From: "Leonard Wojcik" Subject: City Council Meeting Date: 07 Apr 1999 06:30:48 -7 4/07/99 Last night's meeting before the Salt Lake City Council was very effective I think. The turnout was certainly outstanding. The large council chamber was full, mostly of UGAA people, with at least 20 or so people standing. In addition we had at least half a chamber full standing out in the corridor. The point was made that the aviation community cares, and that they will not accept bad leases and that the problem won't just "go away". Thanks to everyone for an outstanding turnout. This is not something that the administration (both city and airport authority) can brush under the rug. I think that at this juncture, the Airport Authority will have to come back and negotiate in good faith, and make sure negotiated changes are incorporated into the leases. I am sure they don't really want to see us again! So where do we go from here? The lease committee will carefully monitor the actions of both the city council and the airport authority at the meeting next tuesday. We will meet with the airport authority representatives when they are willing to deal fairly and honestly with UGAA and fashion an acceptable lease. I hope it will be soon, this has festered for too long. i.e. "I'd rather be flying" :-) Thanks everyone for the great turnout .... you done good ! I, too, think the turnout at the City Council meeting sent a definite message to the council and the mayor that there is still a serious problem with the hangar leases and mechanic's access. The council was quite impressed with the numbers of people who attended the meeting to express their displeasure with the situation at the airport. It is absolutely certain they do not want that kind of crowd to attend every meeting. In that vein... The airport and the mayor's office will be presenting their side of the story to the council next week. If they dig their heels in and refuse to compromise, everyone should be prepared to return to the next public council meeting. We do have a couple of other issues besides the Hangar Leases that need to come up. Another being that Pack said we were offered a position on the airport subcommittee. I was the only one who spoke in the comment period (and not very well, I'm afraid). UGAA was not on the very packed agenda. The Council told me that the administration had made a response, and that the lease is an administrative matter. The council feels the Airport Authority has done a good job at compromising and has agreed to several UGAA requests. The council, while thanking us for coming before them and acknowledging our right to do so, is directing us to work with the Airport Authority since the lease and related issues are an administrative (not a policy/Council) issue. I was provided a copy of a Fax of the April 8 letter/response from John Wheat, Interim Director of Airports. Copies are available by contacting Roger Black at the City. Or if all else fails I can fax you a copy of my copy. In his response, Mr. Wheat states: "The overall intent of the re-write waa to ensure that the leases conform with best commercial practices and related landlord/tenant matters. The revised lease is typical of storage facility leases; however it additionally incorporates language related to and required by airport operational, security, and safety issues." As I read his response there still seem to be several unanswered issues. For example 1) if an airplane belonging to a club is sold to someone not on the registration at the time of the lease execution, the lease is terminated. 2) 15 day termination remains, justified by the "month-to-month" nature of the lease. 3) it appears that we might be agreeing to be held liable for any environmental problems in perpetuity after we lease a hangar, even if they were caused by a prior tenant (as a practical matter, how would you prove this?). 4) Independent mechanics are left in the twilight zone of Title 16 compliance and interpretation. My personal hot button is #4, but I also don't see how any partnership or club can live with #1. So: what do we do now? I am writing a letter to the city council and airport authority and copying AOPA and at least one attorney with an interest in this matter. I have sent suggestions during the negotiations and written letters. I feel this has been swept under the rug along with trying to get the rent rolled back. To be honest, we feel issues at the International Airport are the only ones being addressed, except for the mechanics issue, and we at Airport 2 are left on our own. We would like better wording in the hangar lease so that when we need something addressed or fixed with our hangars it will be taken care of instead of nothing being done like before. UGAA is very cognisant of the differences, and are working to get the changes made. We are at this time trying to establish contact with the new administration, get changes made that were agreed previously and fix a couple of outstanding problems.
