The taxpayers paid for this research, and we should be allowed to see it and make our own conclusions about whether it is valid or phony. The universities are very opposed to this law and comments currently received by OMB are 15 to 1 against the public's right to know. That's why you need to act immediately. The law was passed last year, but the OMB regulation will determine whether or not it becomes useful to citizens. I strongly support the Shelby provision because of its critical importance to the American public. It will enable the public to obtain, for the first time, through the Freedom of Information Act, the raw data collected and analyzed under taxpayer-paid federal research grants and agreements. Instead of being presented with only the conclusions of tax-funded research studies, the public will be able to obtain the basis for those conclusions. The Shelby provision is extremely important to the American public because the Federal Government funds so much of U.S. research. The results of this research affect almost every aspect of American life, from government regulations to public policy issues, both policy and economic, regarding the family, education, crime, drugs, guns, the environment, health and safety, business, tax rates, the Federal budget, and government spending. Without the ability to obtain the raw data from the research studies used to support these policy and regulatory decisions, the public cannot independently judge for itself the validity of the government's decisions. Every year, the Federal Government considers over 4,000 regulations. The total regulatory burden for the country is now estimated to cost over $600 billion. Unless those impacted by these rules are able to access the research data supporting the government's findings, they will be severely limited in their ability to engage in a meaningful debate. Federal Judge Sam Cummings ruled that the statute in question violated defendant Timothy Joe Emerson's rights under the Second Amendment - which details the right to bear arms. Federal prosecutors argued that the right to bear arms belongs to an organized militia, like the National Guard, and not to individual citizens. Therefore, prosecutors said, Cummings should let stand the federal law stating that those under a restraining order cannot posses or brandish a firearm because it might pose a threat to the person filing the order. But Cummings ruled that "A historical examination of the right to bear arms, from English antecedents to the drafting of the Second Amendment, bears proof that the right to bear arms has consistently been, and should still be, construed as an individual right." "If I do my part and you do your part,we'll be proud to live here because we'll turn this country around," I told him, "and we'll realize who the knights in shining armor really are. They are us." Of course, young Richard is right. We can't win the battle for America's soul by trying to convert the middle-aged liberals who run America's media, film industry, public education system - and the White House and the Government. I don't expect them to help reverse the moral decay they have wrought. =20 No, but it is teenagers like Richard who have a sense of shame about the way things are. They may well be the instruments God will use to bring about change. It's interesting that a 7th grader knows what it means to stand up for what is true and right, but our national leaders do not. Richard knows the impact on his life of lies, hypocrisy and corruption, but apparently many politicians in Washington do not. So, as I sat down this morning to write you this letter, I looked at the options. We can decide that nothing can be done to fix the problem, and accept the final decline of this great nation. Or we can lead the way to defend what we know to be right by investing in a generation who can see Sixties values for the delusion they are.=20 That's our choice: we either follow the path to destruction or we lead the way to renewal. I can't begin to tell you how much we've done, but you will realize that a great deal of work goes on behind the scenes. Each time I write, or speak on radio or television, thousands, even millions more people learn what's really been going on in Washington. And as you'll agree, the first step in bringing change is to teach people the truth. And there's much more we can do with more time and money. =20 Everything I've told you about, today and previously, has been accomplished on a tiny budget. I haven't written to you since Thanksgiving, but I'm writing now to ask you to join me in this important work. =20 I work 16 hours a day. Unfortunately, OMB is trying to interpret that provision very narrowly and only require disclosure of data used "in developing policy or rules." That would allow anti-gun researchers and their government sponsors to claim that their studies weren't used in making rules, and therefore keep their taxpayer-funded data secret.
