At the time, that person had 38 active auctions, and I reported all of them. eBay removed two of them, and they were both resubmitted within two hours of their removal. I told eBay this, and they said that unless I was an authorized representative of the artists, they had to be extremely careful about removing auctions, and that unless it was ridiculously obvious (like MP3 collections), they wouldn't do it. eBay is in a precarious legal position: if they start policing *some* things, they have to police *everything*, and they can't possibly police everything, so unless it's blatantly obvious, they won't deal with it. So they've instituted a program where if you are an authorized representative of the artist, *you* can police things and they will remove items immediately for you if you tell them about it. They recommended I contact such a representative to tell them about it, and have them sign up for the program. While I think copying MP3s to CDRs and selling them on eBay is pretty slimy, the fact that it's there is already illegal, and no one on this list has a claim on the material, so I would suggest letting it ride. It's even worse than that. I've spoken to a few representatives of ebay (I had some auctions that were cancelled as well) and what they told me was pretty disturbing. Their policy is akin to the fact that they don't police their site at all. They only react to people mailing them about infringing auctions. What, IMHO, this amounts to is if the government said that the new policy on speeding was: "You can drive as fast as you want, and we won't pull you over, UNLESS someone goes up to a police officer and points you out as a speeder, in which case we will give you a ticket." I feel that this practice is discriminatory, and very ripe for abuse by bootleg sellers that want to knock out competition, and just people that like to make trouble in general (of which there are a great many on the net). If you are unhappy with this policy, just tell them. e-mail safeharbor@ebay.com or any of the other various ebay addresses and tell them to either police their site or don't. Anyway, even if the guy who's selling the disk has all of his stuff removed, he's already advertised his product and now has e-mail addresses of people who are interested. I find it ridiculous that anyone would actually spend $30 on a disk full of mp3s. If someone on this list was simply offering the disk, at a reasonable rate, just to conserve bandwidth on the OAA and help those with slow connections, that'd be different. But this seller is probably trying to pay off his cd burner. There's plenty of bootlegs being sold on ebay all the time but there are specific reasons why we, as Orb listmembers should have a big problem with this particular auction: The OAA was created by and for the orb listmembers, and all of the material in it was donated by orb listmembers. While we (the orb listmembers) don't "own" the incredible music contained within the OAA, we did obtain permission from the Orb to do it as long as it didn't contain in-print material and was not done for profit, etc; and there has been an incredible amount of time and effort put into it's creation by numerous listmembers ripping their rarities to MP3 so that the rest of us could enjoy them free of charge. I feel like the person running this auction has stolen from us -- the orb list. If we all donated our time and effort to see the OAA come to fruition, why should one guy who downloaded the whole thing stand to profit from our efforts? It's just not right. Why should someone pay over $60 for 3 $2 CDR's of this stuff if he/she could just download it from an FTP site for free? If you want to "do someone a favor" and burn a CDR set of the OAA, then it should be just that -- a favor to a fellow orb fan, with maybe a small charge to cover your time and costs -- that would embody the true spirit of the OAA. Ebay is NOT the forum for spreading the contents of the OAA, this seller is making dirty money off of our efforts to amass such a large collection rare orb MP3's in one spot. I personally will make an effort to have this auction killed, and I will email all of the bidders instructions on how to download all of the files contained on that CDR set from my ftp site FOR FREE. Jed is a big fan of electronic music and probably plays more of it than anyone else on KROQ, except for Jason Bentley. Richard Blade, who plays almost exclusively 80's stuff, uses Orbitals Halcyon. So I'm hoping that someone on the list with an Aubrey Mixes to spare has a need of either Orbscure Trax or FFWD. Orbscure Trax is more rare than Aubrey Mixes, and IMHO is a better CD, but since Aubrey Mixes are so hard to come by right now, I have a few other things I might be able to throw in, or some cash. Same with FFWD. I would prefer not to trade both OT and FFWD for Aubrey mixes, unless something else got thrown in by the other party as well. They played all the best new music of the day. But by the late 80's they let their best DJ's go. Freddy Snakeskin and Swedish Eagle went off and started MARS-FM the first Electronic Music station to hit Southern California. Eagle came back to try again with Groove Radio which was good for awhile (until they fired Eagle). Alex was interviewed one night and came back to play a set later in the evening. To cut a long story short KROQ went to the Seattle scene in the late 80's/early 90's and to be frank they really suck now. In the past couple of years they have put Jason Bentley on Saturday nights at Midnight for 3 hours of mostly electronic music. So I will at least give them credit for that.
