Review 3/1/96 Date: 01 Mar 1996 22:38:20 -0700 Utah Shooting Sports Council 1996 Utah Legislature General Session Final Legislative Review Information Current as of 1 March 1996 Provided by Scott Engen, Government Liaison, Utah Shooting Sports Council The 1996 General Session of the Utah Legislature was a real nail-biter for Utah firearms owners as several pieces of firearms legislation were in question even as the final gavel dropped at midnight on 28 March. Let's take a look at the pieces of legislation that passed and didn't pass the 1996 Utah Legislature. The Bills that Passed the 1996 Utah Legislature: HB8 -Limitation of Civil Action-Rep Sue Lockman (R-Kearns) This bill will provide a legal defense for a crime victim against being sued by a criminal in civil court if the criminal is injured or killed while in the commission of a felony. This applies to most injuries and losses, including those caused by self defense, dog bites, slip and fall or other similar circumstance. The criminal, in order to collect any such damages, must prove his actions didn't constitute a felony, and his criminal culpability was less than the individual he is trying to sue. There are also provisions that the criminal must clearly retreat from the criminal activity, by ceasing all hostile, threatening or criminal behavior. The bill as passed by the House would have extended much greater protection to crime victims, by covering all crimes. The members of the Senate Judiciary Committee, including Senator Craig Taylor (R-Kaysville) and Senator Lyle Hillyard (R-Logan), both civil attorneys, removed many of the broad-based protections the House version offered. After a rewrite the bill emerged as above from conference committee. The bill will provide a basis upon which to build in the future. HB70-Fines for Poaching-Rep Michael R. Styler (R-Delta) This bill makes another step toward protecting our wildlife resources from the threat of trophy poaching, on a large scale or for profit. The bill provides additional levels of fines and severe penalties for poaching various trophy species, and provides for jail time in some circumstances. USSC requested several amendments to the bill, including keeping the current level of fine for cougar poaching, which was finally set at $ 500.00, and allowing a judge to have some latitude in sentencing jail time for these offenses, to give priority in jail space to those criminals who commit violent crimes. HB 165-Concealed Weapon Permit-Rep. Michael Waddoups (R-Taylorsville) This bill clarifies a point in the concealed carry permit law which allows the Utah Department of Public Safety to collect the pass-through charge for services from other agencies for fingerprint clearance as required by current state law. USSC will monitor this situation to insure such authority is not abused. HB 418-Secure Facilities Amendments-Rep. Michael Waddoups (R-Taylorsville) This bill will help meet specific concerns of law enforcement and the courts regarding the possession of weapons and other items within specific, non-public access, high-security areas of correctional facilities, courts, law enforcement facilities and mental health facilities. This will require that any of these agencies that wish to have a "secure area" must follow very specific criteria, such as providing secure storage lockers for CCW holders to store firearms, posting of signs at all entry points, and using the administrative rule making process with it's public notice, review and input prior to designating such areas. USSC proposed an amendment which would make the agency declaring a secure area fully responsible for the physical safety of an individual while in a secure area, but this was removed in committee. This bill was on the Governor's "Must Pass" list. The Bills that Failed to Pass the 1996 Utah Legislature: 1ST Substitute SB93-Firearm Locking Device Senator Lane Beanie (R-Bountiful) The original version of SB 93 would have required every firearm that was sold, leased or transferred in Utah by any federally licensed manufacturer, importer, wholesaler, distributor, dealer, pawnshop or gunsmith be equipped with an external locking device at the time of sale. Any violation would have been an "A" misdemeanor, punishable by up to a year in jail and a $2500.00 fine. SB 93 was amended by the sponsor in committee to include only those sales or transfers by a licensed dealer to the public, and reduced the penalty to a "C" misdemeanor punishable by up to 90 days in jail and a $ 750.00 fine. The bill was further amended on the Senate Floor to include removal of the requirement to sell a locking device with each purchase or transfer and replacing it with a requirement that the dealer "affirmatively offer to sell" a locking device. Dealers must have a locking device available for sale that will lock the type of firearm purchased, and must "explain the locking device's use and why it may be needed." Any violation by the dealer will be an infraction level criminal offense, punishable by a $50.00 fine per violation. It was clear from the discussions on the Senate floor and from statements made by the sponsor in the House Education committee that this was just the beginning of this type of legislation, and a number of Senators and others spoke in favor of the original bill with it's mandatory sale of the locking device. SB93 then went to the Utah House where it was replaced in its entirety by a bill "strongly encouraging a publication on firearms safety and information be included at point of sale. The Senate refused to agree with the House amendments, and the House refused to back down from their position on the bill. During the final hours of the session a compromise was offered by the House to include some of the Senate provisions in the bill, but the Senate and sponsor appears not to have agreed with the compromise and the bill did not pass before midnight. It is critical to note that the President of the Senate has a great deal of political horsepower in getting what they want in a piece of legislation. Utah gun owners can expect to see this legislation again should the sponsor return to the Senate in 1997. HB 192 Negligent Storage of a Firearm-Representative David Jones (D-SLC) This bill would have made a massive shift in the burden of proof needed to win a civil suit in the event of a firearms accident, would have allowed a court appointed attorney to sue the parents or take the children of a parent whose child had been involved in an accident, and would have been the end to junior firearms training and competition as we now know it. Because of the efforts of USSC, and most of all because of the willingness of many Utah individuals and organizations to make the phone calls, send the letters and faxes, and attend the hearings, this very dangerous bill was stopped in committee. This bill had been the darling of the media, and the flagship of the 1996 anti-gun agenda. This demonstrates what your dedication and hard work can do to help protect your firearms rights. Utah gun owners can expect to see this legislation again should the sponsor return to the House in 1997. HB 196-Defining Unlawful Activities-Rep Steve Barth (D-SLC) This bill would have placed all of the Utah wildlife code under the Utah RICO statutes, allowing wide latitude in the investigation and prosecution of wildlife law violators. Intended to target large scale poaching for profit operations, USSC expressed concern that the potential for abuse of process by law enforcement and prosecution was very high. A compromise worked out by USSC, DWR and the Utah Statewide Prosecutors Association would have limited the bill to only those wildlife violations which constituted a felony or those which were committed with the primary purpose of profit. The bill passed the House and was not passed by the Senate prior to the midnight deadline. HB 303- Cruelty to Animals-Rep. Frank Pignanelli (D-SLC) This bill was part of a package of animal protection and animal rights bills run by this sponsor in response to several recent high-profile animal cruelty incidents. The bill was extensively rewritten prior to committee hearings, and was further amended by USSC to insure that both protected and non protected wildlife, along with domestic livestock and accepted training methods for sporting and hunting dogs were exempted from any provisions of the bill. The bill passed the House and did not make the midnight deadline for passage in the Senate. HB 329-Spotlighting Wildlife- Rep. Michael Styler (R-Delta) This bill would have placed the current DWR rule regarding spotlighting wildlife into the Utah code. The bill would create the prima facie presumption that if you have a gun and a light in any area where protected wildlife is found, you're engaged in spotlighting wildlife. USSC provided amendments to the bill which would require that the taking or attempted taking of protected wildlife must also occur to be guilty of spotlighting. Any normal use or possession of a firearms and a light would not be criminalized. The bill passed the House and was sent to the Senate, but did not make the final sifting or selection for Senate floor action. HB 482-Juvenile Offender Amendments-Rep. Michael Waddoups (R-Taylorsville) This bill would have allowed Public Safety to access the records of juveniles convicted of violent felony level criminal behavior and prevent them from getting a concealed carry permit or lawfully purchasing a firearm. It also allows for a juvenile with such a background to apply for expungement of such a record with the court. USSC feels that such violent juveniles should be held accountable for their actions, and supported the bill. The bill did not make it through the Senate before the midnight deadline. That in a nutshell was the results of the 1996 Utah General Session of the Utah Legislature. All Utah firearms owners came very close to really getting the shaft this vear. As you read this report, I hope you will realize several important points. First, those individuals, organizations and politicians that are opposed to your firearms and hunting rights are well organized, well funded, highly motivated and have a sympathetic media on their side. Second, that you and organizations like USSC, the NRA and publications like AGR are about the only thing that stands between those that will take your guns and your hunting away from you. And third, that the only way that organizations like USSC, the NRA and publications like AGR can be effective in protecting your rights and interests is if you make the commitment today to support them with your own hard work, your membership, your contributions and personal efforts. The last one I called was Utah's lone Democratic member, Orton. He has been pro gun. I spoke with Alex in his office who told me that the rules committee was only deciding the scope of the debate to take place and the actuall bill to be debated had been decided--hr125. He said that most of the provisions which increased federal power had been removed, but was sympathetic to my concerns. Stockman's aid who handles this issue is out so I have no idea what the status of his bill is. Interestingly, my latest issue of American Rifleman showed up today. (I thought my dues had run out a long time ago. I wonder why I still get their magazine. ;) In the "Knox's Notebook" column is a bit about Barr's HR 125 and a discharge petition to force it to the floor. Knox urges support of the discharge petition and the bill. He never even mentions Stockmans bill. Funny that NRA's alert seen here a day ago said a bill number wasn't yet known. Why does the NRA insist on support Barrs, at best, mediocre bill while completely ignoring Stockman's nice clean repeal. We all know neither one is going to get past the President's desk. They didn't know what the numbers were. I immediately contacted both Sens Hatch (R-UT, chairman of Judiciary Cmt) and Dole's offices letting them know thatI expect the Republican party to keep its promise to gun owners to bring this thing to a vote. I let them know that my support for Dole and the republicans in general is conditional on this promise being kept. (It's also conditional on several other things which they've already screwed up.
