From: Bill Vance Subject: on nuclear weapons and the well-regulated militia (fwd) Date: 01 Aug 2001 23:15:38 -0700 August 1, 2001 ALERT: On nuclear weapons and the 'well-regulated militia' by Vin Suprynowicz Special to JPFO, for release Aug. 1 Signing himself, "M.D., Ph.D.," a reader I'll call by the initials D.H. wrote in recently: "Dear Vin, I have just finished reading your book 'Send in the Waco Killers'. Congratulations on writing such an interesting and provocative book. I also enjoy your columns, especially those on U.S. drug policy. You were right on to castigate the oblivious public for its complicity in shooting down the missionary and her daughter. The whole drug policy travesty/ scandal is a major reason why I've moved to Canada. "I have a couple of questions. In your book, you seemed to sidestep the question of what the Founding Fathers (may they stop spinning in their graves) meant by "well-regulated" in relation to militias. Also, if you permit private citizens to possess heat-seeking anti-aircraft missiles as part of their 2ndA rights, as you suggest, why not nuclear bombs? Isn't it all a matter of degree? Or do nuclear bombs fit under the 2ndA as well? "Keep up the great work." # # # I replied: Hi, D.H. -- If you take a double rifle to a British gunsmith -- to this day -- and ask him to "regulate" it, he will ask not about government restrictions, but rather for what charge and weight of ball you want those two barrels "regulated." Those barrels are said to be "regulated" for a .45 caliber ball ahead of 70 grains of black powder if they will both hit the same target at a predetermined range (often, 60 yards) with that loading. A "well-regulated" militia is one which is well enough practiced in the use of their weapons -- and accustomed to operating together in the field -- to be an effective fighting force. Far from "sidestepping this question" (the victim disarmament gang only keep SAYING we ignore it -- it's a rhetorical trick, you see) I define the term directly at the bottom of page 424: "Well-regulated means well-trained ... in firing volleys, reloading quickly, and blowing things up. What do you think George Mason and George Washington were up to when they organized meetings of the Fairfax Country Militia in the mid-1770s -- trading ginger cookie recipes?" Nor would the other Founders have told George and George, "You're only free to exercise your 'collective right' to bear arms by joining the uniformed mercenaries retained by the crown governor." Quite to the contrary, such "special militias" -- the 18th century equivalent of today's "National Guard" -- were a form of armed security the Founders specifically warned us AGAINST, insisting that the only guarantor of freedom was that "every man be armed; everyone who is able must have a gun." (Patrick Henry, who called this "the great object.") No, George and George did not seek the crown's permission to take up arms and form their Committees of Correspondence. More importantly, I continually ask, both in my first book and in my subsequent writings, "If the other side wants to insist on the relevance of the non-binding introductory phrase, 'A well- regulated militia being necessary to the security of a free state ...' let Janet Reno and company explain to me when and how and where I and my hunting buddies are SUPPOSED to go to practice our small-unit tactics with M-16s and a Model 58 or Model 60 Squad Automatic Weapon, the better to BECOME a 'well- regulated militia,' better prepared to shoot and kill the next tyrant to dispatch tanks against harmless civilians on American soil. We'll drive as far out into the desert or the woods as they like; just let them explain to us how we're supposed to legally practice such drills without being jailed for "conspiracy to violate the National Firearms Act of 1934." The answer is that these scum are lying. For us to form "well- regulated militias," well able to resist federal tyranny or usurpation, is the LAST thing they want. Are they pestering Congress, asking the delegates to set sensible performance and readiness standards for the Michigan Militia and the Ohio Unorganized Militia and Arizona's Viper Militia -- standards which, once met, will allow these citizen militias to receive cargo planes full of free surplus Stingers and pack Howitzers from Washington, thus discharging Congress' duty to "provide for ... arming .. the militia" (Article I Section 8)? They would shriek in horror at any such proposal. This "You forgot the militia clause, nyah nyah" mantra is nothing but a totally insincere Jesuitical posturing designed to get their chorus of bed-wetters nodding in unison as they were taught in their government youth propaganda camps, chanting "Right, no guns unless they're part of the militia, which really means the National Guard" -- that National Guard which the Founders warned us AGAINST, their warning term at the time being a "special militia," comprised of uniformed mercenaries paid by and loyal only to the seat of power. Do those who insist "Now we have a National Guard so we no longer need a citizen militia" actually contend the National Guard is there to protect us FROM the government? Did the Texas National Guard race to the defense of the harmless and innocent Branch Davidians at Waco ... or did it loan its military helicopters to the federal killers, happily topping off their tanks and cheering them on their way? # # # As for nuclear weapons, language is important. Look at your own words: "If you permit private citizens to possess ..." It is not the business or authority of Vin Suprynowicz to "permit" private citizens to possess or not possess anything ... and I certainly wouldn't FORBID them the ownership of anything except stolen property. So, for starters, you probably mean: "If the federal government permits private citizens to possess ..." But here we run into the same problem. All federal lawmaking authority is vested in the Congress, and is the Congress authorized to permit or ban or allow or infringe the private ownership of arms? Actually, two provisions apply: In Article I Section 8, as mentioned, Congress is given power to "provide for ... arming .. the militia." It may give us arms. But may it TAKE away those arms, or any other arms? No. The Second Amendment bars any INFRINGEMENT of the right to keep and bear arms. A "power to allow or not allow"? Not there. Nor anywhere else. Is it appropriate for the federal government to own nuclear weapons? That is to say, has any federal official in the military chain of command -- from Harry Truman on down -- ever been put on trial for merely having control over nuclear weapons? No. Therefore, shall we surmise the federal government and its agents have some proper and duly delegated right, power, or authority to possess such things? If so, where did it or they get that right, power, or authority? Fortunately, under our system of government, we know what the answer must be: The government can acquire no right, power or authority except those which are delegated to it by the people. Can you delegate a right, power or authority which you do not already possess? No. Therefore: The American people, both individually and as a group, have the right, power and authority to own nuclear weapons. No other condition can apply, unless you submit that we now live under a form of government where all rights and powers start with the GOVERNMENT MASTERS, who then bestow upon us (their peasants and slaves) only those lesser and included rights which our masters wish US to have. On page 414 of "Send in the Waco Killers," I cite noted federalist and friend of Madison Tench Coxe to the effect that "Their swords, and every other terrible instrument of the soldier, are the birth right of an American. ... The unlimited power of the sword is not in the hands of either the federal or the state governments, but, where I trust in God it will ever remain, in the hands of the people." It was only upon the receipt of such solemn, written promises as this that Madison's proposed Constitution was ever ratified. What does "unlimited power" mean? If I possess "the unlimited power of the sword," who shall limit it? Is the nuclear bomb one of the "terrible instruments of the soldier"? # # # How seductive is the old siren song: "Come on, prove you're REASONABLE; admit you don't have any NEED for a nuclear warhead." But once we start down that road, won't they also wheedle and cajole and nag us into stipulating that we don't really "need" a tank ... a howitzer ... a shoulder-launched missile ... a machine gun ... a semi-automatic rifle ... anything, finally, beyond an unloaded black-powder ceremonial flintlock with a plugged barrel that we're allowed to take out of the police locker only long enough to carry in the Fourth of July parade? How would we respond if asked to prove we "need" to go to church or temple as much as twice a week? Surely once a week is enough, isn't it? How about every OTHER week? Can you prove you "need" to speak to your God in prayer more than twice a month? The only way to win that debate is to refuse to enter into it: Freedom of religion is my RIGHT, and a right exists without any requirement that I prove to your satisfaction my pragmatic "need" to exercise it. In even ATTEMPTING to prove to you that I "need" to be able to go to church when I please, or to publish any column I care to write ... or to own a nuclear bomb ... I lose the argument at the outset. "Need" simply doesn't come into it. "The right of self-defense is founded in the law of nature, and is not, nor can be, superseded by any law of society," sayeth Sir Michael Foster, judge of the Court of King's Bench, in the late 18th century. If your enemy or oppressor has a bomb, then get yourself a bomb. "And he that hath no sword, let him sell his garment, and buy one," sayeth Jesus the Nazarene (Luke 22:36.) Have you really read my chapter on "Demonizing the militias"? All those founding fathers -- re-read pp 412-418, for starters -- reassuring us that "The supreme power in America cannot enforce unjust laws by the sword; because the whole body of the people are armed and constitute a force superior to any band of regular troops that can be, on any pretense, raised in the United States" (Noah Webster)? Is that the situation that prevails today? Government officials cowering in fear that if they try to enforce "unjust laws" they'll be shot down by a civilian populace that's got them thoroughly outgunned? Then why did medical marijuana patient (and former Libertarian gubernatorial candidate) Steve Kubby have to flee to Canada with his family just last week to avoid being jailed -- doctors say his adrenal cancer will quickly kill him if he's deprived of his "illicit" medicine -- YEARS after a clear majority of Californians voted to OK medical marijuana? That facts and rights and truths are inconvenient or "inconceivable" means no more than to say that to a prisoner of some dank cell on Devil's Island, running 100 yards in a sunlit field is "inconceivable." It defines the limits of your perception and your expectations -- your ability to VISUALIZE LIBERTY -- not the limits of the world. Plenty of nuclear weapons ARE possessed by all kinds of people, including the kind that wear turbans. Government "safeguards" are a joke. Think no hijacker could get past the Fred & Ethel Mertz Security System down at the local airport if they really tried? It took Capt. Marcinko only a matter of minutes to penetrate the supposedly ironclad "security" at the American embassy in London -- right through to its ultra-secure "code room." He simply sent a man in a Marine uniform, carrying a clipboard, walking boldly in the side "smokers' door." Last week, the Justice Department revealed that the FBI has lost 449 sidearms and submachine guns -- one of which was even used in a homicide. But we're supposed to believe they've NEVER lost enough plutonium to make a bomb? Noooo. After all, they're not mere fallible mortals. They're "the government." We can "trust" them. The only reason the Soviets didn't nuke Washington is that Washington would have nuked them back. What is the only reason Washington wouldn't nuke US? Because they're "really nice guys" who "wouldn't go THAT far" to hold onto power? # # # I've said my right to bear arms is not DEPENDENT on demonstrating any "need." But I'll tell you one group of people that desperately "needed" a nuclear weapon: The innocent women and children of the Mount Carmel Church of Waco, Texas. If Uncle Sam spent most of the past 50 years negotiating with Soviet Russia rather than attacking them in cattle cars, don't you think Janet Reno's approach to a nuclear-armed David Koresh might have been a little more calm and polite? Ditto the Florida relatives of little Cuban refugee Elian Gonzales. Imagine it: Citizens well enough armed that our federal government would feel obliged to approach us with respect, ASKING whether we might be willing to help them out in a spirit of cooperation ... rather than busting down our doors, shoving German MP-5s up our nostrils, and asking questions later. That facts and rights and truths are inconvenient is no excuse for turning our eyes away from them. If I have the skills to build or the money to buy one, I have a right to own a nuclear weapon, and so do you. How could it be otherwise? To say otherwise is to say I have no right to make myself a straw hat just because I have the straw, because the government has declared a monopoly for itself on hat manufacture, and I must first pay a tax for the privilege. This is like telling Mr. Gandhi that "making salt" was a British government monopoly. We all know where that got them. And of any government which will not trust its own people with these weapons we need ask, "Then why should we trust YOU with them? Because you promise never to use them to cow us into servitude ... as you once promised, before Waco, never to use military tanks and armed helicopters against American civilians -- women and children -- on American soil? To enforce a mere $200 tax?" Has the government in Washington City ever show any reluctance to use weapons of mass destruction against a civilian populace when it seemed necessary to get its way? Forget Nagasaki for a moment; Did Grant shell the civilian population of Vicksburg? Was he punished for wantonly killing those civilians ... or rewarded with his government's highest office? No, D.H., it is not "all a matter of degree." Quite the opposite. Providing only that I don't use them to threaten, intimidate, rob, or murder other sovereign individuals, in terms of the right of government to infringe them, my liberties are not subject to being "weighed against the government's compelling interest in keeping people from smoking marijuana," or "weighed against the government's compelling interest in preserving the endangered sucker fish," or "weighed against the government's compelling interest in making sure little girls can go to bed at night without being frightened by the sound of gunfire," or ANYTHING ELSE. They are ABSOLUTE. And the sound of rifles being sighted in on the 200-yard range is the sound of freedom. It does not say "shall not be infringed, unless the weapon in question is really scary." They're SUPPOSED to be scary. The occupants of Washington City are supposed to go to bed every night, wondering if anything they've done today will get them what it got Charles the First in 1649, or Louis XVI in 1793. To their oaths of office -- unless we decide to sweep those offices away entirely, as is our right at any time -- should be added, "And if this day you usurp the rights or liberties of the very least American, be afraid ... be very afraid." Somehow, I doubt they're losing much sleep over my deer rifle. Do you think? -- V.S. So now everybody gets "Faceprinted" instead. Seems like a move in the wrong direction. The only way they can tie a face to specific person is to have a pre-recorded copy of the face to compare to, or to compare features of with, the face to be identified. This is no different than with fingerprints. So all the little kiddies will have their pictures taken and digitized. I doubt the kids will an choice, unless they don't want to eat, at least after a trial/voluntary period, they certainly can't not go to school, at least as a practicle matter. US Congressional Switchboard Toll-free Numbers 1-800-648-3516 1-877-762-8762 Radical activists and the media are gearing up for the "World Conference Against Racism, Racial Discrimination, Xenophobia and Related Intolerance." U.N. Secretary-General Kofi Annan will be presiding as African nations press their demands for slavery reparations from the Western countries who profited from the slave trade. The African World Reparations and Repatriation Truth Commission wants a grand total of $777 trillion in reparations to the people of Africa. But here's a couple facts they don't want to discuss: Number one, slavery still exists in Africa, run by Africans. And number two: Kofi Annan himself comes from a prominent family in Ghana who were members of a tribal group that profited from slavery. Slavery has long been a part of the culture and still exists there today. Indeed, Ghana has been called the cradle of slavery, and slave castles have become major tourist attractions there. Annan's father was a politician - the elected governor of Ashanti Province. That's significant because the Ashanti group became dominant in the area and controlled trade routes to the coast. Their control over the trade in gold, ivory, and slaves made them, and later the Europeans, very rich. Annan's ancestors received firearms for their role as middlemen in the European slave trade. The fact is that slavery existed in Africa long before the Europeans arrived. Slavery was an accepted social institution and was firmly entrenched in many African societies before their contact with Europe. Men and women captured in tribal warfare became slaves. It still exists today. The U.S. State Department's annual report on human rights practices, released in February of this year, describes a religious tradition called "Trokosi" in Ghana: "Although the Constitution prohibits slavery, religious servitude--Trokosi--exists on a limited scale. In June 1998, Parliament passed and the President signed legislation to ban the practice of Trokosi in comprehensive legislation to protect women and children's rights. Human rights activists believe that the goal of eradicating the Trokosi practice is attainable with the new law; however, the practice persists." But how limited is it? Some reports say there are around 5,000 Trokosi slaves within Ghana. But local humanitarian groups say the figure could be as high as 10,000 to 12,000. Under this system, virgin girls are given to priests to appease the gods for crimes committed by relatives of the family. The initiation rituals signify marriage to a god and its proxy, the priest. The girl becomes the priest's property and enslaved for many years, even life. Belatedly, the media have focused attention on the slave trade in Sudan, where Muslims buy and sell Christians. But the situation in Ghana continues to escape attention, even though one would think that Kofi Annan would have a personal interest in highlighting that. By the same token, that may explain why he would want to ignore it. On December 2nd, 1999, the International Day for the Abolition of Slavery, Annan, said that this "is not a time for complacency in the fight against slavery, but a time for action." He should go back to his native country of Ghana and help abolish slavery. Call the office of Congresswoman Cynthia McKinney and urge her to highlight Kofi Annan's link to the slave trade. Her number is: 202-225-1605 The Congresswoman has taken the lead in promoting Kofi Annan's World Conference on Racism. Here is a copy of her statement at a June 19 event in Washington: OPENING REMARKS of CONGRESSWOMAN CYNTHIA MCKINNEY, CBC TASK FORCE HEARING ON THE UN WORLD CONFERENCE AGAINST RACISM. WASHINGTON - 06.19.01 | Welcome, and let the spirit of Juneteenth [the date recognized by some as the "true" date that slavery ended] pervade our discussions here today. I am please to introduce my colleagues who are with us this morning. More will come throughout the morning. The World Conference Against Racism, to be held in late August this year in Durban, South Africa, is an important world event. It seeks to focus world attention on examining the causes of racism as well as providing an opportunity for nations to formulate practical measures to prevent, and where possible, to eradicate racism and other discriminatory practices. What could be more important than for the family of nations to come together as one and to seek to end racism in the world today. The United States should fulfill its leadership position as a major world power and attend the conference. We should send a delegation consisting of highly respected and extremely capable individuals who hold high aspirations and deep convictions on ending the scourge of racism in the world today. The Congressional Black Caucus can play a critical role in ensuring that this current administration fully appreciates the importance of this World Conference to people of color in this country. The members of the CBC all represent districts affected by poverty and race hatred, stricken with incarceration, overcrowding, violence, and all the other familiar ills of modern black urban life. To our nation's great shame it has had much experience with racism. That experience spans almost every generation of our nation's history: from the early years of slavery during the establishment of our nation, through the apartheid practices of the southern United States, and finally through the federal government's physical destruction of the black political movement here in this country during the 1960s and 1970s. But our nation's journey with racism will not end until it faces the truth of its past. By drawing upon our nation's history and forging with it a willingness to confront these horrible truths, our delegation should be able to make substantive contributions to the World Conference forum examining the causes of racism. I wish to briefly address two important issues which I think should feature as center points in our discussion today. The American slave trade and the destruction of the black political movement here in the US in the 1960s and the 1970s under the federal government's COINTELPRO (counter intelligence) program. From 1490 until about 1870 one of the most elaborate maritime and commercial ventures arose, a result of which 30 - 60 million black men, women and children were enslaved in Africa and carried packed in ships wearing leg irons, in foul overcrowded conditions, and transported to the Americas to work on plantations, in mines or as servants in fine houses. Tragically, many tens of millions of them did not survive the journey and died en route during the Middle Passage from disease, cruel treatment, and the rigors of sea travel. Slavery stretched several hundred years, involved every maritime European nation, every Atlantic-facing African people (and some others), and every country of the Americas. On any view, this slave trade must rank as one of the greatest crimes of all time. Upon arrival in the Americas black families were broken up, men separated from their wives, and mothers and fathers permanently separated from their children. These slaves then suffered the further indignity of losing their African names, as well as, their own histories, cultures and languages. Their combined labors generated fabulous wealth for their white masters and they provided much of the financial foundation for modern America. Despite centuries of back breaking labor, black Americans never shared in the wealth and instead, to this day, remain poorer than whites, enjoy lower standards of living, suffer lower standards of health care, and figure disproportionately in incarceration levels in our state and federal prisons. Incredibly, this history of slavery is largely unknown to the vast majority of Americans. Our nation has refused to confront the enormity of this crime and has instead sought to create the myth that slaves were better off being manacled and brought to the Americas. Nothing is ever said of the millions of slaves who died, of the destruction of whole African communities by ill health, violence, and separation. And nothing is ever said of the sheer injustice that nations which committed this crime still, to this day, refuse to even apologize for their conduct let alone pay reparations for the damage caused by their actions. I remember only too well when Congressman Tony Hall introduced legislation asking for the Congress to apologize for slavery. To my horror I overheard other Members on the House Floor laughing behind Mr. Hall's back because he was foolish enough to introduce the Slavery Bill. Not surprisingly the bill never got out of committee and was never voted on. One other matter I think important for discussion in Durban is the federal governments COINTELPRO program. Important research is revealing that during the 1960s and the 1970s the FBI and other sections of the US military and intelligence apparatus conducted a secret war against black political groups and the Native American movement. To our collective shame we are now learning that the federal government conducted a secret, systematic and at times, savage use of force and fraud against a small political minority exercising fundamental freedoms considered sacred by our Constitution. Many of our black political leaders were wrongly accused of crimes and imprisoned, and some were even murdered. The black political movement in this country was totally destroyed by our own government. The Native American movement suffered the same fate. What I am telling you about didn't happen in Nazi Germany under Hitler, China under Mao, Chile under Pinochet or Uganda under Idi Amin. No, it happened here in the United States, under Lyndon Johnson, Richard Nixon, and others. That this happened to people in this country in the 1960s and 1970s is no longer conjecture. It is a shocking fact that the federal government wrongly imprisoned and even murdered innocent black Americans. On this generation of Americans falls the burden of proving to the world that we really mean it when we say that all men are created free and equal before the law. The real history of slavery in this country must be publicly recorded and there must be a reckoning with black America for its sacrifice in building this nation to what it is today. In addition, our federal government should reveal the truth about the full extent of the COINTELPRO program and make its records open to public examination. I'll tell you what happened in the Parting Shot section. Today, as most of you know, is when we can announce that the Militia of Georgia has standardized its weaponry for the Special Forces Division. Those weapons include: M1A / M14 and its variants, the M1 Garand, .30 caliber Bolt action weapons (preferably .308), any AR15 / M16 variant and 12 gauge pump action shotguns. A lot of you said you couldn't afford the expense of the AR but, still wanted one. When we suggested that you build your own, many were ready to jump on the bandwagon. And just as Johnny Cash sang about building a Cadillac "One Piece at a Time" you too, were ready to build your custom AR that way. So, here's a list of companies that will sell you the parts. The parts can be bough via the phone and shipped directly to you. The LOWER RECEIVER is the only part you cannot buy through the mail. It has the serial numbers on it but, can be purchased at gun shows, in gun shops or ordered by a dealer for you. The average cost of the LOWER RECEIVER (stripped) is about $145 or thereabouts. One M.O.G. member bought a completed lower with the stock attached for $300. We later found a completed upper (sights, barrel, etc. for another $350) but, he ran short of funds. Today, we presume you will buy the LOWER stripped and purchase all the other parts from a dealer. Here's the Dealers, the kit price, etc. : 1 - American Spirit Arms Corp. has kits beginning at $500. Call them at 1 - 888 - GUN - KITS ( 1 - 888 - 486 - 5487 ) 2) J&T Distributing has great quality parts for $435 in the collapsible stock or full stock models with the NEEDED 1 x 9 twist barrel. Their number is 1 - 888 - 736 - 7725 3) Sarco has parts sets offered at $375 but, it's not known if these are post or pre ban - new or surplus. Their number is 908 - 647 - 3800. 4) Model "1" Sales has parts sets for $400 in any configuration you can think of : 16 inch to 24 inch barrels. You have to specify the barrel twist (1 x 9) though. Their number is 847 - 639 - 3192 5) M&A Parts (a good company) has sets for $415. They have any configuration you want: post ban, pre ban - full size or collapsible models. Call them at 847 - 550 - 8246 6) Olympic Arms sells kits for $424 to $449. Your dealer can even order a complete rifle with a MSRP of only $600. See their website at www.Olyarms.com 7) Rock River Arms has a complex pricing structure. Call them at 309 - 792 - 5780 or visit the site at www.rockriverarms.com 8) Bushmaster has a lot of variations PLUS you can get your rifle barrel fluted, custom flash suppressors, etc. They are among the most expensive but, you can build a truly custom weapon with their parts. Call 1 - 800 - 998 - SWAT or visit www.bushmaster.com Their parts and services are good but, their politics are questionable. Again, you want a barrel of 1 x 9 twist rate so you can shoot all the different kinds of ammo with a consistent accuracy. Military parts (M16) fit the receivers but, dealers tell me it is "illegal" to build them that way. It's not my area of expertise because back in the 70s, everybody built ARs with military parts. I'll tell you what I know but, my area of expertise is in the M1 Garand and M1A rifles. ## WOLVES IN SHEEP'S CLOTHING Someone called US - Militia has been threatening us. Here's the deal: We exchange info with a LOT of groups. When they send us e - mails that use the "cc" feature, my program picks up their addresses and sends them all our public mailings. US Militia for whatever reason, does not want to associate with us. We respect that. But, they keep threatening to report us to the ISP for SPAMMING. Well, these people have no respect for us nor the liberties we protect. They are cowards. So, please do not send US Militia, nor its members any mailings that include the Militia of Georgia nor myself. If you do, I'll be forced to block you from my e - mail service. # # # PARTING SHOT I wanted to include a lot of mail for this section but, decided to forego that. This could be a long newsletter and we don't get enough feedback to justify doing a lot more with it. There is a necessity though to answer some concerns: First, we did not report on Klamath Falls nor get involved. Why? My men are specially trained. They are tiring of "ALERT" only to be followed by "Stand Down." If we walk off our jobs, leave our families and go to someone's aid, we expect to walk away with a victory. The Klamath Falls situation was not a victory but, a joke. Since the feds over-ruled the courts, one wonders what is really going on. Ladies and gentlemen, at some point we will have to ACT. We will have our Lexington Green. Do not send us any ALERT messages unless you are serious and willing to stand on the front lines with us. I have an UNCONFIRMED REPORT that Atty. Gen. John Ashcroft said on some television report that the "Militias were a threat to national security." My source is trying to get a copy of the video. I don't doubt that Ashcroft said it. Bush says he will sign a bill to require background checks on private gun sales. That, as I've explained many times is NATIONAL GUN REGISTRATION!!! Under so - called "illegal immigration reform" the INS will keep all those "background check" records forever. And y'all know Bush's record on illegal immigration. If INS has access to those records, they can give it to the FBI, BATF, MJTF, etc. at any time. If we are sincere, we are a threat to this unconstitutional legislation. The American Revolution began with gun confiscation... and registration always precedes confiscation. We must not comply with this kind of legislation. Anyway, the August meeting will have some surprising news for a change. It will be GOOD. How many times have I promised you GOOD NEWS? Until then, I'll keep collecting info and will have some news to go along with the already good news at the August meeting. If you are a Constitutionalist or a conservative, there's a reason for that: It's true. For those of you on heart or blood pressure medication, you might want to stop reading here because we are going to show how you have been supporting all those far-left groups that work against everything you want. This is distressing, so be forewarned. In the early 1960s, the Democrats thought they needed a helping hand to stay in power. So, the Democratic National Committee joined together with a couple unions and formed the National Council of Senior Citizens (NCSC). The NCSC(1) charged dues to members, but that is but a drop in the bucket to the organization. It is primarily federally funded with your money, to the tune of about $70-million annually. The group received over $300-million in federal grants in its last five years of operation. Between 1964 and 1994, NCSC received more than one-billion bucks in tax money. Why should we care? Generally speaking, NCSC is organized labor's lobbing arm and is used to mobilize retired union workers. The NCSC went out of business last year and handed off to the Alliance for Retired Americans, an AFL-CIO organization. At least, they said they were disbanding. Then, they turned up with 170 other far-left organizations on the dole to form an activist group called the Fair Taxes For All Coalition, designed to fight against President Bush's proposed tax cuts. According to the Cato Institute(2), between 1996 and 2000 alone, these 170 far-left groups have collectively received $618-million of our tax money. Which means, our taxes are financing the socialists so they may better institute socialism in this country. So, of course they don't want a tax cut. The Fair Taxes For All Coalition is co-chaired by the American Federation of State, County, and Municipal Employees (AFSCME) -- the nation's largest government employee's union -- and the People For the American Way. AFL-CIO is helping, too. The Detroit AFSCME union hall, readers might remember, hosted the Democratic Socialists of America convention two years ago.(3) AFSCME received $447,000 in federal grants from 1997 to 1999. The AFL-CIO collected $6-million in tax money from 1997 to 2000. United Auto Workers is also against the Bush tax cut. UAW received over $3-million in tax money from 1996 to 2000. The National Urban League is in on this, too. They ripped off a cool $123.9-million between 1996 and 2000. Between 1996 and 2000, NAACP received over $1.5-million, NOW took $1.2-million, YWCA got $48.8-million, National Council of La Rasa got $9.5-million, League of Women Voters took $2.3-million, and so on. The list is like a who's who of the far left. This is the Democratic Party in action. They all get much of their money from the U.S. Treasury. Some far-left groups actually get over 95% of their money through federal grants. Of course, they also give a lot of that money back to Democrats running for office. They all also mobilize as activist front groups for the Democratic Party's causes. Looking at the amount of government grants dispersed to activist groups is interesting, too. The Department of Labor awarded $433-million, The Department of Health and Human Services gave $93.2-million, Housing and Urban Development gave out $28.2-million in grant money, etc. This is all money going to advocacy groups, not identified federal programs. Which means, much of this money is used to fund socialist positions most of us would strongly disagree with. We should note here that only the 170 groups making up the Fair Taxes For All Coalition are listed in the Cato report. Which means, this is just part of the story. For instance, the environmental whacko groups are not represented. Clearly, we have a long-term major problem here. The Democrats are funding the socialist activists with our tax money. This must stop right away. There is absolutely no reason for the government to fund private organizations, and especially politically motivated organizations. As Thomas Jefferson once wrote: "To compel a man to furnish contributions of money for the propagation of opinions which he disbelieves, is sinful and tyrannical."(4) That's a proper description for the Democrats: "Sinful and tyrannical." Because, if the Constitution is good, the Democrats must be bad since they refuse to obey it. We have our work cut out for us, folks. Let's get Congress to stop funding these far left activist groups and instead fund organizations that will support the Constitution. 1. http://www.aoa.dhhs.gov/aoa/dir/149.html 2. http://www.cato.org/pubs/pas/pa-407es.html 3. http://209.15.142.23/reports/headsup/hu191.htm 4. Bill for Religious Freedom, 1779. Papers 2:545 A PROPOSAL FOR VOTER FRAUD Here's a new report that's about as proper as a couple wolves running lose at a Siamese cat show. The Odd Couple of ex presidents, Jerry Ford and Jimmy Carter, teamed up to bless us with their wisdom once again. Ford has an excuse. He has "old-timer's syndrome." Carter, on the other hand, is still a socialist meddler. It was a safe bet that these guys would propose just exactly the opposite of what the Constitution mandates of government, and so it happened with the National Commission on Federal Election.(1) The commission proposes that the federal government coerce states into restoring voting rights to convicted felons who have served full sentences. As governor, Bush backed that. However, States run the election, not the federal government. Therefore, States may do as they wish on this matter. Some States allow felons to vote, others do not. The commission proposed that Congress give States $1-billion to $2-billion to help update their election systems. To qualify, States would be expected to make a "few" changes in their voting law. For instance, States would need to allow voters to correct ballot errors. Most already do, two or three times. The commission, apparently, would have the States allow a voter to stay in the booth however long it takes them to get it right. That's silly. That could cause huge lines to back up. Now the fun stuff starts: The commission wants standards "that define what constitutes a vote." That makes us wonder if these people ever really voted in a polling place. Every polling place I have seen in five States had complete instructions out front (and, sometimes in the voting booth) that tells exactly how to vote, shows a sample ballot and demonstrates what errors will cause a ballot to be voided. So, it only stands to reason that when one follows the simple instructions one can be assured that the vote will count. This means, when the sign says the chads must be punched out in order for the vote to count, the vote will not be counted if the chad is still intact. If a voter cannot read and follow simple instructions, that is usually a good indication they do not belong in the voting booth, anyway. The commission also wanted unregistered voters to have the option of voting. The ballots would then be deposited in a "provisional ballot" box until after the election. What a joke! Ballots are supposed to be secret. That's why the voter deposits the ballot in the ballot box and poll workers are not allowed to touch them. So, if there is a whole box of "provisional ballots" sitting around until "after the election," who would verify the voter and count the ballots? No one, that's who. In many large cities, poll workers would just mix them in with the others. There's so much voter fraud going on anyway, this would just make it easier. Already, in the last election, a few major cities had larger vote counts than registered voters. The commission also suggested censoring the press. That is, they want news organizations to refrain from projecting election winners until after polling places are closed in all 48 contiguous states. Fat chance! There is a strong relationship between the media and the Democratic Party. The problem in the last election started with a company named Voter News Service. VNS is owned by the Associated Press and the television networks. They all share the same liberal bias. Last November, many Americans noticed that quite often the vote results displayed at the bottom of the TV screen were greatly different than what the talking heads were announcing. Many times, Gore was projected the winner of a State when, in fact, the actual voter results at the bottom of the screen showed Bush with a decisive lead. When the results came in from east of the Rockies, the talking heads were calling Gore the winner when their displayed data actually favored Bush. This technique cost Bush a lot of votes in States voting late as well as in States west of the Rockies that all still had their polls open. To think that all these "very experienced journalists" reporting the election did not know exactly what they were doing is silly. It was intentional. They can't blame Voter News Service when they were responsible. All they had to do was to read their own monitors. We need a major overhaul to fight widespread voter fraud. Unfortunately, nothing useful came from this commission. 1. http://www.reformelections.org or, http://www.brook.edu/GS/Projects/ElectionReform.htm DOUBLE TAXING SOCIAL SECURITY Here's a quick flash for all working folks, especially those who still tend to trust the Democratic Party: Check out the amount of payroll (FICA) tax you are paying nowadays. That's you're "contribution" to the Social Security fund. The federal government charges workers a lot more in payroll tax than paid out in Social Security benefits. Then, they tell the American people that, since 1980, the excess Social Security tax has been deposited in a Social Security Trust Fund because it will be needed when the "baby boomers" retire. There should be over $4-trillion in that trust fund this year and the fund should be growing at a rate of nearly $100-billion per year. However, Democrats had a different idea about what to do with that money and Democrats were running Congress back in the 1980s. Actually, two years after the Social Security fund was started (back in the 1930s) Congress noticed there was a lot of money available and started spending it. But, that's another story. Anyway, today there are zero dollars in the Social Security trust fund. Instead, Congress "lent" the money to the general fund and spent it on programs that were never authorized to the federal government by the Constitution. The Social Security trust fund, therefore, contains nothing more than IOUs. And, the only way that $4-trillion will ever be replaced is by tax increases. This, of course, is legally called gross misappropriation of funds and would get the leaders of Anybusiness USA some significant prison time if they did such a thing with retirement funds. However, Congress was controlled by the Democratic Party all those years and they are above any laws. Apparently, they are above common sense and fiscal responsibility, too. According to Daniel J. Mitchell at The Heritage Foundation's Institute for Economic Policy Studies: "the best possible interpretation of the Trust Fund is that the IOUs are a measure of how much taxes will have to be raised in the future."(1) That would be about $4-trillion above what they are now. Because, those useless, nonnegotiable bonds they say make up the Social Security trust fund are not real economic assets. Rather, they are claims on the Treasury that will have to be financed by either raising taxes, borrowing from the public, or reducing benefits or other expenditures. They are exactly the same as someone borrowing from one credit card to pay off another. As even the Clinton administration's fiscal 2000 budget admits: "The existence of large trust fund balances, therefore, does not, by itself, have any impact on the government's ability to pay benefits." That's because there are only IOUs in there. Congress spent all money in every trust fund, including the Social Security trust fund. Meanwhile, we will replace the money through higher taxes. Or, our grandkids will. Which means, the American people are to be taxed twice for exactly the same fund. Everyone in Washington knows this is true, too. The Democratic Party's Senate Majority leader even admitted it in a weak moment. In a speech, Senator Tom Daschle gave his usual Washington double-talk about the trust fund: "Right now we are using Social Security trust funds to pay for other spending in the federal budget, and that to me ... isn't what we should be doing. That money should be held in trust."(2) They have been doing it for over 50 years, though. It wasn't until the Republicans took over Congress that there was even a suggestion to stop stealing that money. After the talk, Senator Tom Daschle actually admitted to columnist Robert Novak, "there is no such fund per se." And so there is not. Much of the Social Security payroll tax workers and employers pay today goes to pay for other programs. That money will need to be replaced in a few years, which means there will be a significant tax increase somewhere along the line. Republicans are "looking into the problem." But, as long as the Social Security trust fund is available to Congress, it appears they will spend it. When we look at the Democratic Party we see the sleaze of Clinton, Condid, Barney Frank, Kennedy, Dodd, and a couple dozen other sexual perverts in Washington. But, like they said, "it's only sex." Perhaps we must accept their personal perversions and look into their clear abuse of power and the fact that we will, eventually, need to be taxed twice to fund the same amount of Social Security simply because they misappropriated the funds. 1. http://www.heritage.org/library/backgrounder/bg1256es.html 2. http://www.self-gov.org/good/a0039.html ~ End ~ -- RKBA! ***** Blessings On Thee, Oh Israel! ***** RKBA! ----------------+----------+--------------------------+--------------------- An _EFFECTIVE_ | Insured | All matter is vibration. | Let he who hath no weapon in every | by COLT; | -- Max Plank | weapon sell his hand = Freedom | DIAL | In the beginning was the | garment and buy a on every side! | 1911-A1. | word. -- The Bible | sword.--Jesus Christ ----------------+----------+--------------------------+--------------------- Constitutional Government is dead, LONG LIVE THE CONSTITUTION!!!!! - ------------------------------------------------------------------------------- From: Bill Vance Subject: New Policy on Firearm Background Checks (fwd) Date: 04 Aug 2001 22:29:04 -0700 In a message dated 8/4/01 12:52:37 PM Eastern Daylight Time, hirider@wt.net writes: > Please excuse if this is a duplicate, but it's important, IMO-- > > Carolyn > > > Important: Please send your comments to Attorney General Ashcroft. > Contact info is at the bottom of the page. > > New Policy on Firearm Background Checks > United States Attorney General John Ashcroft is seeking public > comment > on a > new policy involving firearm background checks. (fwd) Date: 05 Aug 2001 13:52:24 -0700 But will the sheeple, the dumbed-down-by-the-public-fool-system masses, ever realize this? I THINK NOT! Bob Socialism Is Not The Cure by Rob Moody Socialism, like the ancient ideas from which it springs, confuses the distinction between government and society. As a result of this, every time we object to a thing being done by government, the socialists conclude that we object to its being done at all. ~ Frederic Bastiat Last fall, I heard at least one politician criticize his opponent for voting against federal funding for breast cancer research. "This unenlightened boob [pun intended] voted against funding for breast cancer research! He must want women to die!" The implication is that unless the federal government funds the research, it won't be done. After all, who would have a financial incentive to find a cure for cancer? My neighborhood recently held an auction, the proceeds from which went to the Avon Breast Cancer Crusade. Similar fundraisers are held all the time. The local news often covers walks or runs that benefit research for a specific disease or disorder. Sometimes someone will even send me a letter asking me to sponsor her in a walk or run. Additionally, the country is currently debating whether the federal government should fund stem cell research. I have yet to hear anyone argue that such research would be best left to the private sector, assuming that it did not involve the taking of a human life. Fundraisers continue to be held (which makes the participants feel good about themselves) and money continues to flow from the federal government (which makes the politicians look good). Yet after a number of decades and billions of dollars, we still don't have a cure for many diseases. This approach of providing donations or federal funding to researchers who do not work for a private company is a huge waste of time and treasure, and doomed to failure. All you have to do is look at the financial incentives these people have. If the federal government hired you to help find a cure for cancer, paid you $100,000 a year and provided you with a nice office in an air conditioned building, what would your incentives be? If you worked long and hard and eventually found a cure for cancer, you might be rewarded for it by losing your job. As long as you didn't find a cure, you could continue to earn a nice living while proudly telling your family and friends that you were "looking for a cure for cancer." The primary goal of every bureaucrat is to keep his or her job by ensuring that the funding for it continues to flow from the government. If that means taking your time to find a cure for cancer, so be it. If we were really serious about results instead of our own self-esteem or the popularity of politicians, we would get the government out of the medical research business and let the private sector work its magic. Government research tends to crowd out private research by reducing the odds that a significant discovery will be made. Additionally, after the federal government basically forced a private company to share its map of the human genome, there is now much greater uncertainty about how much a company would be able to benefit after investing years and millions of dollars in research and development. Why go to all of that trouble and expense if the federal government is going to be waiting for you at the end of the process with a deal that you literally can't refuse? Certainly medical research should receive funding. The question is, which research should receive how much funding, and from whom? In a free market, entrepreneurs and investors decide these questions. Since their own time and money is at risk, they carefully determine which research is most likely to produce results, and which research would provide the most benefit to the greatest number of consumers (i.e., which research would be the most profitable). If they fail, only they are held responsible. In a planned economy, politicians and bureaucrats decide which research receives how much of the loot that has been confiscated from others. The primary consideration is whether it will make incumbent politicians look good and help them get reelected. If a cure isn't found, that's even better, because then the politicians will have a permanent constituency of researchers and their families who are dependent on them. In a planned economy, failure is prima-facie evidence of the need for even greater funding instead of an incontrovertible signal to pull the plug on the whole operation. No amount of federal funding is ever going to find a cure for anything. If you want to promote medical research, here are some things you can do. First, stop electing politicians who vote to provide government funds for medical research. Second, start a medical research company or start working for one. Third, buy shares in medical research companies when they go public, or buy their bonds when they issue debt. Finally, start or contribute to a fund that will award a monetary prize to the people who find a cure for a particular disease or disorder. Socialism is what ails us; it's not the cure for anything. -- RKBA! - ------------------------------------------------------------------------------- From: Bill Vance Subject: Glad To Post It Again, Bill...... The US Constitution is the supreme law of the land, and any statute, to be valid, must be in agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows: The general rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of its enactment, and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted. Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it ... A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby. No one is bound to obey an unconstitutional law and no courts are bound to enforce it. The patrol officers back off and establis= h a=20 perimeter, waiting for the specialists, the men in the black ninja suits.= =20 That was the scene in Lubbock, Texas on a sweltering July=20 morning. Richard Robinson, an unemployed mechanic, had been out of work s= ince=20 the state had taken his car and body shop through an act of eminent domai= n,=20 paying him a year's salary, $45,000. Robinson and his wife Laura had argu= ed=20 the previous day about his unemployment and the police were called. Robinson did not respond to negotiators' attempts at contact=20 until 12:30 p.m. When he was contacted, Robinson was "distressed and=20 emotionally volatile," according to police spokesman Bill Morgan. Let Lubbock take the lead and = get=20 rid of the fully automatic weapons, armored personnel carriers and flamma= ble=20 CS gas. As a Jew, naturally, I'm not sympathetic to Nazism given Hitler's Holocaust against the Jews. Members of my grandparents family were liquidated by the Nazi's. Nazism and Fascism are referred to as "right-wing," yet, in this country, the label is applied to libertarians, conserva- tives, and even, in certain circumstances, to liberals. How could the majority of Americans who generally advocate limited government, self rule, liberty, sovereignty, private property, religion, a moral code etc...be lumped in with Fascists who advocate the exact opposite? After all, last I checked, Hitler wasn't exactly known for his respect of private property ownership. My relatives could've attested to that had they survived. Neither was Mussolini famous as an advocate of limited government. How could it be then, that libertarian/conservatives such as myself are spoken of in the same breath as those who advocate the exact opposite of everything we believe in? The answer can be found in the way the left deals with opposition. Anyone who opposes a left-wing agenda, however it is defined at a given time, risks being placed into the "right wing" bin. To the left, the term right-wing applies to anyone who is not left-wing. This has even included devout Marxists who may have deviated from the party line. Marx himself invented the term "capitalism" as a derisive reference to the emerging free market of the nineteenth century. His attempt at defamation was turned into a badge of honor. The term capitalist today is synonymous with freedom. The same should apply, in the US, to the term right-wing. The American Revolution was a war against a right-wing British monarch who was imposing absolute tyranny over his colonies. The colonists rejected his European conception of hereditary aristocracy, the divine right of kings, a state church, and a mercantilist economic system where charters are granted to monopolies. Jeffersonian libertarianism called for an aristocracy of ability, a government serving citizens under a Constitution, freedom of religious expres- sion, and free enterprise. American's were never right-wing by the classic definition of the term. The European right and left were two types of tyranny. The right used the church as a tool of authority while the left used atheism in the same manner. The right gravitated toward a hereditary aristocracy while the left looked to a "dictatorship of the proletariat" under a "hero of the people" such as Stalin. The right viewed property as a servant of the state while the left sought outright control over property for "the common good." The right was hyper nationalist while the left practiced world conquest through "struggle" and subversion. The right sought earthly utopia through racial and ethnic purity while the left sought the same through the elimination of economic class and those who refused to conform to political correctness. Both systems, to the degree they were enthroned, led to holocausts, forced starvations, and, in the case of the left, the murder of hundreds of millions of people worldwide. European right-wing conceptions never took root in the US to any significant degree. Nazi's, Klansmen, Aryan Na- tion, and Christian Identity, for examples, are on the fringe of American life. Concepts of theocracy and ethnic purity generally don't resonate. American ideas of progress have been to move away from such primitive socialistic conceptions. Of course, the left has gone to great lengths to exaggerate the influence of the European right here while falsely tarring the American right, which is most of us, with the European right-wing brush. European left-wing conceptions, on the other hand, have taken deep root in the US, primarily among the leisure class. The left has developed a homegrown movement connected philosophically and in some cases literally with it's Euro- pean counterpart. They have obtained enormous influence in areas such as the academe, the media, foundations, business, entertainment, and government itself. The deeply entrenched left today represents the vanguard of a European style authoritarian movement. They seek to erode religion, the family, private property, and privacy in general, replacing these with the authority of the state in an attempt to undo the spirit of the American Revolution. The American right, as opposed to the European right, opposes authoritarianism in favor of small government, liberty, and the free market. I'm proud to be right-wing if this means an insistence that the government operate strict- ly under the Constitution. I'm proud to be right-wing if this means espousing moral values, individual responsibili- ty, the family, God, and basic patriotism. Given the domi- nance of the left today, these positions are now considered to be extreme. That would make me a right-wing extremist. http://www.sierratimes.com/archive/morse/2001/feb/edcm021501.htm -- RKBA! - ------------------------------------------------------------------------------- From: Bill Vance Subject: Klamath Falls A Call to Arms by JJ. Even though this war is not being fought with bullets, there are casualties, and there will be more. The logistical operation being set in motion at this time will follows the rules of any battlefield condition. This is a test, America. The results from this phase of the battle in Klamath Falls may determine the future destiny of the Western Lands of North America and its people. The mission is clear: To provide logistical support for over 1400 encampments in a place called Klamath. There, thousands of our compatriots, battle-tested, have been involved in a struggle for their lives since April 6, 2001. They are the ones in the trenches (irrigation canals) Our goal is theirs: to resume the regular flow of irrigation water and bring life back to these farms - in the face of an enemy at the gates. Let the Convoy Roll... There are convoys preparing to depart from several states in the West. Our test will be to see if we can resupply these 'troops' for the autumn and winter campaigns against this enemy. If we are successful, our brethren on the battlefield will not be forced to abandon their camps. We are doing this not just to bring attention to the situation, but to feed, clothe and defend those who have led the fight, and have suffered greatly because of it. Let it be known that we did not start this war, but having no choice but to wage it, let us wage it well. The forces against us claim they are trying to save fish. We are trying to save humans. In our minds, the most threatened species in the Klamath Basin is man himself. This may become one of the greatest rescue and resupply operations ever - and more important than the Historic Berlin Airlift. Let the Convoy Roll... We don't take suckers here. These dedicated warriors now loading up their gear to resupply our side of the battle lines take their own risks. Many of them leave their families and local battles at home to join what could be (if successful) a battle which will be the turning point of this war. Accidents can happen on the road. Things back home are left unattended. No one is paying them to do this. No one is ordering them to do this. These dedicated warriors are answering the call to arms. With the command and control center of this operation at the Head Gates in Klamath, those in charge pledge to deliver the supplies to where they are needed most in the Klamath Battlefield. They too stand ready for the war. If you are concerned about the ranchers and farmers in this area, and are willing to help, then you too are a warrior and welcome to join us. There will be no medals handed out, no service pay, no rank given. But victory in the battle will reap rewards unimaginable. Failure in the mission means our compatriots in the battlefield may be forced to sell their land. Most have made the statement: NOT FOR SALE AT ANY PRICE. They need help to make that stand. Let the Convoy Roll... Our enemy at the gates is more than just a few federal agents encamped there. It is the apathy in many hearts around the nation, and those who simply disagree. For too long we have lobbied government for a solution to a problem they created. America: We have to solve this problem. We have to fight this battle. We must win this battle. As I write, those wishing to do away with the human element are petitioning the court to stop the water flow. Without a solid defense, they will succeed. We must allow those fighting on the front lines to hold that line until the waters flow freely. This can only be done with your help. We cannot even expect this call to arms to be carried by the regular media channels. We must pass the word to our friend and neighbors ourselves. I believe we can do it. I believe we can succeed. I have faith we will be victorious. Do you believe? Any donation, no matter how small, can help. Convoys may be rolling through your town en route to the battle. These are the supply lines for the Great Western Battle - the war to determine who will own the land; who will feed our fellow Americans in the future, and if American can stand on its own two feet. We must supply these troops in the field with goods and supplies now, else future generations may be force to supply more than that to troops in the field. Let the Convoy Roll... As we pray it does not come to this, we must take steps for this long term engagement. Both sides have entrenched themselves for the long fight. Our enemy uses our tax dollars, junk science, and bad law as their weapons. We must fight back with compassion and resolve in our hearts - and we must do so for the long term. This is not a new kind of war with new rules - just different rules of engagement. Posted at the Klamath Head Gates now is a cross in memory of those brave firefighters who died in Washington because they could not have the water they needed to do their jobs. All this because of the rules of engagement of our opposition. Remember them when you see the convoys roll by. We're doing this for them, and to prevent such tragedies from happening in the future. Think of the child whose school will close in the Klamath Basin. The veteran who can't pay the mortgage without water, the dying eagles in the refuge, the thousands of proud Americans forced to cry out for help. Let us not let their voices go unheard. This is War: Let us meet this challenge like the Real Americans we are. Let that Convoy Roll... This may be our one chance to let the world know that, once again, a sleeping giant has been awakened. There is at least one person wishing a thousand people could be there on August 21. There are thousands hoping at least one more person can attend. That difference is you, American. To our brethren in the Klamath Basin: You shall not stand alone. You pain is our pain. We are affected by the same bad laws and policies. Your fight is our fight. You have fought the battle bravely, and help is on the way. If that convoy comes through your town, meet and greet that convoy, giving whatever you can. If it's not coming through your town, then go find that convoy or start one of your own. Climb on board. Join up with the others. These people are not just going to a rally - they are going to war - right here on American soil. Our goal is to prove, to Washington D.C. and the world, that we are NOT FOR SALE AT ANY PRICE. We are God's people - and as God people we must stand on our own two feet. ...and crawl before no one. Let That Convoy Roll. J.J. Johnson Previous Articles Going Corporate? (fwd) Date: 11 Aug 2001 00:03:03 -0700 Springfield News State takes newborn from mom Wednesday, August 8, 2001 By ROSS GRANT He was laying on my stomach, taking a pacifier. They said they were going to check his vitals and they took him.Diana M. Ross WARE Two months after a rottweiler killed her 5-year-old son while under foster care, Diana M. Ross has lost her third child to the state, just a day after he was born. Ross, 27, of Ware gave birth to 7-pound, 4-ounce Aaron Anthony Ross Sunday at 7:30 a.m. By Monday afternoon after someone complained that Ross was mistreating the newborn police arrived at Mary Lane Hospital in Ware with a court order to take him away. Social workers placed the infant with a new family immediately. "He was laying on my stomach, taking a pacifier. They said they were going to check his vitals and they took him," Ross said yesterday. "I'm barely getting any sleep. I get too upset." Ross was told that she hadn't been feeding her baby properly, and that he was going to live in a foster home with his 3-year-old brother, Damien, she said. Ross will have to wait until tomorrow to argue for the return of her child in Hampshire County Juvenile Court. The state took the newborn after a "credible source" filed a report saying the child was at risk of being abused or neglected, said Carol A. Yelverton, public affairs director for the Massachusetts Department of Social Services. Department workers brought the complaint to juvenile court, which instructed them to take the child from his mother. "We feel for her. This is a terrible situation for her and we understand that. But we are mandated to take care of the safety of children," Yelverton said. Taking a newborn child away from his mother is "very uncommon" for the department, she said. Still, in this case, Yelverton said it was justified. "It was a court order. The DSS has done its job. We have ensured the safety of a child when there were concerns raised about his safety," she said. But Ross and her high-profile Springfield lawyer, Alan R. Goodman, question the timing of the state's action. How could a mother mistreat her 1-day-old child in the protective environment of a hospital? they asked. Rather than the safety of the newborn, they think the move is the state's reaction to Ross' intention to sue it for the wrongful death of her 5-year-old child while in foster care. "This child was pulled from the loving arms of his mother," Goodman said yesterday. "This appears to be a retaliation by the state." Kyle Anthony Ross was mauled to death by a rottweiler on June 9, while under the care of his Springfield foster mother, Linda McNeil of 25 Redden St. The dog was later put to sleep. The Hampden County district attorney's office refused comment yesterday on whether any criminal charges will be filed in connection with the rottweiler attack, except to say the incident is still under investigation. But Yelverton said there is no connection between Kyle's death and the state's action this week. "We have had concerns about Ms. Ross' abilities to parent her children safely. No matter what happened in June no matter how tragic that was we have a responsibility to respond to a report if we get one," Yelverton said. "This is very serious stuff. These are not arbitrary questions. The court has to show that someone is not fit to take care of children," she said. -- RKBA! - ------------------------------------------------------------------------------- From: Bill Vance Subject: VIN: Public school industry (fwd) Date: 11 Aug 2001 12:15:11 -0700 FROM MOUNTAIN MEDIA THE LIBERTARIAN, By Vin Suprynowicz They can never meet the 'demand' for free sandwiches There's been much piteous mewling of late about an ongoing "teacher shortage" in the government schools. Additionally, the collectivists moan we're not doing enough to "meet the demand" for new youth propaganda camps, or for "homeless facilities," either. These statements are nearly devoid of discernible meaning. However, it is apparently no longer safe to merely ignore them, since some guy who earned a doctorate in education by writing a slim report on the benefits of air conditioning (many know him as Nevada Gov. Kenny Guinn) now actually proposes to squeeze more money from the productive classes in order to meet these "needs" and "demands." What's going on here is that words which have real use in analyzing a private economy are being borrowed and inappropriately applied to collectivist looting schemes. What is the "demand" for Jaguar motor cars in the Vegas Valley? Bob Kane tells me they move about 350 new cars per year out of Gaudin Jaguar-Porsche. And "No, we don't have much trouble meeting demand; there's no waiting list." So only 350 people in a valley of millions would like a new Jaguar? Not quite. They start at $30,000, see, and can cost as much as $85,000 if you want one of the fancy convertibles. Still a good buy for all that British hand fitting and finishing, in my book. But clearly a lot of folks decide to spend less on a car -- or to invest in something more suitable for hauling hay bales through the mesquite -- leaving local Jaguar "supply and demand" pretty much in balance. But let us suppose that some politician took it into his head that it was a travesty for so many of his worthy constituents to do without Jaguars, instead hauling around their precious children -- our nation's future! -- in flimsy Japanese sheet-metal jalopies. Emergency legislation would be enacted, requiring Mr. Kane and company to give out free Jaguars to anyone who wants one. When both the dealership and eventually the parent company went belly-up trying to meet this "demand," the government would simply nationalize Jaguar U.S.A. and put government bureaucrats in charge of handing out the free cars. What would Jaguar "demand" look like, then? To meet this "demand," quality would quickly be cut -- the new government managers would start welding Jaguar hood ornaments onto any sheet-metal contraption they could manage to throw together. "You dare complain about the quality of your new, government -issued 'Jaguar?' Don't you understand the problems we face?" the superintendent of the County Jaguar Distribution District would whine. "We can't get enough quality raw material; we're having to train non-English- speaking workers straight out of the celery fields ... Besides, if you don't like it, you can always go spend your own money on a private-sector car." "Gee, not many of those old for-profit dealers left around any more, now that you guys are giving away stuff for free." "Aha. Not much 'demand' for what they offer, is there?" Government can similarly never meet the "demand" for free food and beds for the shiftless winos we're now instructed to call "the homeless." Spot 12 hungry hoboes downtown this week and set up a table to give away 12 free sandwiches for lunch. Tomorrow 50 people will line up for your free sandwiches, and by next week 500, including courthouse secretaries in high heels. Start applying a "means test" to limit your expenditures and you'll only end up servicing a new class of skilled government form-filler-outers, while the 12 hoboes you started out trying to help will end up washing down Ring Dings with Old English 800 back under the overpass -- with no fixed address and no writing skills, they can neither fill out nor satisfy the requirements of your new "free food" forms, see. It's the same with the "demand" for free welfare schooling. No one seems to know what it really costs to run a child through 12 years of government day care, any more, what with the expenditures scattered around in so many budgets. Let's conservatively call it $6,000. Want to eliminate the "teacher shortage" overnight? Just start billing the parents that $6,000. (Heck, make it $6,700, admitting 10 percent of each class on full scholarships for poor kids who can do best on competitive entrance exams.) Competing private schools charging less for more would spring up like mushrooms, rescuing an entire generation from the clutches of the current "reproductive organs of the welfare state." With a new emphasis on "getting what you pay for," they'd probably pay higher salaries for the best teachers , driving up average teacher pay while attracting many new recruits from among folks who actually majored in something other than "Education" -- while two thirds of the unemployables currently holding down such jobs could be fitted for new uniforms at Wendy's. (Remember, de Tocqueville found this "the most literate nation on earth" in the 1830s -- 20 years before Horace Mann & Co. opened the first tax-funded "public school" on the Prussian model, in Massachusetts.) The union seeks to increase average teacher pay while solving the current "teacher shortage"? Be careful what you wish for. Ponder http://www.friendsofliberty.com/shondaponder/shondaponder080601.htm The Death Penalty seems to be gaining a lot of attention these days from those who would like to see it removed from our society. Let me ask you...is death worth the consequence of a life taken? On Tuesday, August 7 at 2:30pm at the old courthouse at 111 Main St. in Hickory, Ted Cummings, one of the trial attorneys for Ronald Frye, and Robert Null, one of the jurors in Frye's trial, will talk about their concerns with the scheduled execution of Mr. Frye. Mr. Frye is scheduled to be executed on August 31st for the murder of his landlord. Serious concerns have recently been raised about the trial of Mr. Frye and the quality of defense he received. During the penalty phase of the trial, the jury was never told about Mr. Frye's past which would help explain his actions. Members of the jury have signed sworn affidavits saying they would have voted for life in prison rather than the death penalty, had they known about Mr. Frye's troubled past - which includes his mother's turning him over to strangers when he was four, and being beaten so badly that pictures of the wounds have been used in North Carolina police training on child abuse. If you are a Christian, you will note that in the Bible's old testament there were many crimes that are punishable by death. Including adultery and fornication. God wanted his people to be a pure people at any cost. And, at the time, it was necessary for His work to be done the way He wanted it to be done. In the New Testament, Jesus forgave an adulteress, knowing what her sins were, and that she was guilty of the crime in which the scribes and Pharisees had accused her. He told her to go and sin no more. Not to go and take the opportunity to sin more. However, in so doing, he did exactly what he set out to do: turn mother against daughter, father against son, and brother against sister. The forgiving society that Jesus would have had has given way to a society where slaps on the hand are acceptable punishment. "They know they did wrong because I told them so. So now that they know, leave them alone." Somehow, I don't think this is what Jesus had in mind. So let me attempt to straighten some people out here: Jesus forgave the woman because he COULD. He is God. He had the authority. And, she did exactly what He anticipated that she would do, and served Him from that day forward. He didn't do it to show us an example of how to live, he did it to show the scribes and the pharisees that they did not have the authoritative conscience inside them to be in the offices that they held. Don't tell your brother about the moat in his eyes until you get the one in your own out. Only when you can own up and pay for the sins that you yourself have committed, have you any right whatsoever to condemn someone else. Our government is full of murderers today...is it any wonder that they would wish to do away with the death penalty? When a wrong has been committed there are ways in which you are supposed to react. It has been laid out in the Bible in both the old and the New Testament. The first step is to take your complaint to your brother in private. If the complaint has not been settled in private there, you take it to your brother in the face of two or three witnesses who are called to try to mediate between the two of you before any harm is done to either of you. If, in the face of two or three witnesses the dispute or complaint cannot be handled, there is only one place left to go--court. A righteous judge has the power to oversee any sentence that is placed on the criminal. Most of the people in a jury trial setting have never committed cold-blooded murder or raped a four year old. I don't care what their past is like. A normal human being learns from other's mistakes, and from the past. My parents spanked me when I was a child. Sometimes they went overboard. This has not caused me to murder anyone. If anything, it has caused me to not spank my children unless they understood perfectly what they were getting the spanking for to begin with. And, many times, I find that spanking isn't necessary when they show remorse for the wrongdoing--rather than the fact that they are going to get the punishment for doing it. The death penalty is reserved, today, for those who have no regard whatsoever to any life whatsoever, other than his own--for whatever reason. If my son were raped and killed by a man who had a really horrible childhood, do you think I would care whether he was beaten as a child or not? I dare say, if my son were Mr. Frye's landlord, and he were murdered, the punishment should equal the crime. The crime was the murder of someone's son. Mr. Frye, therefore, should die regardless of what his childhood was like. ======= Don't forget to check out our messageboard at http://www.friendsofliberty.com/messageboard/intro.htm Want to submit your article or news? http://www.friendsofliberty.com/submit/arsubmit.htm Got an editorial you'd like to see posted? http://www.friendsofliberty.com/submit/oesubmit.htm Want to make a complaint about a product or service at fli? http://www.friendsofliberty.com/submit/complain.htm Want to submit your press release? http://www.friendsofliberty.com/submit/prsubmit.htm Need to gripe or inquire at the FLI webmasters? http://www.friendsofliberty.com/submit/webmaster.htm Show Your Spirit, America! http://www.friendsofliberty.com/affiliates/flagline.htm ============================================================ Get FREE business cards for your business or personal use! James Love, writing in News Viewz, reports that the just-concluded conference at the Hague in the Netherlands would impose "a bold set of rules that will profoundly change the internet" and "extend the reach of every coun- try's intellectual property laws," including those that are not related to the Internet. Last December, NewsMax.com reported on efforts within the U.S. government to make Web sites responsible for everything said by the other sites to which they provide links. In other words, if a nonprofit Web site provides links to a partisan political site, the nonprofit would lose its tax-exempt status because that would count as a campaign contribution. This is widely feared to be a leftist reac- tion to the Internet's ability to get around the mainstream media and expose the public to the other side of issues. That would apply even to those sites that provide links to both the Republican and Democrat parties. It would put a lot of sites out of business or constrain their ability to reference other sources. A similar concept envisioned on an international scale by the Hague convention could "effectively strip Internet service providers of protection from litigation over the content they carry." As Love puts it, the new international treaty, if it takes effect, "will strangle the Internet with a suffocating blanket of overlapping jurisdictional claims, expose every web page publisher to liabilities for libel, defamation and every other speech offense from virtually any country." Membership in the Hague Conference now includes China and Egypt. One can hardly imagine an American Web site relishing being held to the "speech standards" prevailing in places where repressive civil actions that crush dissent are commonplace. But the European delegates would not even consider adding favorable speech language. In answer to an inquiry from NewsMax.com, Love said that "every country can refuse to enforce a judgment if a judge finds that to do so would be manifestly incompatible with public policy, a fairly high standard, but not impossi- bly high." Those who have observed the antics of some of the more activist judges in this country can imagine some sig- nificant lines being crossed and precedents being set. Love also told NewsMax that under the Hague convention, "nations agree to enforce each other's judgments, if they follow a common set of rules regarding jurisdiction. In terms of the Internet and speech, just about everyone gets jurisdiction, which causes all sorts of problems." One of those "problems" is that the treaty would give "businesses who sell goods and services the right to dictate via con- tracts countries where disputes will be resolved and rights defended." What caused all this activity to muzzle the Internet? Get this: "European negotiators were also unhappy with the gener- ally free and unruly nature of the Internet, and saw the convention as a mechanism to reign in hate speech." To some, that raises a red flag and sounds eerily similar to frequent leftist rhetoric in the United States. Who defines "hate speech"? Is it defined by the prevailing ultra-left tone on many of America's campuses where professors lose their positions and students are suspended or refused graduation for speaking against politically correct orthodoxy? The News Viewz paper adds: "Europe was also alarmed and jealous of the U.S. leadership in the development of the Internet. European negotiators pushed hard to impose a treaty based on the European Union's Brussels Convention, not only to preserve the European approach, but to lead, for once, in an important area for the Internet." Presumably, there will come a time when the president will be asked to submit this treaty to the U.S. Senate for ratification. Look for another controversy over yet another document which, according to the report cited above, would "diminish national sovereignty http://www.newsmax.com/archives/articles/2001/6/26/205952.shtml -- RKBA! - ------------------------------------------------------------------------------- From: Bill Vance Subject: VIN -- ignoring the tax riots (fwd) Date: 13 Aug 2001 23:34:28 -0700 FROM MOUNTAIN MEDIA THE LIBERTARIAN, By Vin Suprynowicz The natives are restless "As key Democrats and Republicans huddled behind closed doors trying to break an impasse over a proposed new Tennessee income tax, 2,000 protesters rushed up the Capitol steps, screaming, 'No means no!' and smashing a few windows," the Los Angeles Times reported from Nashville in mid-July. "It was a bona fide tax revolt, and it worked. ... The tax-thwarting protest was the handiwork of two talk show hosts who took to the airwaves and put out an urgent S.O.S. ..." Next, coming on the heels of the successful Tennessee revolt, "Taxpayers in Tennessee's parent state of North Carolina held their own protest ... during which they tossed teabags at legislators and gained the upper hand on Democratic lawmakers who are pushing for a dramatic tax hike," wrote Andrew Cline, managing editor of the Carolina Journal, last week for the National Review online (www.nationalreview.com/comment/comment-cline080301.shtml.) "They just keep raising taxes," Cline quoted one protester, as "About 1,000 North Carolina taxpayers rallied behind the state legislative building on Tuesday for a 'Tar Heel Tea Party' in hopes of halting in its tracks a nearly $600 million tax increase proposed by the Democrats who control both houses of the state legislature and the governor's mansion. ..." Is something happening here? And if so, why is the news so well hidden by much of America's print media? "If this was a groundswell around the nation to have bottle bills, it would be the cover of Time magazine, 'Bottle Bill Mania Sweeps the Country,' comments Grover Norquist of the Washington-based think tank Americans for Tax Reform. Print coverage may have been less thorough than broadcast coverage of these events for three reasons, surmise Mr. Norquist and John Hood, of North Carolina's John Locke Foundation, which helped promote the North Carolina event. First, the events are happening far from Washington, D.C., from which many of the nation's news desks now operate. It's easier for the cable TV networks to pick up colorful footage of protesters dressed as grim reapers or colonial Minutemen and beam them around the country in minutes than for deskbound editors to dispatch reporters to seldom-visited locales like Nashville and Raleigh during the understaffed summer. Second, the more hidebound media outlets tend to be pro-government and pro-tax in their outlook -- there may be evidencing a subconscious reluctance to give credence to such groundswells. And last, these events are being promoted by talk radio hosts. Some in the print media are still reluctant to acknowledge the growing upscale audience of these radio stations in the cell phone era, and also still look down on them as unworthy competitors "leading the hunt for the black helicopters." But why are the protests happening in the first place? "In history class we learned about rising expectations," replies Mr. Norquist of ATR. "People revolt not when the French king is at his most Draconian, but when the French king is loosening up, liberalizing. Then people say, "Well, we want more of this," Similarly when we cut taxes we remind people that it's possible to cut taxes. ... Federal spending has fallen from 22 percent of GNP to 18 percent today, while the percentage of the nation's economic output being consumed state and local spending has grown from 9 to 12 percent over the past 20 years, Mr. Norquist notes. "So thanks to the victory in the Cold War, thanks to welfare reform, thanks to some restraint from the Republican Congress ... that's almost a 25 percent cut in the size of the federal government as a percentage of the economy. There has been no state that has done anything close to that level of reform. ..." "Six percent of the nation's GDP is spent on education, and private schools spend half what government schools do (per student.) So ... you could drop state and local spending by a quarter just by getting state government schools as cost-effective as private schools ... I think that people are coming to demand of state and local governments the reforms that they've seen in the past six years in Washington. ..." Norquist identifies Florida, Arizona, Colorado and Texas -- but not Nevada under Gov. Kenny Guinn, who he declines to identify as a fiscal innovator -- as states where Republican dominance in both statehouses and governors' mansions could soon bring that kind of cost-cutting to the local level. "Tax reform, tort reform, property rights -- it's Reagan and Gingrich brought down to the local level. After Reagan was elected it took 14 years to have Reaganism take over the House and Senate, and now that's finally being pushed down into the state level. ... "People are growing impatient, because they're not seeing those kinds of reform at the local level. So in those states that are refusing to reform, that are in fact moving in the wrong direction with new tax hikes like Tennessee and North Carolina, you're seeing riots." Successful riots. The findings of Montreal Neurological Institute researcher Freda Miller, first published Monday in the scientific journal "Nature Cell Biology" are generating "huge" interest in the scientific community, according to the Montreal Gazette -- though the American media has by and large ignored the miraculous breakthrough. "The dream scenario would be to take someone with spinal cord injuries, say an 18-year-old, take a biopsy from their skin and use that to treat the injury in the same patient," Miller told the Gazette, which noted that her discovery may even facilitate the regrowth of human organs. Before Miller's find, scientists believed that adult stem cell research would never be as productive as the embryonic variety, since adult stem cells are found only in the brain and bone marrow. "(Skin-derived stem cells were) just not on the radar screen in terms of the way any of us were thinking," Miller told the Gazette. "The idea of lots of stem cells in different tissue is a very, very new one. Can it be true that you could get a stem cell from one place and it would make another kind of cell? We didn't believe it ourselves." The medical implications of Miller's discovery are "enormous," the paper said, especially as they relate to the embryonic stem cell debate in the U.S. "Opinions vary but the prevailing view in North America seems to be that obtaining stem cells from human embryos, even to cure diseases, is considered immoral. The embryo is destroyed in the process." But Miller's research opens the door to a world of new, far less controversial possibilities. "We gave it two months," the Montreal scientist said of the research into skin-derived stem cells. "But it worked right from the beginning. Every step of the way it's been an 'I can't believe that it's true' experience." The McGill University research team found that its isolated cells began growing in grape clusters and duplicating "at an amazing speed" -- once every two or three days. What's more, the skin-based adult stem cells were able to produce different types of cells. "It was almost a hybrid or a more promiscuous version of those adult stem cells," Miller told the Gazette, adding, "It's very exciting." Still, despite the enormous scientific and medical potential of the McGill University discovery, more than a day after the Gazette report, the U.S. media continues to ignore the story. In its Tuesday edition, the New York Times, for instance, was still touting the wonders of embryonic stem cell research, with a front page story on the progress made in Britain. In the U.S., only the Washington Times and the Christian Broadcasting Network have covered Miller's findings. (fwd) Date: 18 Aug 2001 14:19:14 -0700 Writer says emigration imposing Hispanic culture on North America 2001 WorldNetDaily.com A prize-winning Mexican novelist says her country is reconquering territories in the United States with a massive army of uncontrolled emigration. "The common people - the poor, the dirty, the lice- ridden, the cockroaches - are advancing on the United States, a country that needs to speak Spanish because it has 33.5 million Hispanics who are imposing their culture," said Elena Poniatowska, author of "La Piel del Cielo," a new novel release last month in Caracas, Venezuela. She was quoted by the Venezuelan Spanish-language newspaper El Imparcial in a story translated by WorldNetDaily. The writer said the pessimistic vision held by the late Mexican author Octavio Paz that the Mexican is a "loser" is a relic of the past. "Mexico is recovering the territories yielded to the United States by means of migratory tactics," she said. "Perhaps Octavio Paz could not foresee this phenomenon. But it fills me full of joy, because Hispanics can have an ever- greater influence all the way from Patagonia to Alaska." She also talked about the boom in Indian rights as a result of the fight maintained for many years by the Zapatista Army of National Liberation. She said she doubted the formerly powerful ruling party - Partido Revolucionario Institucional, or PRI - would have allowed the recent Zapatista march from Chiapas to the capital. Last spring, new president, Vicente Fox, authorized the demonstration. Poniatowska was born in Paris in 1933 of Polish origin. She has lived in Mexico since she was 9 years old. Her novel won the prestigious Alfaguara de Novela 2001 Prize and has been released in 16 Latin American countries. The novelist added that she valued her experience as a journalist with the daily Excelsior in the 1950s. She has contributed articles to dozens of other Spanish-language newspapers and magazines and lectures widely in Mexico and elsewhere - including Oxford, Cambridge and Paris. She has taught at universities in Texas and Florida as well as at Harvard, Princeton, Yale, Cornell and the University of California. She is now affiliated with the political science department at Baylor University in Waco, Texas. -- RKBA! - ------------------------------------------------------------------------------- From: Bill Vance Subject: Fiedor Report on the News (fwd) Date: 18 Aug 2001 17:21:42 -0700 Fiedor Report on the News A Weekly View from the Foothills of Appalachia August 19, 2001 #241 by: Doug Fiedor dfiedor@home.com Previous Editions at: http://209.15.142.23/reports/headsup/list-hu.htm FEDERAL LAW HARMS CHILDREN While out and about I noticed that a new Chinese restaurant was right next to the vitamin store where I was stopping. My stomach was carrying on because breakfast had been many hours earlier. So, I chose Chinese for lunch. While waiting for my take-out, I happened to notice a young woman attempting to deposit what appeared to be twin rug-rats into the back of a Plymouth van. The temperature was in the middle 90s, the sun was bright, the little kids were obviously cranky, and the mother didn't seem to be in any better spirits. Who knows how hot it was inside that van when she opened that door -- like an oven, probably. Not having to haul little kids around for the last couple decades, I must admit that I didn't know the procedure involved. And it did seem, to me anyway, to be a long drawn out procedure. It certainly was while standing on the hot asphalt at one in the afternoon when both the temperature and humidity were in the middle nineties. Back when I did it, I would sit (or lay, depending) the kids on the front passenger seat, toss the stroller in back and away we would go. The preferred procedure would probably be to start the car and get the air conditioner running full blast before inserting little kids and/or, open a couple doors to let some of the heat out. Anyway, the young mother went through over 15 minutes of strapping those two little kids into little seats that looked like the tilting full-body holders that supported the astronauts of the 1970s during take off. The children were, of course, protesting. Never mind. They were strapped in anyway. Then, the woman had a problem collapsing the stroller. That done, she closed the side door of the van and walked around to the driver's side. I was inside the Chinese restaurant and so could not hear what was going on out there. But it was my impression that it was very loud in that van by that time. If that procedure had taken any longer, those kids would have started cooking. So, I got to thinking -- always dangerous -- why did something that would have taken me 15 to 20 seconds now take a parent a good 15 minutes? The answer, of course, is easy: The federal government became involved. The overreaching buttinskies in the federal regulatory bureaucracy learned that they made a grievous error in mandating air bags in all vehicles. Those air bags can easily kill small people and kids. But, of course, bureaucrats will never admit when they make stupid laws. So, the bureaucrats required children be protected by a wrap- around holder somewhat similar to those once used by astronauts. There is no Constitutional authority for the federal government to even comment on our automobiles, but whatever. They did it and we didn't tell them to shut up. Therefore, the whole situation is now extremely stupid. Because, the real true fact of this case is that these unconstitutional demands of government caused harm to that young mother and her two little children. Multiply this by a few thousand instances every day around the country -- and a situation nearly as bad on a cold winter day -- and the government's mandate of lashing children into half-cages for transport becomes more dangerous than anything that happened to previous generations of kids in the family cars. Being the oldest of nine kids who were never lashed down when we went for a ride in the old '46 Ford, and later the '49 DeSoto, I remember the fidgeting and horseplay along the way. But, as I also remember, we were all within reach for a quick correction, when necessary. There was a time, way back then, when kids liked to go for a ride with their parents. All that required was to get in the car, sit somewhat still and do nothing to alarm the driver. Government changed that into some sort of major procedure. There is nothing wrong with using whatever protection that might be available for the kids. However, there are times when common sense dictates that the law must take a back seat so the rug-rats do not get char- broiled before they get home. And that is exactly why any such mandatory procedures by the federal government should be repealed. Parents, not interfering Washington bureaucrats, are responsible for how their children are transported. PROTECTING A FLESH EATING BUG Most people don't realize it, but insects are the most successful life form on the planet. Some scientists estimate that there might be as many as 10 million different types of insects worldwide. Insects are divided up into 32 orders (depending on whose taxonomic system is used) of which the largest is the beetles. There are at least 125 different families of beetles, separated into around 500,000 different species. In fact, one in every four animals on this planet is a beetle. On land, there isn't anywhere you can go where you can't find some insects living -- even in the frozen extremes of the Arctic and Antarctica during summer. Insects also sometimes exist in surprisingly large and diverse populations. One scientist inventoried an acre of British pastureland near Cambridge and found it to be quite the buggy place. He estimated there were over 1,000,000,000 Arthropods, of which nearly 400,000,000 were insects and 666,000,000 were mites. The remaining 38,000,000 were myriapods (centipedes and millipedes). Scientists do not know how many different types of insects there are in the world, or even in the United States, for two very important reasons: First, there are two many varieties to catch one of each all at the same time. And second, in the time it would take to catch one of each and catalog them all, some would have died out as part of natural selection and others would have mutated into something slightly different. That has been going on for millions of years and man cannot retard it. Besides, the number of different types of insects -- 500,000 types of beetles alone -- vastly outnumbers the number of scientists willing to study them. Nevertheless, that does not mean that some ecowhacko groups won't try to "protect" one when they can only find a few in an area. In fact, that is exactly what is happening today. And now comes the saga of one such little bug whose days on this earth are understandably numbered: The American burying beetle (Nicrophorus americanus), is a member of the carrion beetle family Silphidae.(1) It is the largest carrion-frequenting insect in North America and may reach a length of l l/2 inches. Carrion beetles, as their name implies, are scavengers. They eat dead flesh. There are 570 species of silphids found worldwide, and 31 of them live in North America. Eighteen different species live in Nebraska alone. Today, the American burying beetle seems to be largely restricted to areas most undisturbed by human interference -- areas where the carcasses of small dead animals can be easily located. It is not proven that there are any other limiting factors for sustaining these beetles. Their specific habitat requirements are unknown and vegetation and soil type do not seem to matter. They want dead flesh to eat and lay eggs on and that is not usually plentiful in areas where humans live. However, because ecologists are not able to find very many of them, they have to blame it on something. So, the prevailing theory is that "the disappearance of the American burying beetle involves habitat fragmentation." Which means, the beetles need more open spaces where humans do not remove dead carcasses. Other human factors affecting the beetle "might" include: (1) artificial lighting that decreases populations of nocturnally active insects, (2) changing sources of carrion because of habitat alteration, (3) isolation of preferred habitat because of land use changes, and (4) increased edge effect harboring more vertebrate competitors for dead flesh. Can't have that. So, "the U.S. Fish and Wildlife Service, in cooperation with the scientific community, has formulated a recovery plan that is now being implemented. Surveys at several places in the eastern United States are being conducted to find remnant populations so they can be protected from land development authorized or funded by state and federal agencies. The search for remnant populations is now the primary activity in Nebraska. The populations in Rhode Island and Oklahoma are being monitored, and the habitats there are being managed to prevent any disruption that might be harmful." The beetles are being reintroduced in Massachusetts from a laboratory colony at Boston University, and other introductions are planned. These beetles will, of course, remain on the endangered list. So, wherever ecologists implant the colonies will understandably become protected areas. That's how it works with today's bureaucrats and ecowhackos. They resurrect a useless bug that should be extinct. Then, they move out the people. It's a control thing. Designed to control us humans. 1. http://www.ngpc.state.ne.us/wildlife/beetle.html MORE UNITED NATIONS NONSENSE The third world Neanderthals and associated socialists making up the United Nations Committee on the Elimination of Racial Discrimination have criticized the American people again. This time, they said the United States' record on racism is bad and demanded a halt to the death penalty and immediate moves to stamp out police brutality. The three page preliminary report was released last Monday. According to Reuters: "The body of 18 independent experts, who monitor how signatory countries comply with the Convention on the Elimination of All Forms of Racial Discrimination, noted 'a disturbing correlation between race, both of the victim and the defendant, and the imposition of the death penalty' in America. It called on the United States to ensure that no death penalty was imposed as a result of racial bias, 'perhaps by pronouncing a moratorium'."(1) According to the UN, about 54 percent of people currently on death row in the United States come from a minority background, but minorities make up just 20 percent of the population, so that's proof there must be some racial bias. These people, of course, have zero idea what they are talking about; yet they talk anyway. So, just for kicks, let's wander over to the U.S. Department of Justice Bureau of Justice Statistics(2) and take a cold, hard look at exactly who is being protected by "prosecution" of these minority perpetrators: Right up front we see that blacks were 6 times more likely than whites to be murdered in 1999 and 7 times more likely than whites to commit homicide. And, "black offenders are involved in a relatively large percentage of felony-murders (nearly six out of ten)." Would it be a good or a bad thing to protect the honest, law abiding residents of the black community against black perpetrators? Apparently, the UN takes the position that we should slap the wrists of black predators and let them back out to kill more black people. In 1999, there were 4,646 white on white homicides but only 820 black on white homicides. Yet, there were another 4,235 black on black homicides that year. In 1999, there were only 285 white on black homicides. Put yet another way, in 1999 the homicide rates per 100,000 population was 3.5 for whites, 25.6 for blacks and 3.9 for "others." Or, there were 7,938 white homicide offenders, 8,911 black and 538 "others." In all felony murder cases reported, 55.3% of the victims were white and 42.0% black. But, 39.3% of the felony murder perpetrators were white and 59.1% were black. So, what did we get out of all those numbers? One very important fact: There are nearly 5,000 black people killed annually in the United States by other black people. The black population in the United States is but a fraction of the white population, yet the number of black people killed annually is higher. This was never the case before the federal government interfered with their "Great Society" and welfare programs that decimated the black family structure in our cities. But, this is most definitely a major problem today. In Detroit, little children were shot dead from stray bullets while watching television in their own living rooms. Young punks killed just to get a car for joy riding. Two high school students shot two other students "just for something to do." The drug gangs had active contract killer squads. Often, stick-up artists would shoot the victim "just because." Some of these perpetrators were guilty of many shootings. Most of this violence was black on black. Should that make a difference? Shall we prosecute all malicious and premeditated violence to the fullest extent of the law or have different standards for different races? The United Nations Committee on the Elimination of Racial Discrimination is way out of line to even mention anything that happens in the United States with all the killing, slavery and oppression currently happening in other parts of the world. If they want to support human rights, they might look into all those Christians used as slave labor in communist China's prison camps. After they get results on that, they should start on the African women captured for sex slaves. 1. http://dailynews.yahoo.com/h/nm/20010814/ts/un_usa_racism_dc_2.html 2. http://www.ojp.usdoj.gov/bjs/homicide/race.htm ~ End ~ -- RKBA! - ------------------------------------------------------------------------------- From: Bill Vance Subject: Talkabout a NO-SPIN zone! (fwd) Date: 18 Aug 2001 23:23:32 -0700 Passed on by a friend ~~~ Hi there John Grabbed this off the web ~ the author is unknown but he sure covers it [Name elided to protect an innocent!] The Bill of Lefts (ideals sought by liberals) includes, but is not limited, to these certain inalienable principles: Education: Politicians have the right to send their children to private schools. Commoners do not. Since big government knows best how to teach our children, "school vouchers" should not be used to allow parents to use their own taxes to fund an education at non-government schools. It is reasonable for public school teachers to oppose "school vouchers" even while 40% of them send their own children to private schools. Prayer in school or the mention of God in school is bad. Having a homosexual teach your children about sex is good. The best school teacher, especially at the college level, is a person who has never held a job in a market economy. A teacher who sets the tone for his class by wearing a t-shirt, jeans, and sandals is entitled to expect his students to behave themselves perfectly. We honestly believe that the same sandal-and-t-shirt-clad public school teacher who can't teach 4th graders how to read is qualified to teach those same kids about sex. Self-esteem is more important than actually doing something to earn it. Certain minorities are entitled, even expected, to have poor language skills because it is a part of their ethnicity -- even when their families have been US citizens for many generations. These persons with poor language skills are entitled to special treatment in the educational system because the schools teach in English, not the individual's "native" language. It is desirable to have faith in unsubstantiated scientific theories and use religious principles in its practice while demanding the scientific methodology of religion. The fact that scientific theories change so fast that college text books of fifty years ago have no value in today's curricula only strengthens our faith in unsubstantiated scientific theories. Family: It is okay, even expected, to have sex before one is ready to have children or otherwise accept the responsibility consequent to having sex. Parents have no right to make decisions or even be informed regarding the sexual behavior of their minor children. Employees of government schools, being more enlightened than parents, may substitute their judgment for that of parents. Women have as much right to work as do men. If a mother chooses to work, it is reasonable for her to leave the rearing of her children to babysitters, even when her income is insufficient to pay the sitter. In this case, her neighbors are obligated to pay the sitter. Rights, Entitlements & Responsibility: Rights (which are God-given) are to be confused with privileges (which are earned). Therefore, we can say that everybody has a right to the same benefits and wealth gained by those who excel. All HIV carriers are innocent victims and must be given special "rights". Carriers of all other deadly contagious diseases are not "politically correct" and will be subject to quarantine. AIDS is spread by a lack of funding. Racism is not just for losers. Employers and college admissions committees must remember that bigotry is enlightened and honorable if discrimination is targeted at the "right" groups. Ability and initiative must never supercede ethnicity. Standardized tests are racist, but racial quotas and set-asides aren't. Quotas and set-asides are needed because we assume that certain groups of people just don't have the ability to make it on their own. Traditional gender roles are artificial but being gay is natural. Everyone who has been born has every right to live, including all convicted murderers. Persons who have not yet been born do not have a right to live. Trees can feel pain but babies can't. Therefore, saving the forests is critical and abortion is harmless. We have a right to expect all products to be safe. Therefore, if you stupidly misuse a product (ie a gun or even a cup of hot coffee) and thereby harm yourself or another person, you are a victim and are entitled to a multi-million dollar settlement. The rights of bugs, rats and weeds supercede the rights of humans. The successful must be burdened with heavy taxes for earning more money than those of us who have no initiative or talent. This makes us feel like things are fair. Deficits are a part of life, but that is only a problem for those with money. If the government gives you a credit card for health care or any other social program, use it as much as you want. Let somebody else pay the bill. Society & Welfare: We welcome all races, creeds, religions, ideologies, etc. as long as they are compatible with liberal thought. We must not tolerate any ideas which are not PC (politically correct = politically cleansed). We reject all thought which is based on traditional religion or which is based in classical morality. These outdated philosophies only hinder our "progressive" agenda. Everything is free as long as you don't work for it. Expect the government to take care of you. Therefore, you are best off not working at all. The best way to care for the unemployed and the poor is to simply give them more money rather than expect them to work for the money. This is an excellent way to buy votes for liberal political causes and candidates. Government should never take away anything it gives you. But it may take away anything you earn on your own. We can feel safe knowing that the government knows better how to spend our money than we do. Since members of the Hollywood elite demonstrate superior morality, wisdom, and judgment by their actions, solid family values, and worthwhile productions, we should respect and follow their endorsements of causes and of political candidates. The few actors and musicians who do take a stand for morality and in defense of Constitutional freedoms are kooks. Actors and musicians are inherently experts on morality, government, justice, the climate, and business. Their opinions carry greater weight than those of the real experts. The best journalist, especially on national TV news, is a person who has never held a job outside journalism. Journalists who are not US citizens have a right, even responsibility to pontificate on how US citizens choose to vote. Journalists are inherently experts on morality, government, justice, technology, business, military strategy, the climate, weather, and sports. Their opinions carry greater weight than those of the real experts. We believe that trial lawyers are selfless heroes and that doctors are overpaid. After all, trial lawyers contribute heavily to liberal causes, so they must be good guys. The death penalty is unfair to criminals. It does not deter crime. However, gun control laws do deter crime. After all, no criminal would even think of using a gun to commit a violent crime -- he might get in trouble! Only high-ranking politicians, TV talk show hosts, and criminals are entitled to the protection of a firearm. All law-abiding citizens must give or sell (at a large discount) all firearms to the government. The government, after all, is the only rightful owner of firearms and must maintain absolute control of all firearms (except those used for the protection of high-ranking politicians, TV talk show hosts, and criminals). We are not satisfied with the countless substantial and oppressive gun control laws imposed on law-abiding citizens since 1934. We want to add additional "reasonable" gun control laws, knowing full well that they will have no effect on crime, but they'll make us feel good. The NRA is bad, because its members stand up for certain parts of the Constitution. The ACLU is good, because it stands up for certain parts of the Constitution. There was no art before federal funding. Talentless people who call themselves artists must be supported by the government because nobody will buy his garbage. Government officials who refuse to use taxpayer money to support talentless artists and writers are guilty of censorship. The free market that gives us 500+ channels, can't deliver the quality that PBS does. Therefore, PBS should receive heavy government subsidies. Harriet Tubman, Caesar Chavez and Gloria Steinhem are more important to American history than Thomas Jefferson, General Robert E. Lee or Thomas Edison. Environment: US industry has made incredible progress in cleaning up the environment. But, this is not enough. Al Gore has called for a "wrenching transformation" to impose even greater regulatory burdens on US industry so they will be forced to move even more of our jobs to third-world nations with no anti-pollution regulations. Worldwide pollution will thus increase sharply, but we'll feel good having done our part in the US to control pollution. Over its vast geological history, Earth has gone through countless climatological cycles. As an example, over the past 10,000 or so years since the last ice age Earth has been in one of its many global warming phases. We believe all of this change is the fault of modern man -- especially the successful American economy. Americans must be punished for their success by imposing crippling regulation on American businesses and industries. We are very concerned about the environment. Therefore, we support presidential "executive orders" which close off public land from public use. The rights of grasshoppers and all other non-human organisms always come before the rights and needs of humans. Property owners are not entitled to the reasonable use of their property if the rights of a grasshopper or any other organism could remotely be harmed. Hunters don't care about nature but pasty, euphorians who've never been outside big cities do. Government, Politics & Regulation: The only reason socialism hasn't worked anywhere it's been tried, is because the right people haven't been in charge. If we raise taxes high enough, the entire economy will be controlled by a few politicians and bureaucrats, not those greedy job-creating businessmen. Only then can everybody enjoy the prosperity we deserve. There must be plenty of mandates on the other guy. You are safe as long as you choose to do as little as possible -- then government will not impose mandates on you. Only a big all-powerful government can solve everybody's problems. To ensure big government can solve everybody's problems, it must control as much money as possible. Therefore, it is best for the federal government to extract heavy taxes from its citizens, then dole out tax money to compliant state and local governments and specify exactly how, when, why, and to whom funds will be expended rather than allow the taxation and decision making to occur at the lowest practical government level. In the event the federal government wants to solve perceived problems with out expending federal tax dollars, it need only require other entities such as businesses, state or local governments, schools, etc. expend its own money to satisfy federal goals. Whenever the federal government gets involved in a social problem, the costs of that problem go up (ie the cost of college increased sharply with the introduction of student loans, the cost of public schools K-12 soared with federal intervention while quality of education declined, the cost of retirement increased sharply with the introduction of Social Security, the cost of medicines and health care increased sharply due to excessive federal regulation, the cost of child daycare increased sharply with federal sponsorship, the cost of caring for the poor increased sharply with federal welfare programs, etc.) Although federal intervention has, in some cases, improved safety and quality of life, this increase in costs makes citizens even more dependent on big government. This is a good thing. The best politician is an individual who has never had a real job (ie a job outside politics) and who has never had to run, or work, in a business which has to function under heavy-handed government regulation. To ensure that anyone can be president of the United States, we have set the precedent to allow drug-abusing, draft-dodging, womanizing liars who are not above suspicion in financial scams and murder plots. We accept the notion that our chief law-enforcement officer can set the tone for the rule of law by obstructing justice and that the nation's commander-in-chief can keep foreign statesmen waiting while being "serviced" by subordinate government employees. Womanizing is assumed to be a typical characteristic of powerful men. Therefore, we accept this characteristic in men who have the correct ideology. Laws are best written by federal courts and regulatory agencies, so it is best for Congress to make any legislative law as vague and contradictory as possible. The military, not corrupt politicians, start wars. Therefore, the nation's military infrastructure must be under-funded and systematically dismantled. Servicemen, generally being somewhat conservative, are not to be trusted or respected. It is acceptable for politicians to sell or even give away military secrets or military-critical technology to potential enemies in exchange for substantial donations to political campaigns. Using secrecy to protect national security is bad. Secrecy to protect powerful politicians from criminal prosecution is good. It is acceptable for the president of the United States to use federal property (ie renting bedrooms in the Whitehouse) as a means for obtaining substantial donations to political campaigns. Bipartisanship means conservatives and moderates must agree with liberals. All rights reserved by the US Constitution to the States and individuals are subject to the control of the federal government. Business & Economy Whatever you do, don't ever think about employing someone. If you do hire a maid, it is best not to report it to anyone -- especially the tax collector. Businesses create oppression and governments create prosperity. When highly successful businesses (ie Microsoft) fail to contribute heavily to political campaigns, their success must be punished by breaking up the business. Due to heavy regulation and taxation, millions of US manufacturing jobs have been exported to third-world nations. During the same period, millions of unskilled "service-sector" jobs have been created and countless skilled US workers have displaced into those low-pay jobs. Liberals proudly call this progress. Since our nation's economy is far more successful than most, we need to impose ever greater regulatory burdens on our industries so they can no longer afford to operate here. Then we can export our jobs to those nations which do not have such regulatory burdens. The heavy pollution, low pay, unsafe working conditions, and child labor found in those nations as a result of our exported jobs are a small price to pay if we can slash prosperity in our own nation. It's only fair. We all want to pay the lowest possible price for manufactured goods, yet we express self-righteous indignation when the workers who make those products work in slavery conditions at minimal pay. Women should be paid the same as men for "comparable" jobs, even though men of the same age typically have more time in the workforce and consequently greater skill and responsibility. Women in an office job should also be paid the same as a men whose jobs include exposure to danger and harsh weather. Hmm, I wonder if, under the law of unintended consequences, this has contributed to what appears to be an increase in the number of kids left in vehicles to cook while the parent goes into a store for some "short" errand. It's such a bother to unattach the kids from the vehicle and then reattach them a few minutes latter, some might rationalise that the kids will be OK for "just a few minutes". The increased incidence, or at least reporting, of child snatchings means that the kiddies must be locked into the vehicle with the windows up, at best merely cracked. That situtation will of course addle their little brains in less than "a few minutes" as temperature in the vehicle will reach into upper 100s, approaching 200 degrees in very short order. Even putting a screen over the windshield will only help a bit. You'd need screens on all the windows, and even that would only extend time to reach parbroil. Or so it is down here on the southern edge of the Texas Hill Country. I should know, I left my sunglasses on the seat yesterday while attending a very small gun show, thinking they were in the shade, which they were when I went in, but an hour later they were not. I think I've got little burn scars on over my cheekbones, to remind me not to mess with Texas sun, or Mother Nature or old Sol or whatever. :) The Second Amendment is the RESET button of the United States Constitution. --Doug McKay" Joe Sylvester Don't Tread On Me ! (fwd) Date: 23 Aug 2001 10:50:22 -0700 Sent: 8/24/20 08:23 PM Bob Stewart's Gun Rights Seem to Have Been Retroactively Restored. https://www.keepandbeararms.com/newsarchives/XcNewsPlus.asp?cmd=view&articl eid=1890 Written By: Angel Shamaya -- Arizona gun kit maker Bob Stewart just received some fascinating news. On the day before the federal anti-Second-Amendment trial against him was to begin, his civil rights, including his gun rights, were restored by a federal judge. According to a two-page federal ORDER signed by Arizona Magistrate Lindsay Ellis of the Superior Court of the State of Arizona, Maricopa County, on August 20, 2001, "IT IS ORDERED that the civil rights of applicant Robert D. Stewart aka Robert W. Stewart, be restored, including the restoration of his right to possess firearms." Considering the fact that BATF's prosecuting attorneys have been seeking prosecution on "felon in possession of firearms" charges, the above is quite relevant. But far more intriguing is the fact that the ORDER by the federal judge is backdated to August of 1998. Specifically, "IT IS FURTHER ORDERED that these rights be restored nunc pro tunc: (http://www.lectlaw.com/def2/n083.htm) "Nunc pro tunc" literally means "now for then." Translated, a "nunc pro tunc" order by the court is to be treated as if it were ordered on the date ORDERED -- in this case, August 17, 1998. Could it be that the BATF's prosecution isn't prosecuting a "prior felon in possession" anymore? If you would like to read the actual court ORDER, do so by clicking these links: PAGE 1, https://www.KeepAndBearArms.com/images/BobRestoregif1.gif PAGE 2. https://www.KeepAndBearArms.com/images/BobRestoregif2.gif WHY THIS IS RELEVANT BATF agents originally invaded Mr. Stewart's home and pointed a machinegun at one of his young boys because they said the gun kit he was selling was "readily converted." And though they have no official definition of what that term means, they used it to justify stealing hundreds of thousands of dollars worth of personal property, confiscating his customer list of approximately 3,000 names/addresses, etc., and basically ruining this good man's life. BUT, when they knew their forceful method of inventing a definition of the term "readily converted" was a LOSER, they decided to prosecute Mr. Stewart for being a felon in possession of firearms they allegedly found in his home during their violent invasion. But his restoration of rights is dated long before the BATF conducted their "raid" on his home and family. See above documents. His rights have been restored, officially dated back to August of 1998 -- and the BATF machinegunners assaulted Mr. Stewart and his family much later than that date -- in June of 2000. Get the picture? So now what are these BATF folks going to do in their bid to put Mr. Stewart in jail for a very long time? According to the BATF -- who has been caught lying in the past -- Mr. Stewart was also allegedly in possession of unregistered machineguns. One reasonable guess is that they'll proceed with prosecution over an alleged violation of the unconstitutional ban on "unregistered" machinegun possession. If they do that, we'd have a case worthy of going all the way to the Supreme Court, where the ban on "unregistered" machineguns can be rightly challenged as a violation of the Second Amendment. There are of course other possibilities; well-funded gungrabbers usually have something up their sleeve. 1. Prosecutors may (probably will) say that the restoration of Mr. Stewart's rights being backdated is only a clerical issue and that he was still, for all intents and purposes, a "felon in possession of firearms." 2.One Arizona gun rights activist suggested on Tuesday that the BATF "claims to reserve the right to pass on whether your 'gun rights' have been restored", suggesting that they'd deny Stewart's restoration in order to fricassee him. (That would be a very, very bad move considering the fact that the BATF's annual budget is $760 Million but they claim to "not have funding" to restore gun rights -- and for many other reasons. There would also appear, in my unlawyerly opinion, to be a conflict of interest in their being able to deny something they allegedly have the power to grant when to do so would serve only their purposes.) 3.Another activist suggested that the restoration was politically motivated in order to give the BATF an out. We shall see soon enough. WHAT WILL HAPPEN NEXT? Naturally, Mr. Stewart filed a MOTION TO DISMISS in court on the day when his trial proceedings were due to begin, Tuesday, August 21, 2001. Judge Roslyn O. Silver -- who has refused ALL of Mr. Stewart's motions thus far -- has given federal prosecutor Welty until September 5th to respond to Mr. Stewart's MOTION TO DISMISS. Mr. Stewart will then be given FIVE DAYS to respond to the "MOTION TO LOCK HIM UP AND THROW AWAY THE KEY" we expect from Welty. (REPEAT: BATF has a $760 Million annual budget and has been given 14 days to respond. Once they do, Mr. Stewart, who is now working another job to replace the income stolen from him by BATF, gets only 5 days -- and Stewart is defending himself.) To my knowledge, a new trial date has not yet been set. When a date is set or any new information comes in, you will hear about it on KeepAndBearArms.com. And we will post each page of what Mr. Welty has to say the very day it is delivered to Mr. Stewart. CALLING FOR HELP FROM ATTORNEYS I have personally been called names like "stupid" and "foolish" and "ridiculous" for supporting Bob Stewart throughout his ordeal -- even by "pro RKBA" attorneys -- because "you look bad if you support a prior felon in possession." (I'll save for another day my commentary about the fact that Mr. Stewart was a non-violent "felon" who claims he was lied to by BATF agents to, in his admitted ignorance, plead guilty the first time he was assaulted by federal agents.) But that isn't the way it is now; we've cured his cooties for you -- and I would appreciate a few Real American attorneys stepping forward as soon as we receive the response from BATF's prosecutor. Expect to see that on or shortly after the 5th of September. If you are a pro-RKBA attorney willing to take a look at the BATF's response as soon as it comes in, please email me directly at Director@KeepAndBearArms.com with a subject of KABA PRO GUN ATTORNEY.
