U.N. discussions. Accusations that the United Nations is targeting private human rights gro= ups=20 come at a time of growing congressional impatience with the world body. The House last week voted to withhold $242 million in U.N. dues next year= =20 unless the United States gets back its seat on the U.N. Human Rights=20 Commission. In a secret vote by the full Ecosoc committee this month, the= =20 United States lost its seat for the first time ever. Freedom House, an NGO group founded by Eleanor Roosevelt in 1941, lately = has=20 upset Russia by questioning its military actions in Chechnya, angered the= =20 Chinese with criticism of religious intolerance, alienated Cuba by pressi= ng=20 for freedom of speech and enraged Sudan by challenging its bid for=20 membership in the Security Council on human rights grounds. All four governments are represented on the NGO subcommittee, and each ha= s=20 challenged Freedom House and other prominent human rights groups in their= =20 efforts to either win accreditation or renew existing credentials. "It is inappropriate," said Robert Maginnis, vice president for policy of= =20 the Washington-based Family Research Council, whose application for=20 accreditation has been deferred for the third time. "We are a pro-life,=20 pro-faith, pro-family organization that has shown a commitment to human=20 rights," he said. At an Ecosoc subcommittee hearing last week, Mr. Maginnis said, the Famil= y=20 Research Council representative "was on the hot seat for an hour and a ha= lf"=20 defending the group=B4s positions against abortion and sex trafficking. The subcommittee recommends which groups should be recognized to particip= ate=20 in U.N. forums and meetings. The recommendations then are forwarded to th= e=20 full Ecosoc committee for a vote. Longtime observers say it=B4s getting harder for bona fide human rights=20 advocates to win accreditation with the current composition of the Ecosoc= =20 subcommittee. They note that Russia will challenge any group criticizing its actions in= =20 Chechnya, China will automatically block any group that characterizes Tib= et=20 or Taiwan as independent of Beijing and Cuba opposes any group that=20 criticizes the Castro regime. Last week, for example, Cuba=B4s representative accused Freedom House of=20 lending its accreditation badges to Cuban dissidents. Beijing=B4s representative criticized the group for failing to say in its= =20 reports that Taiwan is a province of China. Joanna Weschler of Human Rights Watch said that repressive governments we= re=20 emboldened two years ago, after Sudan successfully won the ouster of=20 Christian Solidarity, the group that buys and then liberates Sudanese=20 slaves. "Complaints are rare, but they are increasingly growing and intensifying,= "=20 said Ms. Weschler, who said that Human Rights Watch was denied accreditat= ion=20 for several years in the early 1990s. Freedom House=B4s Mr. Karatnycky praised the U.S. counselor on Ecosoc, Ri= chard=20 Williams, for battling to renew the group=B4s accreditation. But Mr. Maginnis of the Family Research Council, which is applying for=20 accreditation for the first time, said he wishes U.S. delegates would hav= e=20 defended his group more vigorously against what he views as political=20 attacks. "Because we are . . . perceived to be aligned with the Bush administratio= n,=20 and given the situation on the human rights commission and the backlash=20 against President Bush, we were a handy whipping dog to go after," he sai= d. A State Department official said problems arose with the Family Research=20 Council=B4s application for accreditation. "They=B4re hung up on procedural issues. There are no substantive objecti= ons=20 within the committee," said the official, who spoke on condition of=20 anonymity But some characterize procedural objections as a fig leaf to hide an atte= mpt=20 to stifle criticism of human rights abuses. "The complaints against us are largely procedural, like the allegation th= at=20 we improperly obtained a certain translation service for a meeting in=20 Geneva," said Michael Goldfarb, Freedom House=B4s spokesman. "They are seizing on alleged technical infractions as a means of censurin= g=20 organizations. At heart, it=B4s really a freedom of speech issue. There s= eems=20 to be a climate of stifling open legitimate and substantive debate of=20 important human rights issues and abuses," he said. Several groups, such as the Simon Weisenthal Center and Baptist World=20 Alliance, didn=B4t even realize that their applications were in danger of= =20 being rejected. "I suspect they only want more information," said George D. Younger, the=20 U.N. representative for the Baptist World Alliance. "Our operations are=20 transparent and not politically motivated." The group, based in McLean, Va., represents 162,000 churches in 116=20 countries. "To the credit of the U.N. system, the staff are extremely sympathetic to= =20 NGOs, and the Secretary-General [Kofi Annan] stresses the importance of=20 hearing the views of civil society," said Mr. Karatnycky. I must tell you that the Audubon Society has joined other environmental groups (probably including Earthwatch), in sueing the US Government to (1) stop the building of a cemetery on Fort Huachuca, AZ in which to bury veterans of WWII, the Korean War, the Vietnam War, and the Gulf War; (2) stop the building of an airport on Fort Huachuca to be used by the city of Sierra Vista, AZ to attract businesses to improve the economic viability of this area; and (3) to force the closing of Fort Huachuca, the lifeblood of what's known locally as the Greater Huachuca Area. Should these lawsuits succeed, Sierra Vista, AZ will become another western ghost town with no property values left to sustain the few people who won't be forced to move out to obtain work elsewhere. Robert Byrd (W.Va.) threatened to slash the spending projects of lawmakers who broke ranks to support President Bush's $1.35 trillion tax-cut plan. Two Democrats in particular, Sens. Both Senators are up for re-election in 2002 and the GOP is expected to target them by providing money and resources to their respective Republican opponents. Byrd at least does all parties the favor of stripping away any remaining veils of modesty from the true Democratic agenda, which seems to size up as follows: Tax cuts are to be opposed because they could somewhat limit the ability of senior senators to waste hundreds of millions on "pork" projects never envisioned or authorized by those who penned the Constitution. Such pork projects, in turn, are vital not so much because the barefoot citizens of Gandeeville, W.Va., really need an eight-lane federal highway "demonstration project" to better link them to the vital parsnip and possum patches of Elmira and Gassaway. No, the purpose of these allocations is forthrightly to guarantee the re-election of senators who need to brag on the campaign stump that they've "brought home the bacon" to their local jurisdiction ... regardless of how useless and inefficient the spending, regardless of the resultant general reduction in financial independence and well-being of taxpayers nationwide. After all, the more we're overburdened and (in relative terms) impoverished, the less able American families will be to pay for their own food, clothing, and education -- heck, even to stay home and rear their own kids -- and the more "need" will thus be expressed for further handouts from Uncle Sam ... in turn generating demand for additional federal "programs." Ah, what fearful symmetry. Government reduced to a set of intricate and expensive "solutions" to problems of its own making. (What, my use of "impoverished" is inappropriate? Many of our American fathers and grandfathers supported their families in free-standing homes on a single salary, and paid cash for a new car every four years. Can you?) For the record, President Bush's tiny tax cuts would not have the effect of reducing federal spending -- in fact, federal largesse will continue to grow at a record pace, even if American wage-earners are allowed to hang onto the tiny additional stipend now proposed. The correct answer to Sen. Byrd is that we hope he indeed follows through on starting to trim his colleagues' "pork." Let's watch the percentage by which he determines their spending requests can be trimmed, while still meeting the quite limited, legitimate spending obligations of the Congress under Article I, Section 8. Then, those same rates of reduction should be applied to him and all his colleagues ... after the GOP gains the five additional seats which Sen. The California-based American Medical Marijuana Association was quick to reassure concerned parties that the ruling was of sharply limited scope: "It is important to recognize that the Supreme Court decision did not strike down or in anyway modify any state medical marijuana laws," the AMMA wrote in a press release. "The Supreme Court did not say that citizens don't have the right to cultivate and possess medical marijuana within their own state borders. All this decision said is that medical necessity is not a defense to federal law. "Bottom line," the AMMA continued, "medical marijuana still stands in those states that have approved it. Even the medical marijuana clubs will be largely unaffected, because they will simply switch from distributing medical pot to helping patients grow their own. ..." Maybe. But it turns out I wasn't the only person whose first response was to recall the high court's previous nadir of homicidal hair-splitting, when Justice Taney held in the infamous 1857 Dred Scott decision that black men are property, not persons entitled to the protection of the law. The court's defenders will whine that the justices aren't supposed to "legislate from the bench"; that they were only asked whether there is a "medical necessity defense" under the federal Controlled Substances Act, whereupon they looked it up, determined there was none, and so ruled. The question of the Drug War's constitutionality wasn't answered because it was never asked. The court simply tells us what Congress intended. Which is a black-hearted lie, of course. If Congress in a fit of madness were to enact the Nazi race laws tomorrow, would the justices sit there with straight faces, instructing us, "We cannot locate within the Act any 'religious freedom' exemption to the requirements that Jews sew yellow stars on their clothing," etc.? Of course not. When it's the First Amendment right of religious freedom that's involved, everyone understands the court's first duty is to determine whether the law in question is constitutional on its face. If it isn't, under the great precedent of Marbury vs.. Madison, the law is held to be null and void. Besides which, attorneys for the Oakland Cannabis Buyers Cooperative et al. did assert (as Justice Thomas acknowledges) that he federal drug statute "exceeds Congress' Commerce Clause powers, violates the substantive due process rights of patients, and offends the fundamental liberties of the people under the Fifth, Ninth, and Tenth Amendments." Fact is, the entire federal drug war is blatantly unconstitutional, and any high court obeying its oath to preserve our government of limited power would have thrown it out in its entirety the first time it got a look at it. There are no fewer than three independently sufficient grounds on which this could and should be held. The weakest of these is the 10th Amendment, which tells us that any power not specifically delegated to the United States by the Constitution is reserved to the states or to the people. Since nowhere in the Constitution is Congress delegated any specific power to regulate what responsible adults choose to put in their own bodies, any state law (like California's successful 1996 medical marijuana proposition) supersedes federal authority. This is the weakest argument simply because it would seem to authorize state drug wars. Now, truth be told, even state drug wars are further banned under the 14th Amendment (the second sufficient grounds for tossing out the Drug War). This amendment bans the several states from "abridging the privileges or immunities of citizens of the United States." Under the 14th, the high court could and should have thrown out California's current marijuana distribution scheme not because it allows some marijuana use, but because it places any restrictions on marijuana use, at all. Am I saying Americans have some kind of right to drugs? Damned right, and here's where we come to the constitutional provision which even a second-year law student could hardly ignore. The Ninth Amendment advises the justices that, "The enumeration in the Constitution of certain rights shall not be construed to deny or disparage others retained by the people." In 1787 and thenceforward, at least through 1915, did our ancestors on these shores "retain the right" to grow, produce, import, buy and sell opium, cocaine, alcohol and marijuana whenever they pleased, without federal restriction save the occasional modest excise? Indeed they did. And the proof is that when Congress wanted to ban one of these forms of commerce, a separate constitutional amendment -- the 18th, since repealed -- had to be enacted to allow a federal ban on "intoxicating liquors." So: when was the parallel and necessary constitutional amendment ratified, authorizing the War on Drugs? Pardon me, I didn't hear that. Could you speak up? In one case reported by Michelle Malkin on May 18, a county in Maryland has charged a mother with criminal truancy because she refused to allow officials to review her curriculum while she also had not registered her schooling efforts with an approved sponsor. She was using a strong curriculum, by the way. Another case goes like this: A naked two-year-old gets out the front door of the house, and a neighbor calls the authorities. Social workers demand to question family members, the family members refuse, and the family is now in the third year of dealing with it in court. This case isn't about home schooling directly, but relates to parents' rights to decide for their own children. It also happens that the parents are home schoolers maybe coincidence, maybe the reason for the government pursuit. What should be news, however, is that attacks are happening across the nation, and they're nothing new. Here's a smattering from the Home Schooling Legal Defense Association: The East Otero School District in Colorado requires parents to report home-schooled children's standardized test scores. What the district did to at least one family was try to intimidate them into letting the government determine the time and place of testing, which is not the law. In California, the Montabello Unified School District sent a representative to the home of home-schooling parents to try to make them "register" their children with the public schools, which is not the law. Also in California, two families that recently began home schooling went through all the legal rigmarole, and still were treated to "mistaken" accusatory visits from social workers, one accompanied by a policeman. All these cases were reported during the first 17 days of May highly significant because they involved members of the Home Schooling Legal Defense Association. How much more such bullying is happening to home schoolers who aren't members of this one organization? The same website details legislative attacks on home schooling. A current proposal in Maine would remove forced-immunization exemptions for those who have religious or other objections, and thus would indirectly (but disproportionately) affect home schoolers. Florida is considering a bill that would allow the government to "assess" the "needs" and "strengths" of families until every child reaches age 9. More openly aimed at home schooling is a bill in Michigan that would impose new mandatory standardized testing for home schoolers, even though the data show that home-schooled children do better than government-school victims on college entrance exams. Minnesota is currently considering adding new testing and parent-qualifications requirements. So, while we have state legislators making it increasingly difficult to home school your children without being prosecuted, we have school districts knocking on doors and lying to parents about the law to intimidate them into giving up the whole idea. I suspect that many of the knocking-on-the-door-and-lying incidents are done knowingly: In the cases mentioned above, the Home Schooling Legal Defense Association faxed a letter to the offending district, and the parents were not bothered again (not bothered so far; these are recent cases). All this after it has become common knowledge that home schooling is the best thing for children, which proves that the best thing for the children is the last thing on the mind of your government. Some states are becoming friendly to home schoolers. Learn about those, and consider relocating to them even if you don't have children. However, the other states noted above (and more) are desperate to stamp out home schooling, whether by lying about the law or by pressuring lawmakers into changing the law. In these states, the absolute-power ambitions of elected politicians combine with the damn-the-children, protect-our-jobs union mentality of the government schools to produce damaging laws and Orwellian offenses by the "most respected" public servants (respected by the uninformed, anyway) state senators and educators. All of this is happening now and has been for years, and without much coverage by rightist commentators. As I said, the real news is that it's yesterday's news. America is indeed hazardous for children and for loving, informed, involved parents. The time to sit and be outraged is over it's time to write to the newspaper, organize rallies, and flood your lawmakers with protests. The bill has almost nothing to do with what you've probably heard so far. The so-called "gun-show loophole" headlines are a minor detail and basically obscure what the bill really does. I've just finished studying the eight pages of legalese. Here is it what it calls for: 1. Unprecedented federal control over gun shows nationwide -- perfectly legal gun shows become strictly outlawed without prior federal approval, licensing and registration of each show; 2. Centralized federal licensing and registration of every gun-show promoter in the nation; 3. Centralized federal registration of every vendor -- including non-gun vendors -- at any gun show in the country. In order for me to sell my BOOKS at a gun show I'll have to pre-register and prove who I am, or face arrest; a private individual looking to sell a single gun would be treated as a vendor under this law and must be registered even if the gun isn't sold; 4. Centralized federal registration of EVERY PERSON who attends a gun show in America, whether or not they make purchases of anything at all -- you won't be allowed in without registering; 5. Centralized collection of "any other information" on gun-show attendees, as determined solely by the Secretary of the Treasury; 6. Imprisonment for attending a gun show and failing to give up any information required by regulations of the Secretary of the Treasury; 7. Imprisonment of any gun-show promoter who fails to register a single vendor; 8. Imprisonment of gun-show promoters who cannot prove they notified every person attending a gun show of the new rules, and obtained from attendees any information the Secretary of the Treasury mandates by regulation; 9. Centralized collection of "any other information" the Secretary of the Treasury decides, by regulation, is necessary on vendors, attendees, and the gun show itself; 10. Submission by gun-show promoters of vendor registration logs a) 30 days before any gun show, and b) additional submission of updated vendor registration logs 72 hours before any gun show, and c) additional submission of vendor registration logs within five days of the close of any gun show, under penalty of arrest and imprisonment for non-compliance; 11. Identification of vendors only by use of federally approved photo ID that may include use of a social security number, electronically encoded data, or "biometric identifiers" such as fingerprint, voice print, retina scan, iris scan, or similar (as defined under 18 USC 1028(d)(2)); 12. Regulations to be issued by the Secretary of the Treasury on the procedures, data collections, methods and implementation of the entire process to federally control gun shows, in addition to the requirements made by the proposed statute; such regulations will not be known, drafted or even suggested, until after the McCain-Lieberman law is enacted; 14. The proposed bill also puts pressure on state governments to make at least 95% of their law enforcement records for the past 30 years openly available to the federal government; and -- makes unlimited funds available for the states to comply with these federal goals; -- requires annual federal review of states' compliance; -- increases penalties (up to ten years imprisonment) for record-keeping violations; -- grants states permission to make even more restrictive requirements without being out of compliance with these new federal laws (and by implication, puts states that resist these rules in federal trouble); -- provides hundreds of millions of taxpayer dollars for more law enforcement under numerous programs including project Exile and others; -- hires 200 more Federal BATF Agents; -- provides $10 million to the National Institute for Justice to give out for research on "technologies that limit the use of a gun to the owner"; and -- provides for annual reports (in great detail) by the Attorney General to Congress on whether the Brady law is working; 15. Enlargement of the federal bureaucracy and appropriation from taxpayers of "such funds as are necessary" to license, register and monitor an estimated ten million non-criminals who attend the thousands of gun shows held annually in America; and 16. Oh yes, I almost forgot about the so-called "loophole" part the media is so excited about -- the McCain-Lieberman bill will make an honest private citizen a criminal for transferring a gun to another honest private citizen, without first registering the transfer with, and getting permission from, the federal government (represented by the FBI at its data complex in Clarksburg, West Virginia). Transfer or possession of a firearm to or by a criminal (a "federally prohibited possessor") is completely unaffected by the McCain-Lieberman "loophole" bill, so I guess it's accurate to characterize it as a loophole bill. To sum up: Perfectly legal gun sales -- with no victims or criminal activity of any kind -- are outlawed at gun shows by the McCain-Lieberman bill, unless the sale is pre-registered with the federal government; real crimes are totally unaffected; and your friends in the federal government take over full control of gun shows -- which have been previously free of government infringement for more than 200 years. How can you be TOO principled? Take the most extreme position you can -- you're claiming territory you won't have to fight for later, mostly with your "allies". *** Let the other guy offer compromises. Think of them as rungs on a ladder. Keep your own goals fixed firmly in your mind and make sure you never move any direction but upward. That's how the other side got where they are. It works. *** Never aim at anything but total achievement of your goal: utter capitulation of the enemy. Every effort involves inertia and mechanical losses, so adopting any lesser objective means partial defeat. Total victory means you don't have to fight the same fight again tomorrow. *** Second thoughts, failure of confidence, nervous last-minute course-changes are all detours and recipes for defeat. The time to think is before the battle -- if possible, before the war -- not in the heat of it. *** The shortest path to victory is a straight line. He who remains most consistent wins. *** Go straight to the heart of the enemy's greatest strength. Break that and you break him. You can mop up the flanks and stragglers later, and they may even surrender, saving you a lot of effort. *** Always attack in "perpendicular" fashion, from an unconventional and unexpected (but relevant) direction. Most people fear silence at a level below conscious analysis and rush to fill the emptiness with accommodation. A difficult tactic to learn and use, but it works. *** The more fundamental position is the highest ground, allowing the most "perpendicular" attack. If he argues politics, argue ethics -- things seldom go beyond this stage. If he argues ethics, argue epistemology (look it up). If he argues epistemology, argue metaphysics. If he argues metaphysics, you're up against Darth Vader and you're in trouble. Switch back to politics and accuse him of being out of touch with everyday reality. Or ask him if he's stopped beating his wife. *** Conservatives are accustomed to being called fascists and well prepared to defend themselves on that ground. Liberals are used to being called socialists. Those labels can be switched, however, and remain valid and instructive. It also catches them completely unprepared. *** Understand from the minute the fight begins that you're going to take damage. Accept it. (You'll always suffer more from the idiots and cowards on your own side than from any enemy.) Keep your overall goal in mind above all. Those who swerve to avoid a few cuts and bruises defeat themselves. *** If you lose, go down fighting. It costs nothing extra, and now and again ... *** Know down to the last cell in your body that the other guy started it. He's the one who put things in an ethical context where considerations like decency and mercy have no referent. The less pity moves you now, the sooner you can go back to being a nice guy. *** Otherhandwise, the easiest, most humiliating path to defeat is thinking that to beat your enemy you must be like him. Avoid the temptation to set your values aside "for the duration". What's the point of fighting if you give up what you're fighting for? If remaining consistent with your values leads to defeat, you chose the wrong values to begin with. *** Truth is a valuable commodity which you don't automatically owe to anyone. Remember, however, that lies are even more expensive -- they're tiring and costly to maintain -- and even a tiny one can utterly destroy you. *** Never soft-pedal the truth. It's seldom self-evident and almost never sells itself. There's less sales resistance to a glib and comforting lie. *** Lies can be custom-tailored; truth comes straight off the rack -- one size fits all. *** Those who lead through authority have rivals on whom they must expend as much energy and attention as they do on their enemies. Those who lead by example have enemies, but no rivals. *** In conflict, if you control their head you win the fight. The girl sprinted across the room and leapt into Kim Ogletree's=20 arms, wrapping her legs around her mother's waist. When Jimmy Barnett reunited with his 8-year-old son, Cephas, he lifted th= e=20 boy high into the air. Then he hugged him tighter and tighter. Half an hour after David Duncan and his son, Stephen, found each other, t= he=20 7-year-old continued to rest his hand on his father's shoulder. In the chaos of Friday's sudden reunions between members of the House of=20 Prayer church and many of the children seized from their homes by state=20 welfare officials in an abuse investigation, the boy wasn't letting his=20 father go anywhere. When her tears subsided, Ogletree said getting her eight children back fr= om=20 state foster care was almost enough to make up for the trauma of seeing t= hem pulled from their home May 8 in an ugly confrontation with police. Like t= he=20 other parents, Ogletree had not seen her children since they were taken i= nto custody. For some parents, the separation had been as long as two=20 months. "If you hold on and stay firm and continue to believe, you can see what=20 happens," Ogletree said. "It took a miracle, but we got our children=20 home. The Lord brought them home." DFCS officials showed little sign of relenting on the conditions they had= =20 asked the judge to impose. "[The parents] said they would come, but if all the children are not=20 here, they would not take any," Andy Boisseau, a DFCS spokesman, told=20 reporters at midday. "All of the children are not going to be here - that= 's for=20 certain." To avoid raising false hopes, the children were not told that a reunion w= as=20 a possibility. But at the House of Prayer, about two miles from the DFCS office,=20 Brooks and several colleagues were meeting with Allen and church members, trying=20 to reach a compromise. Less Guns, More Crimes VPC Vindicates Lott Findings by David Codrea, GunTruths Correspondent Washington DC- In a stunning development, the Violence Policy Center (VPC) released Hispanics and Firearms Violence on May 8, a study that puts the anti-defense collective squarely on the side of gun rights defenders. Also attending the Capitol Hill press conference were U.S. Representatives Lucille Roybal-Allard (D-CA), Grace Napolitano (D-CA), and Hilda Solis (D-CA), as well as representatives of leading national Hispanic organizations, who joined Karen Brock, MPH, VPC health policy analyst and study author in endorsing the startling findings that less guns result in more crime. "Hispanics own guns at rates lower than the general population," states the study's introduction. "Hispanics are far less likely than blacks or whites to own guns," the study maintains. "Only 11 percent of Hispanics own guns, compared to 16 percent of blacks, and 27 percent of whites." "Hispanics are more likely than those in other racial / ethnic groups to be victims of violent crimes involving strangers," the study continues. "77.4 percent of Hispanics were murdered with a firearm-the highest percentage for any racial or ethnic group... Handguns were used in 69.5 percent of all Hispanic homicides-once again the highest of any racial or ethnic group." In addition, the VPC study also demonstrates how more guns result in fewer gun-related injuries, a further reason to encourage responsible firearm ownership. "That year [1997], Hispanics had a total firearm injury (fatal and nonfatal) rate 2.8 times that of whites," it states. "This information is further supported by a 1996 New England Journal of Medicine study which found that Hispanics were shot (both fatally and nonfatally) at a rate 2.6 times higher than non Hispanic whites." VPC also asserts that fewer guns resulted that "Hispanic households had significantly higher rates of property crime, burglary, and theft than non-Hispanic households." What all of this means, to anyone capable of constructing a syllogism, is that if less guns result in more crime, the opposite is proven true as well, a position advanced by Yale University Professor John Lott in his landmark book "More Guns, Less Crime." Bottom line, folks, the anti-defense lobby has tripped on their own numbers and is too dumb to figure it out, especially the opportunistic moron politicians Roybal-Allard, Napolitano and Solis. The "study" compared such disparate "regions" as California, Texas and Chicago, as if the populations in geographically extensive states can be considered homogeneous - no attempt was made to disclose Hispanic homicide / injury rates based on urban / rural environments, nor to point out how ridiculous it is to compare such state figures with those of a city. Nor did they factor in such influences as existing gun laws which render populations defenseless; for instance, it is illegal to own a handgun in Chicago that was not registered by 1982. Also absent from the "study" was any indication of how many of the homicides were justifiable, either by law enforcement personnel or private citizens defending themselves or others. Nor was affiliation of the "victims" with criminal activities explored, or the distinction between gun possession and lawful ownership. But that's because the folks at VPC have never shown as strong an interest in promoting the truth as they have at dredging up whatever crazy and subversive crap they think will generate headlines, enhance their political clout, encourage contributions from well-heeled and well protected elitist patrons, and further undermine the ability of average Americans to exercise their God-given right to self defense.
