Website turns tables on government officials

Annoyed by the prospect of a massive new federal surveillance system, two
researchers at the Massachusetts Institute of Technology are celebrating the
Fourth of July with a new Internet service that will let citizens create
dossiers on government officials.
The system will start by offering standard background information on
politicians, but then go one bold step further, by asking Internet users to
submit their own intelligence reports on government officials -- reports
that will be published with no effort to verify their accuracy.
"It's sort of a citizen's intelligence agency," said Chris Csikszentmihalyi,
assistant professor at the MIT Media Lab.
He and graduate student Ryan McKinley created the Government Information
Awareness (GIA) project as a response to the US government's Total
Information Awareness program (TIA).
Revealed last year, TIA seeks to track possible terrorist activity by
analyzing vast amounts of information stored in government and private
databases, such as credit card data. The system would use this information
to analyze the actions of millions of people, in an effort to spot patterns
that could indicate a terrorist threat.
News of the plan outraged civil libertarians and prompted Congress to set
limits on the scope of such activity. The Defense Department then renamed
the program Terrorist Information Awareness, to ease public concern.
But the controversy gave McKinley the idea for the GIA project. "If total
information exists," he said, "really the same effort should be spent to
make the same information at the leadership level at least as transparent --
in my opinion, more transparent."
McKinley worked with Csikszentmihalyi to design the GIA system. It's partly
based on technology used to create Internet indexes such as Google. Software
crawls around Internet sites that store large amounts of information about
politicians. These include independent political sites like opensecrets.org,
as well as sites run by government agencies. McKinley created software that
ferrets out the useful data from these sites, and loads it into the GIA
database. The result is a one-stop research site for basic information on
key officials.
The site also takes advantage of round-the-clock political coverage provided
by cable TV's C-Span networks. McKinley and Csikszentmihalyi use video
cameras to capture images of people appearing on C-Span, which generally
includes the names of people shown on screen. A computer program "reads"
each name, and links it to any information about that person stored in the
database. By clicking on the picture, a GIA user instantly gets a complete
rundown on all available data about that person.
The GIA site constantly displays snapshots of the people appearing on C-Span
at that moment. If there's a dossier on a particular person, clicking on the
picture brings it up. A C-Span viewer watching a live government hearing
could learn which companies have contributed to a member of Congress's
reelection campaign, before the politician had even finished speaking.
All of the information currently on the site is available from public
sources. But GIA will go one step further. Starting today, the site will
allow the public to submit information about government officials, and this
information will be made available to anyone visiting the site. No effort
will be made to verify the accuracy of the data.
This approach to Internet publishing isn't new. It resembles a method known
as Wiki, in which a website is constantly amended by visitors who contribute
new information. The best known Wiki site, www.wikipedia.org, is an online
encyclopedia created entirely by visitors who have voluntarily written
nearly 140,000 articles, on subjects ranging from astronomy to Roman
mythology. Any Wikipedia user who thinks he has spotted an error or wants to
add information can modify the article. Unlike at a standard encyclopedia
operation, there is no central authority to edit or reject articles.
The GIA approach, though, raises the possibility that people could post
libelous information, or data that unreasonably compromises a person's
privacy.
That troubles Barry Steinhardt, director of the Technology & Liberty Program
of the American Civil Liberties Union. "We think that there should be some
restrictions on the publishing of personally identifiable information,
whether it involves government officials or not," he said.
But he noted that the public has a right to know some things about a
politician that would be properly kept private about an ordinary citizen.
For instance, voters have a right to know where a politician sends his
children to school, if that politician has taken a strong stand on school
vouchers.
"Do they have the right to publish every piece of data they're going to
publish?" Steinhardt asked. "It's going to depend on what they publish."
In any case, Steinhardt said, McKinley and Csikszentmihalyi have a First
Amendment right to set up the GIA project. And he said that it's a valuable
response to the government's TIA surveillance. "I assume the point of this
is, turnabout is fair play."
On a page of the GIA website, at opengov.media.mit.edu, McKinley and
Csikszentmihalyi give their answer to questions about the legitimacy of
their actions.
"Is it legal?" the site reads. "It should be."

The history we celebrate today
This weekend we celebrate that stirring day in history, July 4, 1812,
when the first president of the United States, Benjamin Franklin, emerged
from the old State House in Boston, held up the new Constitution freshly
penned by Thomas Jefferson of New York, and announced to the cheers of
the gathered throng that "These United Colonies are, and of right ought
to be, free and independent of the crown of Spain!" Who would not wish to
have been there, joining in the joyous tumult, as the commander of the
Continental Army, Ulysses S. Grant, promptly ordered his men to board the
waiting steamships and set sail for San Juan Hill?
Um, no. Actually, that's not the way it went. But today's question is,
how many young Americans, be they eighth graders or high school seniors
-- even college students at our best universities -- could correct as
many as half a dozen errors in the paragraph above?
A year ago, in May of 2002, Education Week magazine reported that of
11,300 high school seniors tested, 57 percent did not have even a "basic"
knowledge of American history. Only 39 percent could adequately describe
two advantages the South had over the Union Army during the Civil War
(see http//www.edweek.org/ew/newstory.cfm?slug=36naep.h21).
When Congressman Roger Wicker recently asked high school seniors in his
Mississippi district to name some of the unalienable rights our
forefathers died defending in the Revolution of 1776, he got ...
"silence," The Associated Press reports.
"Among these are life," Rep. Wicker said, "and ..."
"Death?" one student asked.
"Do the words 'Give me liberty or give me death' sound only vaguely
familiar?" asked former Review-Journal staffer Caren Benjamin of The AP
in a report filed from Washington last week. "Do you think Thomas
Jefferson was the 'Father of the Constitution'? If so, you're not alone.
"Nearly 80 percent of seniors at 55 top colleges and universities --
including Harvard and Princeton -- received a D or F on a 34-question,
high-school level American history test that contained historical
references like those."
Ninety-nine percent of the seniors could identify profane adolescents
"Beavis and Butthead" as "television cartoon characters." But only 23
percent could identify James Madison as the principal framer of our
Constitution.
Sadly, this is nothing new. Surveys of high school seniors dating all the
way back to 1955 have shown sizeable portions of young American students
in good standing are unable to identify the decade in which the Civil War
took place. At least, back in 1955, a clear majority could name the
nation against which the War of 1812 was fought, and rattle off the names
of 20 American presidents. (The New York Times on Nov. 20, 1955
identified Jefferson Davis and Benjamin Franklin as "wrong answers" to
that question, though of course they're only wrong if you specify
president "of the United States.")
In 1994, the National Assessment of Educational Progress found only 11
percent of twelfth graders were "proficient'' in American history. (Asked
to name the document that contains the basic rules used to run the
Government of the United States of America, only 27 percent could name
the U.S. Constitution.)
Of course, we always have to check and see which answers are being judged
"correct."
Of those 11,300 high school seniors tested last year, according to
Education Week, 64 percent were marked with a wrong answer because they
failed to reply that the Progressive era of 1890 to 1920 was
characterized by "a broad-based reform movement that tried to reduce the
abuses that had come with modernization and industrialization."
The answer may be technically correct, due to the clever use of the verb
"try," but doesn't history more typically involve the study of real-world
results, rather than starry-eyed intentions?
Far from "reforming" the move toward corporate control over the economy,
the so-called "Progressive" era brought its greatest triumph, as control
over the paper money of the United States was wrested away from the
direct control of Congress -- where the Constitution had safely ensconced
it for 125 years, resulting in a zero rate of inflation -- and turned
over to a consortium of private, corporate bankers known as the "Federal
Reserve Board," who have managed during their stewardship to reduce the
purchasing power of the dollar to one seventeenth of its level of 1912.
The "Progressive era" also brought us direct election of senators --
breaking the veto power of the state legislatures over the enactments and
growth of the central government -- as well as alcohol Prohibition, the
beginning of the Drug War with the Harrison Narcotics Act, and an income
tax that helps subsidize today's military-industrial complex. How on
earth these repressive stepchildren of the hygienic movement served to
"reduce the abuses that had come with modernization and
industrialization," Education Week does not explain.
But the ignorance of our youth about our heritage of freedom is still
unquestionably abysmal. Do today's high school students know the federal
government is barred from subsidizing the indoctrination of the young in
any religious creed, including the newfangled religion called
"environmentalism" -- let alone that it is the First Amendment that
offers us this guarantee our tax moneys can never be used for such a
purpose? Do they know there is no exemption allowing the government to
punish "hate speech"?
How many of today's youth can tell us it is the Second Amendment that
guarantees to each individual the right to carry around weapons of
military usefulness, without "infringement" by any taxation, permitting,
or other regulatory scheme -- or that neither the Fourth Amendment
(guaranteeing "the right of the people to be secure in their persons,
houses, papers, and effects") nor the Fifth ("nor be deprived of life,
liberty or property without due process of law") adds "unless the
attorney general thinks you're a drug dealer, or that you may have
contributed to some suspected terrorist organization"?
How many know that the Sixth Amendment guarantees us our right to trial
by the kind of jury that judged John Peter Zenger -- not one stacked only
with those who will swear in advance to enforce the law as the judge
instructs them?
Do they know that Article I. Section 9 of our Constitution specifies that
"No Capitation, or other direct, Tax shall be laid, unless in proportion
to the Census or Enumeration herein before directed to be taken," and
that the Supreme Court in the Brushaber and Baltic Mining cases said the
Sixteenth Amendment did not repeal or change that restriction on direct
taxation, nor "create any new taxing authority"? Can any of them explain
why this might be important?
Which is declared in Mr. Jefferson's Declaration, that "Whenever any form
of government becomes destructive to ... Life, Liberty, and the Pursuit
of Happiness ... it is the right of the people to alter or abolish it,"
or "From each according to his abilities, to each according to his
needs?"
That first one sounds like a recipe for anarchy and revolution. Might it
come from the Communist Manifesto, instead?
Which of these two principles have Americans given their lives to defend?
To which of these two principles have Americans sworn eternal enmity,
gladly sacrificing their lives to oppose?
If our youth cannot answer these questions, then what are all of today's
marching bands and waving flags and fireworks really all about?
In 1776, there was no President of the United States -- though Franklin
later served as president of the governing body of the independent
Commonwealth of Pennsylvania. The redhead who penned the Declaration
hailed from Virginia. The army commander was, of course, Washington, "the
indispensable man" ... though arguably the most important victory of the
Revolution was won in the autumn of 1777, on a farm in upstate New York,
by a storekeeper from New Haven who was offered no official command, and
so galloped onto the field of battle without anyone's permission, waving
his hat and shouting, "Follow me, men!"
Who was that great general, who rose again and again despite his serious
wounds -- even after his horse was shot from beneath him? Who was that
great American hero, to whom in large measure we owe whatever remaining
freedoms we have not yet allowed to slip through our fingers?
You know his name. It's in all the history books.

I thought you might like to hear about a gun lesson that 66 youth,
age 12-19, learned at Camp American last week. All 66 campers
were "issued" a small water gun for the purpose of playing some
competitive team games. For the final game in the series, each team
was told to keep their best 2 guns and turn the rest in. The sheep
were willingly lead to the slaughter in spite of the class on the
importance of gun ownership they had attended earlier in the day. As
each team completed the final round they were told to sit on the
basketball court. When the final team finished the competition, 5
staff members came rushing out of the woods, adorned in blue berets
and carrying huge water guns. Naturally, the 66 campers
were "slaughtered" by the 5 blue berets with the "assault weapons".
The "wounded and dead" were once again gathered on the basketball
court to see if they could figure out what happened. They knew all
too well at this point that they never should have given up their
guns. They also figured out that even though 20 lucky campers still
possessed their "state issued" guns, the 5 big "assault weapons" were
no match for them. They learned the importance of the right to keep
and bear arms, and working to get the ban on "assault weapons"
lifted. This is a hands on lesson they will not soon forget.

gotten 51 votes in the Senate of the United States for an out-
right ban, picking up every one of them, Mr. and Mrs. America,
turn them all in, I would have done it." There is no 10-year
sunset provision in the bill. H.R. 2038 permanently bans every
gun that is currently banned and, with numerous, overlapping
provisions:
* Bans every gun made to comply with the Clinton ban. The Clinton
ban dictated the kinds of grips, stocks and attachments new guns
can have. Manufacturers and gun owners complied and new guns
conform to the Clinton requirements. H.R. 2038 bans the new guns
too.
* Bans guns exempted by name or type under the Clinton ban.
Commonplace Ruger Mini-14s, Mini-30s, Ranch Rifles, .30 Caliber
Carbines, and fixed-magazine semi-automatic center-fire rifles.
* Bans all semi-automatic shotguns. Bans Remington, Winchester,
Beretta, Benelli, and other shotguns commonly used for hunting,
trap, skeet, sporting clays, and self-defense. Bans them by ban-
ning their main component, called the "receiver" (Sec. 2(a)(30)(J)),
and bans them because they have "any characteristic that can func-
tion as a grip"(Sec. 2(H)(ii) and (b)(42)). Any characteristic.
* Bans all detachable-magazine semi-automatic rifles because
they have "any characteristic that can function as a grip."
(Sec. 2(a)(30)(D)(iii) and (iv), and (b)(41) and (42)).
Any characteristic.
* Bans target shooting rifles. Bans the three centerfire rifles
most popular for marksmanship competitions: the Colt AR-15, the
Springfield M1A and the M1 "Garand."
* Bans guns for self-defense. Bans any semi-automatic shotgun or
rifle an Attorney General one day claims isn't "sporting," even
though the U.S. Constitution, the constitutions of 44 states,
and the laws of all 50 states recognize the right to use guns
for defense.
* Bans 65 named guns (the Clinton law bans 19); Bans semi-auto
fixed-magazine pistols of over 10 rounds capacity; Bans frames,
receivers, and parts used to repair or refurbish guns; Bans
importation of magazines exempted by the Clinton ban; Bans
selling a legally-owned "assault weapon" with a magazine of
over 10 rounds capacity.
* Bans guns rarely used in crime. A fact demonstrated by every
state and local law enforcement agency report on the subject.
The Congressionally-mandated study of the Clinton ban found
that the guns "were never used in more than a fraction of all
gun murders."
* Begins backdoor registration. Requires manufacturers of guns,
frames, receivers, and other parts to report the names of their
dealers. Requires dealers to report any of the guns and parts
they have in stock. Bans private sales of the guns and parts.
The next step is to register individual purchasers.
The idea of being able to hold a manufacturer
of a product, legally liable for any after sale
illegal misuse, is like suing Boeing for the

U.S. Rep. Charlie Norwood (R-GA) has introduced a bill=20
that addresses the growing U.S. criminal alien crisis by=20
allowing the over 600,000 state and local law enforcement=20
officials in the field to enforce immigration laws during=20
the course of exercising their regular duties.
The bipartisan bill, entitled the "Clear Law Enforcement=20
for criminal Alien Removal Act of 2003" (or CLEAR Act -=20
H.R. 2671) brings clarity and coordination to our national=20
immigration system and support and relief to the roughly=20
2,000 Bureau of Immigration and Customs Enforcement=20
(BICE) agents charged with enforcing immigration laws on=20
the books.
There are upwards of 400,000 individuals who have received=20
final deportation orders that are hiding in our=20
communities. Their appeals have run out, and the orders=20
tell them, "it's time to go." But the out-manned Bureau=20
of Immigration and Customs Enforcement can't find them!=C2=A0
What's worse, 80,000 of those people have criminal=20
convictions. They were in the hands of law enforcement,=20
but were released back onto the streets. "Can you imagine=20
opening the doors of our prisons and letting 80,000=20
criminals run back into the streets?" asked Rep. Norwood.=20
"That's exactly what's happened with these 80,000=20
criminals."
Today's broken enforcement system has left our state=20
and local law enforcement community increasingly unclear=20
on whether they hold the jurisdictional power to enforce=20
our federal immigration laws. The CLEAR Act clarifies=20
that our state and local officers have the inherent=20
authority to arrest and detain criminal and illegal=20
aliens during the normal course of their duty.=20
Additionally, the bill provides these officers with=20
the appropriate funding and training to adequately=20
enforce the immigration laws, and full access to a new=20
National Crime Information Center (NCIC) database=20
containing the records of any and all violators of=20
immigration law.
The CLEAR Act also creates a new system for BICE to=20
take custody, process, and remove illegal aliens.=C2=A0
Additionally, it produces a system of accountability=20
by requiring the federal government to either take=20
custody of illegal aliens or else pay the locality to=20
detain the aliens.
ACTION ITEM: Right now if a local officer in your=20
hometown, during the normal course of his or her duty,=20
pulls over a car for speeding, with someone who is=20
illegally in our country, they have to call BICE, verify=20
their status, and wait until someone from BICE comes to=20
pick them up. Sometimes they have to wait for hours on=20
the roadside for the pickup to arrive. But most of the=20
time BICE says they're too busy to come by -- telling=20
the police to let the lawbreakers go. As Rep. Norwood=20
says, "That is as wrong as the day is long and it's=20
high time we fixed it."

ISSUE: Concerned about growing encroachments on our
individual rights, cloaked in a shroud of "patriotic"
governmental acts? Now there's something that you can
do about it. Congressman Steve Chabot (R-OH) has introduced
legislation to implement stringent privacy protections
for individuals. The legislation, the Defense of Privacy
Act (H.R. 338), requires federal agencies to assess the
privacy implications of proposed rules and regulations.
"In the past several years, privacy rights have, too
often, been an afterthought in the regulatory process,"
said Chabot. "This proposal will force agencies to open
their eyes to legitimate privacy concerns."
Chabot's Defense of Privacy Act would require federal
agencies to take into account privacy concerns when
developing and implementing regulations, to prepare a
privacy impact analysis of regulations that have been
introduced, and to ensure a periodic review of the impact
on privacy by the regulations that have been instituted.

Chabot has been a leader in the effort to compel federal
agencies to consider the privacy rights of individuals
when issuing rules and regulations. In the 106th
Congress, Chabot first introduced the Defense of Privacy
Act. In the last Congress, Chabot and former-Rep. Bob
Barr (R-GA), then-Chairman of the subcommittee of primary
jurisdiction for the legislation, spearheaded the
successful passage of the legislation in the House, but
it failed to pass the Senate.
Now, it's back on the agenda, and it's time to pass it
all the way through.
ACTION ITEM: "The sphere of privacy, which Justice
Brandeis eloquently described as the 'right to be let
alone,' is not only rapidly diminishing, it is increasingly
penetrable," said Barr. "Special care is necessary to
ensure that personal information remains personal, absent
a sound reason to treat it otherwise. This value is
neither Republican or Democratic; liberal or conservative,
it is an American value."
"This legislation takes the first -- necessary -- step
toward protecting the privacy of information collected by
the federal government. Unlike a private commercial gatherer
of personal data, the government can put you in jail based
on what it uncovers. For this reason, the government has
an obligation to exercise greater responsibility when
enacting policies that undermine privacy rights," Barr
continued.
A hearing on the bill is currently scheduled for this week.

When a man attempted to siphon gasoline from a motor home parked on a
Seattle street, he got much more than he bargained for. Police arrived at
the scene to find an ill man curled up next to a motor home near spilled
sewage. A police spokesman said that the man admitted to trying to steal
gasoline and plugged his hose into the motor home's sewage tank by mistake.
The owner of the vehicle declined to press charges, saying that it was the
best laugh he'd ever had.

A woman was reporting her car as stolen, and mentioned that there was a car
phone in it. The policeman taking the report called the phone and told th! e

45 year-old Amy Brasher was arrested in San Antonio, Texas, after a mechanic
reported to police that 18 packages of marijuana were packed in the engine
compartment of the car which she had brought to the mechanic for an oil
change. According to police, Brasher later said that she didn't realize that
the mechanic would have to raise the hood to change the oil.

David Posman, 33, was arrested recently in Providence, R.I, after allegedly
knocking out an armored car driver and stealing the closest four bags of
money. It turned out they contained $800 in PENNIES, weighed 30 pounds each,
and slowed him to a stagger during his getaway so that police officers
easily jumped him! from behind.

Oklahoma City - Dennis Newton was on trial for the armed robbery of a
convenience store in a district court this week when he fired his lawyer.
Assistant district attorney Larry Jones said Newton, 47, was doing a fair
job of defending himself until the store manager testified that Newton was
the robber. Newton jumped up, accused the woman of lying and then said, "I
should have blown your [expletive] head off." The defendant paused, then
quickly added, "-- if I'd been the one that was there." The jury took 20
minutes to convict Newton and recommend a 30-year sentence.

R.C. Gaitlin, 21, walked up to two patrol officers who were showing their
squad car computer equipment to children in a Detroit neighborhood. When he
asked how the system worked, the officers asked him for a piece of
identification. Gaitlin gave them his driver's license, they entered it into
the computer, and moments later they arrested Gaitlin because information on
the screen showed that Gaitlin was wanted for a two-year-old armed robbery
in St. Louis, Missouri.

ISSUE: Do you think government is bloated?
Well, duh.
Believe it or not, there are some in Congress who are trying
to reverse the trend towards more and more laws, agencies
and programs. Seeking a way to save tax dollars and reduce
the federal government's duplication of services,
Congresswoman Jo Ann Davis (R-VA) has introduced H.R. 2743,
the "Government Accountability and Streamlining Act."
Rep. Davis's legislation requires the Comptroller General
of the United States to determine whether any proposed
legislation in the House or Senate creates any new "federal
entities, programs or functions" that are redundant of any
existing federal program. The Comptroller General would
prepare these anti-redundancy statements for bills approved
by any committee or subcommittee of the House or Senate.
This is similar to how the Congressional Budget Office
"scores" a bill to determine its budgetary impact prior to
consideration on the House or Senate floor.
"Before Congress votes on any measure, we have a full
understanding of the fiscal impacts of the proposal,"
Congresswoman Davis said. "Why shouldn't we have the same
information regarding whether or not a bill would be
duplicating existing programs? This just seems like common
sense to me."
Common sense is sorely lacking on Capitol Hill. We need to
shove our Congressmen along, and demand they support this
bill -- at least as a first step towards more governmental
accountability.
ACTION ITEM: Too often in Washington, the answer to any
problem is to create another federal program. Then we end
up with similar programs being scattered among agencies
and across different Cabinet departments. That's not the
most effective or efficient way to operate a government.
We can do better.
Apart from sweeping government reorganization, this Act
would introduce commonsense steps that Congress can take
to address the problem of waste and duplication in
