There is another scam going on where a person calls and says that they are doing a computer survey from a company. There is no preface information or company names to lend you. But they usually use a company name that is a well-known software company, and they usually say that they are doing the survey because they want to give out free software. They want to know what would be a good time for someone to come from their company and install the software on your PC. They also ask questions about income, etc. During their questioning, they (unknowingly to you) find out what time you're usually home, what kind of computer equipment you have and all sorts of other valuable information. At a company where a friend of mine works, a co-worker of his received one of these calls, and he was robbed the very next day (of course, when he was not home). I received a similar call yesterday afternoon. Fortunately, I knew about this ahead of time, and we didn't provide them with any information. I want to make you all aware of the situation and the potential danger involved in giving out any information like this over the phone. The people sound very genuine, and very few people are going to question receiving free software. I would advise you, however, to tell the people that if they have your phone number, they should have your address (they may be getting it off the Internet somehow), and they can mail you any free software they might be offering. If you have a home computer set-up, you should be familiar with installing your own software. You may even want to tell them you don't have a home computer. Whatever you're comfortable with. Please don't give out any information that you may regret later. Pass this information along to associates, friends and family members, as well. The fewer people they are able to scam, the better. I got a 5 page list of all of the repairs that Bob Hancock has requested be done to EV from Bill Bullis. As far as that repair list goes the only other itemthat Bill thiks Bob wants fixed before we can fly EV is that the battery tray istoo flimsy and should be strengthened. Bill is doing this. Also, I believe Bill is the only person who has talked to Bob about this list and Bill's recollection of the specifics of all of the items is NOT clear. I will make several copies of this list and bring them out on Saturday. Since EV has had its annual done in Sept. but still hasn't flown, Bob is willing to update the annual when he returns after 2/20 if the ship is ready. The other problem with EV is that the registration is missing. It was put in theplane on the seat during a rain storm be Bill, but he can no longer find it. SO, DOES ANYONE KNOW WHERE THE REGISTRATION FOR EV IS? Regarding the G103 tire. We should make this a very early morning project or late in the day, so that the G103 is NOT grounded Saturday. Please coordinate this with Fran Allender, we took the faring off Sunday night, so that the brake could be inspected. Where it is doubtful that an operation is for "compensation or hire", the test applied is whether the carriage by air is merely incidental to the person's other business or is, in itself, a major enterprise for profit. Commercial glider operations operate under part 91: non-stop sightseeing day VFR within a 25 nautical mile radius of the based airport. I know of no commerical glider operation (rides or tows) that operate under Part 135, with the exception of the anti-drug rules in 135.1(a)(5). The question that has to be answered is "is this a 'for hire' operation?" A good resource would be AOPA, and it's an 800 number... Any telephone communication with FAA should be documented with a paper memo to file describing the person you talk to and the nature of the conversation. It can come in handy later. (The FAA *loves* paper!) Now, if the gift certificate were for a one-day introductory membership in the club, then there shouldn't be any question of "for-hire". The day they come out, they sign a piece of paper, and presto! they're a club member. They get their ride, and if they'd like to continue, we modify the end-date and get their equity check. If they don't then by the end of the day, they're no longer a club member. So the gift certificate offers "One Free Glider Ride" in the big print, and in the small print is says "with this one-day membership certificate". Further on, toss in some glowing words about the joys of being a member of the NCSA. If the gift certificate were only for "One Glider Ride" and it was clear that NCSA was only interested in making a buck off the experience, then it would be clear that it was a for-hire operation and commericial operator part 91 (plus part 135 drug rules) would apply. Of course, I'm trying to be logical here, and we all know that FAA and "logic" in the same sentence is a virtual oxymoron. The horror stories (such as the one in this month's "Pilot") are the ones that make us wary of FAA. Another nasty example is that I know I can't post a note at an FBO bulletion board that says "hey, call me and I'll take you for a ride. We'll split gas money". That is, in the eyes of the Feds, "holding out" and can be construed as a commerical operation. Pilots have had certificate action based on such innocent notices. This is also the same bunch of legal geniuses who decided that a tow pilot, even though (s)he isn't paid, can be considered being compensated by "building time". To whomever decides to talk to the FAA: be very careful about what questions you ask and how you word them. They have their own form of FAAbonics, and even though you're both using words you understand, the meaning of those words can be completely different on each end of the conversation. I had gathered (from a lot of second hand info I admit) that there was precedent to beleive that non-commercial tow pilots in a "club" operation were acceptable to the FAA. The strict definition of "not carrying persons or property for compensation" is met IMHO. No matter what the club ride deal is called - gift certificate, one day membership, trial membership or whatever - it simply represents a paid ticket for a glider ride. Paid glider rides constitute a commercial operation subject to more stringent regulation under Part 91 and partial regulation under Part 135. Part 61 requires commercial pilots for the glider and tow plane. Part 91 requires more frequent aircraft inspections than are now conducted. Flight schools give sight seeing rides exceeding the Part 135 25 mile from the airport restriction under the guise of flight instruction. But the pilots are commercial rated instructors and the aircraft are subject to appropriate inspection under Part 91. It doesn't matter that the proposed glider rides are a non profit endeavor. If the club wants to attract new members via the ride route, it may need to do it without cost to the prospective member. Or be prepared to set up a commercial operation. Paul has it basically in hand. I have read and do have a good understanding of the FARs on this matter. As an airplane CFI, I do this sort of thing on a regular basis. These operations are indeed regulated by Part 91. FAR 135.1 specifically excludes student instruction and sightseeing flights (non-stop within 25 sm). 135.1(c) governs applicability of drug and alcohol testing requreiments. It applies to operators of *airplanes* and *rotorcraft* but not gliders. So, drug/alcohol tests are not needed for the proposed glider rides. Ths situation is somewhat more complex w.r.t. pilot certificates and medicals. It's quite clear that there's no problem when the gldier pilot is a CFI and the tow pilot has a commercial and current second class medical. In that case, the flight should be called an "introductory lesson" thus avoiding any of the sightseeing rule interpretations. It should also be no problem when the glider pilot has a commercial certificate. If you don't have the SSA waiver, then the tow pilot must have a commercial certificate. For sightseeing "rides" the glider must be within annual *and* 100 hour inspection. Instructional flights allow a loophole though, in that if the instructor or operator (in this case, the club) does not provide the aircraft, then a 100 hour inspection is not needed. Paul's suggestion about giving a "one day membership" is the ticket here. This is how all the flying clubs here operate specifically to avoid the 100 hour rule. The club *member* provides the aircraft. The CFI (or commercial pilot) is technically an independent operator and thus is not providing the aircraft or working for a commercial operator who provides the aircraft. The distinction betweeen commercial ride and club membership may seem slim, but it is real and blessed by the FAA. As to the issue of the tow plane and pilot requirements, things are a bit less clear to me. The regs don't specifically address towing in the 100 hour inspection requirements. FAR 135.1 excludes "aerial work operations" but towing gliders (as opposed to banners) is not specifically mentioned. I haven't seen the SSA waiver in quite a while, but I believe it apples to club operations only (and not to general Part 91 commercial sightseeing rides). Suggarbush (VT) might be a very good operation to talk to as they are a club which runs an extensive ride program. It couldn't hurt to talk to AOPA, but I wouldn't act only on their advice. I'm not sure where I went wrong on this one. The air was dead calm above 3000 feet, not what I expected. And thermals were pretty much just burbles that delayed the inevitable landing, and didn't support strong climbs. AND the sky was blue, again, not what I expected. At least it was a fun day with around fifteen tows! The G103 brake was fixed by Bill Bullis (thanks Bill!), but still seems to have a bit of air in it. Jim Alton soloed in the 1-26, and was impressive with the tight handling of this fine flying machine. We had two new prospective members visit our club and take flights with Richard Pearl. Gavin and Paula, brother and sister from Los Altos. They have quite a bit of enthusiasm, and enjoyed their flights. The current exemption is valid to May 31, 1997. I will place copies of the current exemption on (or in) the desk near the phone in the NCSA trailer this Saturday. I will keep in contact with the SSA to obtain and distribute a new extension when it is available. Just to add fuel to the Email debate from last week, the first bullet under "conditions and limitations" of the exemptions is included below: 1. This exemption applies only to pilots who are members of SSA chapters that are incorporated, have tax-exempt status recognized by the Internal Revenue Service, and engage in not-for-profit soaring operations. Rob P.S. If one reads the whole package, an ironic "Catch-22" is evident. In the original exemption, the FSDO quoted an FAA interpretation of 61.118 that would imply that no waiver would be needed. It states that the FAA has always taken the position that a glider being towed is not viewed as "carrying property or passengers for hire". The second part of the FAR is the issue - "nor may he, for compensation or hire, act as pilot in command of an aircraft". The FAA holds that logging "free" flight time is a form of compensation. The interpretation further states that if the tow pilot were to simply not log the flight time, then he would not be in violation of the FAR; however, he then wouldn't be able to demonstrate the recent flight experience requirements of 61.69! Actually the past 3 weekends have been pretty good as far as intro. rides go. Lots of training, Richard P and Rolf P flew all day with students or intro rides. Actually, for the past 3 weeks we've had a good turn out for intro. rides. If we can keep this trend going through Spring, we'll have a significant turn-around in our membership numbers. So let's keep talking to people we know about the intro. membership and the club in general. Bob Hancock will be back in the Bay Area on 2/20 and Fran A will schedule both the G102 for an annual and EV for a final inspection before March 2nd. I'll let you know as soon as we have the dates set. Thanks to Sid Moore and Bob Johnson for spending many hours on Sun. preparing the G102 for it's annual. EV should be ready to fly as soon as the radio mount that Curt Laumann has built is installed and we get a 337 on it from Bob Hancock (again the target for the 337 is before March 2). If you are interested in helping with EV please call Fran Allender as he is coordinating this effort. Thanks Bill B and Curt L for all of the work on EV and thanks to everyone else who have contributed to this effort. Late Sunday afternoon Rolf and Gavin (an intro. member) landed out in a field in Byron. It was a successful out landing in that there were no injuries or damage.AS was eventually returned to the airfield, although it took 7 people, 2 trailers and about 3 hours to do it. Unfortunately, the pin holding the horizontal stabilizers in the "flying position" could not be removed, so the fuselage returned on the Blanik trailer (flat tire pumped up first) and the wings returned on the G103 trailer. Due to the late hour, the cold, and the wind this is where they remain today. So, the first task on Saturday morning will probably be Blanik reassembly. The wing pins and safeties are all in the gray Blanik tool bag which is in the trailer. Also, there is a board meeting Sunday morning at Byron starting at 9:30 AM. The G102 has passed its annual and can fly as soon as we put it back together (e.g. seat pan, etc.)! Bob Hancock has asked that we tighten the canopy hinge screws, but this does not have to be done before we fly it. So any volunteers? The new wing tip skid on AS broke on Sunday and tore a small hole in the aileron fabric. Bob Hancock has seen it and said that Bill Bullis can patch this and he will sign-off on the work. Both are scheduled to happen this Wed. Bob Hancock is also scheduled to look over EV on Wed. and will meet with Fran A and Bill B at that time to update the annual and check the work that has been done to date. After that the plan is to fly EV to Livermore and have Steve Brown update our weight and balance, then put it on the flight line. I will reinforce them with some sheet metal to be extra double sure they don't tear. So if anyone is planning on landing out, you will have to use the Grob trailer to fetch the wings again. Also, did we ever resolve the problem of getting the shear pin out of the tail of 53AS? If not I found a piece of 1/2" steel plate I can use to make a similar but better extraction tool with. I had a great day of soaring with a 2 hr flight working thermals, ridge, and convergence lift. I got some excellent instruction on flying in the mountains from Dale Masters. If you are going to the next altitude training session in March, you should consider checking out their operation. They have a Blanik L-23, a Grob103, Grob102, and the ASK-21. They do not have a web site, but you can call them at 805 822-5267. (However, flying at a commercial operation really makes you appreciate the NCSA. at $45/hr for the ASK-21, plus tow and the instructor the bill adds up quick.)
